Bathurst Honda took a $500.00 for a Honda Odyssey on December 5, 2024. We test drove and met with them on December 6 at 1:30pm. We explained to them that we were also considering a Toyota Sienna from another dealership and that we would only decide the following day which one we would take. They said we had until 5:00pm the following day to decide. The following day we decided to move forward with the Sienna, we notified Honda before 5:00pm. They said we had to call with our credit card for reimbursement. They then dodged all communications. Today, December 11, I went to the dealership to complete the transaction and no one would speak to me. The saleswoman called me after I left to tell me they changed their mind and they would no longer reimburse my deposit even though the discussed conditions were met.

A $500.00 deposit was received to hold a 2024 Honda Odyssey for 24hrs. After 24hrs the client requested more time to make a decision and was asked to sign a document stating the deposit would only be reimbursed upon purchase of said vehicle. After 48hrs the client decided to purchase another vehicle at a different dealership thus forfeiting the deposit. In good faith after meeting with the client we have come to an agreement that both parties felt was fair.

On Oct 9 2023, me and my son bought a 2017 Subaru wrx with 104000 km for $26,525.00 plus taxes at Bathurst Honda, in Bathurst New Brunswick. The first day, there was a check engine light, they took it in and gave my son a courtesy vehicle, 3 days after they told him his car was ready, 5 min later engine light again, they disable something, told him it was good to go, but they were to give him an appointment to get it check at moncton Subaru. On Friday the 13 Oct, he left for his work wich is 1h1/2 from home when he got there the motor was knocking bad, the next morning the motor blew up 20 feet from his driveway, they had is car towed back to the dealer, now they accuse him of damaging the courtesy vehicle so they don't want to give him another one. So now he is stuck with no car to go to work... as I had to co sign for him, we demand that the contract for the 2017 Subaru to be canceled... thank you

I can confirm the vehicle in question was purchased on
October 10th, 2023 and was in good working order at time of
delivery. Shortly after delivery, the customer communicated that the check
engine light came on and we advised the customer to bring the vehicle back in
for a diagnostic test. At that point, a courtesy vehicle was provided to our
customer while we conducted our diagnostic testing. During this time, it was
reported to us by a local business owner who observed that our courtesy vehicle
was being driven very recklessly off road in the power line trails. We
contacted the customer to advise our diagnostic testing was complete and to
have our courtesy vehicle returned. Upon arriving at the dealership the client
advised that he hit something in the road and that it broke the exhaust system
on our courtesy vehicle. I have attached various pictures confirming the damage
on our courtesy vehicle. The customer was made aware that a further repair
would be required on the vehicle he had purchased at the closest Subaru dealership
which happens to be in Moncton and that we were waiting for an appointment
confirmation. We advised that we were willing to cover the charges to repair
his vehicle as long as he was prepared to cover the cost of repairing our
courtesy vehicle that was damaged while in his possession and he agreed to this.
While waiting for the appointment confirmation from Subaru of Moncton the
client advised that the engine had ceased working. We proceeded to have the
vehicle towed back to our dealership and confirmed the engine would need
replacement. Understandably, due to the condition of the last courtesy vehicle
provided to the customer another courtesy vehicle was not offered. We have
since replaced the engine in the vehicle and have towed the vehicle to Subaru
of Moncton to complete other required repairs to insure the vehicle is in good
working order before returning it to the customer. We are currently waiting for
completion of these repairs and once completed we will return the vehicle to
the customer with expectation that the damage on our courtesy vehicle will be paid
by the customer as part of our agreement.

I am rejecting this response because:

We are not accepting the offer, we have had to many lies from the salesman and the ******* telling us there is no way we can return the vehicle beffore 30 days...

We want the contract to be canceled as we have lost all confidence in the dealer and its management and that if something happens in the near future my son won't have a courtesy vehicle to go to work.

I have allerdy contacted a lawyer she is just waiting for me to give her the ok to bring this mater to court.

I would like to resolve this out of court if the dealer would be reasonable

    Thank you

    Business Response

    Date: 24/11/2023

That is correct; a person cannot just decide to return a vehicle within
30 days like purchasing an item at ******. I understand issues have arisen with
the vehicle shortly after it was purchased, but we are in the process of
repairing the vehicle so that it is in good working order. If the customer
would not have damaged our courtesy vehicle by driving it off road very recklessly as seen by our eye witness,
he would still have a courtesy vehicle to drive to and from work while waiting
for the repairs to be completed on his vehicle. I now wonder if it wouldn’t be
possible that the customer after taking possession of his new vehicle didn’t
take it out for a similar reckless joy ride that ended with the vehicle being
in its current state. ******* Honda Bathurst will be holding its position in
having the vehicle purchased repaired and returned in good working order with the
expectation that the damage on our courtesy vehicle will be paid by the
customer. Otherwise, we will begin the process in taking legal
    action.
