      Complaint: ********

I am rejecting this response because:

      Hello,

******** ****** said that the ******** pan should absolutely NOT have been put over a hole the size that J&R Tile installed it on. They said it will fatigue in up to 3 years, fail, cause water damage and collapse ( someone would fall through the floor) so it should not be used until repairs are made. Further, the shower was inspected before first use so to blame me for improper drain placement is simply trying to avoid culpability. It is an installation problem. Had they done it correctly the first time, no repair would be needed.

      Thanks,

      Megan *******

through the hole. I reached out to Jand R Tile with all this information and requested he fix it and all associated repairs at his cost. His response via email was to state he was not the framer or plumber. That he could send guys to help install bracing around the hole should I want; they don't drywall or paint; that
currently I do not have any issues related to your TILE install.
Stating they aren't responsible for the plumber or framer is irrelevant given that the framing and plumbing was done when the house was built with no change to either during the renovation other than to leave a PVC pipe for the tiler to use to set the drain where the old drain was cut.
Furthermore, given that J and R Tile were fully aware that there was a hole in the floor and they are experts at tiling, it is not unreasonable to expect they knew to install plywood to mitigate water/structural damage to property and to prevent injury if floor were to collapse around the drain. The shower is currently unusable.

We have offered Megan the best solution.  She had an acrylic pan that was in place prior to which has/had same weights and characteristics as our pan.  The client has a 1 year warranty with us on parts and labour.  With what we have provided her she has no issues at all with the work or any deficiency of the product at all.  The cover popped up once which was probably not put in place by her properly and since then the piece has not popped up.  So in essence she has no real claim or anything to dispute.  Further to that we offered our services to help out  once she opens the ceiling.  Why would the painting and drywall be on us??  She currently has no issue at all in the shower and no evidence of any issues so we are going above and beyond with our service offerings

      **** ****

Megan was the demo, carpentry and plumbing contractor on this job.  She was aware of the size of hole left and was notified by it and her response was the blue rigid insulation gap is strong enough.  We have offered in good heart to help her and send our guy to help brace from below but mentioned to her to cut the drywall and open so we can help her brace.  Considering she was the contractor I don't see why she is refuting to do this and an amicable solution was offered.  Furthermore to that she does not have any deficiency or issues currently.  Her scenario is one of what if and not facts.  Again we are here to help her but again she needs to take responsibility for her construction management.  Further to that I have spoken to ******** systems today and again the solution that is being offered in their opinion is a great service offering on our end.  Lastly they also mentioned that nothing may happen.

      Thanks
