      We have been trying to have Allsco correct issues with our Windows for nearly a year now. We placed an order for around 36k and after 10 months some of our order has yet to arrive. We have leaks, defects, and missing parts still waiting for Allsco to make it right.

      We had purchased all our Allsco windows/patio door/Front door and exterior doors from **** ****** in 2019. We should have the Allsco warranty that was stated in writing to us. I reached out to Allsco on our defective Windowpane and their response is that all windows purchased previous to 2022 the new owners are advising is now voided. I had also reached out on a window seal leak and they are advising that this too is voided; although is it showing in writing we have lifetime warranty.

      Details on the Defect:
      I had emailed Allsco telling them of the manufacturer’s defect In our front door top windowpane which had dropped. I had premier (Allsco representative repair company) come look at the window Pane to repair and I had requested to see the damage when he exposed the glass. The glass had dropped which caused the crack of the Windowpane. Allsco were calling it a stress crack when in fact it cracked because the pane had dropped from the glue. This is a defect. There were no shimmies or anything underneath it to protect it or prevent it from dropping. I have included pictures below as a reference. We have a 5 year warranty on our front door which would be ending this year as it was purchased in 2019.

      Spent over 9K on windows
      One was made wrong and could not be fixed. (Told this by the company technician after he spent 2 hours on it)

      Window is visibly slanted and doesnt close properly.
      Whats the point of warranty? Will be taking this to court

      To Whom It May Concern:

      On February 10, 2023, Allsco Windows and Doors and associated
      entities filed an application in the Court of King's Bench in Manitoba (the
      “Court") and commenced Court supervised restructuring proceedings under
      the Companies' Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended (the
      “CCAA").

      This period will allow our group of companies to restructure to the best
      interest of all stakeholders, which includes all of our customers.

      The Amended and Restated Initial Order (ARIO) provides
      for a stay of proceedings which prohibits all parties from commencing or
      continuing any legal action against the Applicants, and all rights and remedies
      of any party against or in respect of the Applicants or their assets are stayed
      and suspended except with the written consent of the Applicants and the
      Monitor, or leave of the Court. All creditor claims would be caught by the stay
      of proceedings.  Further information in respect of the proceedings can be

      Regarding the filing, ignorance of the law or the existence of say a Court Order is generally not a defense accepted in jurisprudence related to civil or common law. However, the Applicants are not faulting *** ***** ** ****** ****h of New Brunswick on the filing error and are only seeking a reversal of the error now that the error of a prohibited filing is recognized to have occurred.

       

      For now, the Applicants accept and appreciate that a note has been placed on FSC-255-23. The Applicants are focused on other matters and will not be filing a Statement of Defense or other forms or responses to this matter, at this time, as the T** ***** ** *****s Bench of New Brunswick is now aware that the matter cannot proceed any further during the stay.

       

      I sincerely appreciate and thank you for your timely and detailed responses on this matter.
