      I have a disability tax credit through cra due to I have MS and my disability tax credit was expiring this year in 2023 so I had to renew it and it took 20 weeks to finally get approved because when I first applied for my disability tax credit in 2018 cra forgot to add in my 2016 year when I was diagnosed with MS so it got put on this years renewal which was approved on September 30 2023. I had applied for bankruptcy back in August 2022 for 9 months. My discharged for bankruptcy had ended on May 11 2023. The CRA is sending a cheque out today on Oct 18 2023 for the amount of $2034.63 to Allan Marshall's & Associates because they are still on my CRA account. The money they are sending out is for a back time pay of my disability tax credit for 2016 and Allan Marshall's are giving me the run around like transferring me to all these different people and when I went to call them to let them know what the cheque is for they were not listening to me on the phone and I had to keep repeating myself. CRA told me that cheque is my money and I am entitled for it and when I went to send them the email I got from CRA with the attachments of what the email said that was on my CRA account they didn't get back to me til the next day which was this morning and they explained it took forever for it to go through if they are telling the truth. It seems to me that they are trying to keep that cheque for themselves and they probably will give me a hard time trying to get my money back that is mine not their money. I dont trust them at all they are crooks and thats why I am emailing you today to let you know that my cheque that CRA owes me is going to them and they are suppose to send the cheque to me so I am making a complaint about my money being sent to them and that if I have to fight to get them to send me the cheque to my address.

      A timeline of events according to our Notes and Logs on the complainant's file

      1. The complainant contacted our office on Friday, October 13th, 2023 to advise that her 2016 Income Tax Return had been re-assessed by Canada Revenue Agency ("CRA") to approve her claim for a Disability Tax Credit and that they would be issuing a refund. 

      As part of the bankruptcy process, any income tax refund the bankrupt is entitled to for the year they file the bankruptcy, vests with the bankruptcy Estate and is directed by CRA to the Trustee's office. It is our understanding CRA notes the bankrupt's file on their end to send any prior refunds to the Trustee's office as well, for the Trustee to determine whether they vest with the Estate as well.

      On the 13th the complainant spoke with ***** ******** about the 2016 re-assessment and refund. Mr. ******** advised the complainant that our office had not yet received anything from CRA. The complainant was upset, worried that we would "keep her cheque". Mr. ******** advised that once we received a copy of the Notice of Re-Assessment and the refund cheque, we would review and if the complainant was eligible to receive the refund we would issue it to her, but that he couldn't provide her with an answer at that time because we had yet to receive anything from CRA.

      2. On Monday, October 17th, 2023, the complainant contacted our office again via phone. Mr. ******** was not available for the call and I, Joshua Lowney, took the call. The complainant was again upset, stating that CRA told her we would just be receiving the cheque and no explanation and she was worried we would just keep the cheque. I assured her that it not our practice and we administer our files in accordance with the Bankruptcy and Insolvency Act and that our Tax Department would investigate any cheque received to determine whether it needed to be returned to a bankrupt or whether it vested with the bankruptcy Estate. The complainant stated she received something from CRA confirming what the refund was for and wanted to provide to our office but was hesitant to email due to security concerns. I suggested she drop it off at our Moncton Location. It my understanding from our front office staff in Moncton that she did come to the office but did not have a paper copy, she then attempted to email screenshots of the letter to one of our staff. The staff member had not received the email as of the end of business day on the 17th and left for the night. On the morning of October 18th, 2023, the staff member checked her email and had received screen shots of the complainant's 2016 Notice of Reassessment.

      In the meantime, our Tax department received a copy of the complainant's 2016 Notice of Re-Assessment in the mail from CRA on the 17th as well. Which confirmed that CRA was issuing a refund due to the approval of the complainant's disability tax credit. But a cheque was still not received. 

      On Tuesday, October 24th, 2023, today, our office received the refund cheque from CRA. Mr. ******** reviewed the file and determined that the cheque did not vest with the bankruptcy Estate and directed our Tax department to issue the cheque back to the complainant. We had yet to contact the complainant to advise her the cheque would be issued to her when we received the email complaint from your office. 

      From our perspective, our office has acted in accordance with the rules and regulations of the Bankruptcy and Insolvency Act and made every effort to treat the complainant fairly and explain things as clearly as possible. We believe this complaint has no merit as we will be issuing the refund cheque to the complainant, as requested.
