Three weeks ago(Oct,20,2024) I found a handyman on the ******** community because part of my house deck was tilted. It's Sunday, so no one can work, but he(J******** from Vivero property service)contacted me and met him for the first time. It's too small a repair, so I appreciated him and paid 150$. While talking to him, he saw my company logo and said he knew our company, so I trusted him especially more. That's how I got to ask him for an estimate for my house deck and basement renovation.
So, The deck will cost $7,000 and the basement will cost $7,000, a total of $14,000.
Basement construction will run from Nov. 4 to Nov. 8, and basements will run from Nov. 12.
Last Thursday(Oct,30,2024), he asked me to deposit $3,500, which is 50% of the construction cost, to purchase the materials needed for the deck construction.
So, I deposited the money to him through E-transfer. However, I have not been able to contact him well since then and the construction work has not proceeded until now.
He sometimes responds only with messenger service on ********* Then, he says he contacts him in the evening and has no contact. He always avoids contacting customers by saying he is seeing them.
I check the company's review through BBB site, 5 customers suffered the same damage as me. But can the company still work with the same company name and contact information?
So, I believed him. because I told him I saw a review of the BBB site, but he said there was no problem because he explained everything. I was stupid to believe this. I should have checked the BBB site accurately before sending the deposit, but I couldn't.Customer Answer

I was communicating with Jonathan Carvery (Johnny) from Vivero Property Services starting on March 14, 2024 regarding a new deck and retaining wall for the back yard. We agreed on March 17, 2024 on the scope of work and that it should go ahead. We had hired Johnny and his crew on August 1st and 2nd of 2023 to install a French drain to deal with flooding issues. They did a good job and built a lot of trust with us as a result.
This is the summary of work agreed upon (there were additions as work began):
Existing Deck and Retaining Wall Demolition $3,450.00
Deck Construction (with privacy screen) $14,329.00
Retaining Wall $9,062.00
Sod $4,600.00
Total $31,441.00
Payment was made before completion of the work in order to secure building materials, at the insistence of the business.
Work commenced on March 27, 2024 and finished on April 24, 2024 for the demolition of the existing deck and retaining wall as well as the construction of the new deck. However, by May 17, 2024 the business became unresponsive to phone, text, or email. The incomplete work which was promised was construction of the new retaining wall and laying down new sod for the back yard (a total of $13,662). I would like the business to refund this amount since the work has not been completed and they haven't produced any plan to do so.
The business has already been paid in full according to the following schedule:
March 26, 2024 $10,000 (cheque)
April 6, 2024 $7,500 (cheque)
April 26, 2024 $9,340 (cheque)
May 3, 2024 $4,600 (cash)
I am seeking a refund for the amount of $13,662 for the incomplete portion of the work which has already been paid for. The last I heard of Johnny was a text message on May 17, 2024 at 2:00 pm saying he would call me later that evening. I have not heard from him since despite repeated phone calls, texts, and an email.Initial Complaint

This "contractor" was very aggressive in asking for money upfront. The job was quoted as around $28,000 tax in. We paid 50% upfront even though the cost of the quoted materials was less than $3000. (Our bad for not looking into that.) We specifically asked for a proper French Drain, and all that was done was a bunch of river rock (!) dumped into a shallow trench. I have a ****** and could have easily done that if that is what we wanted. We were very clear, and the quote indicated we would receive a proper French drain with perforated pipe and landscape fabric as an underlay. The "contractor" made an executive decision to ignore the requested work and what was quoted and instead use only the river rock (which was an odd choice for a drain as it's the most expensive form of rock), and no drain was installed. I called ****** *********, and the cost of materials (retail) was approximately $1,400. We paid $14,000 and need to redo the trench and rebuild the retaining wall, which was incorrectly done. This company ( Vivero Property Service ) promised to do landscaping work for my backyard in August 2023.
The service includes (sod installation in the backyard, removing the existing lawn, adding fresh topsoil, and installing Kentucky bluegrass sod). And that cost me $2,438 CAD They asked me to e-transfer the money for them before starting the job with the excuse that they had to buy the materials.
Since that time no one has shown up or come to my house.
I kept texting and calling them but they kept giving me excuses such as they were busy or it was raining, etc....
I asked them many times to return my money back but unfortunately, they stopped responding to my messages and my calls.
I called the police, they reached out to him and he told them that he would call me back. but he didn't call or text or even reach me.
I went to the bank as well but they couldn't do anything because it was through e-transfer from my checking account.
The Business and Consumer Services referred me to you to file a complaint.
