      I have been unable to have the electric corded chainsaw that I delivered to B J ELECTRIC (abbreviated BJE) many months ago, repaired and delivered back to me.
      Description of Complaint:
      I delivered an electric corded Remington chainsaw to BJ ELECTRIC (abbreviated BJE) on May 21 2021 for a repair on a non-functioning electric motor and have made repeated email and telephone requests over many months to enquire as to the progress of the repair but I keep getting no satisfactory response; these request dates and a brief statement of their contents are listed on the attached pdf file: CHRONOLOGY OF EVENTS.pdf
      My last email to BJE on July 21 2022 to the listed President of BJE (Stewiacke, NS) to which I attached the CHRONOLOGY OF EVENTS.pdf, and in which I requested:
      (a) the present status of the repair
      (b) the timeline for its delivery
      has received no response from BJE.

      It was great speaking with you this afternoon. I apologize for the delayed message regarding our transition away from the repair of commercially available goods, this is something that you should have been notified about in July 2021.

       

      As a gesture of good faith we would like to replace the saw for you and/or cover the cost of the unit. We will be in contact in the next day or so regarding the steps forward and hope that this can make amends to the events that took place.

      As a result of a recent ownership change that took place in July 2021, BJ Electric Motor & Control no longer repairs small power tools and appliances. This information should have been communicated to the customer in August of 2021. Unfortunately, this was not the case and acquiring parts was attempted and resulted in being unsuccessful. The customer was made aware by phone after their first complaint that the units location was unknown at this time and that a cash payment or replacement would be offered. As the units previous is no longer available for retail purchase a cash payment resolution for the goods in the full amount of their value was offered to the customer. This offer was rejected by the customer.

      At this time we feel that our offer to pay for the full value of the power tool is more than fair given it was received in an unusable state. 

      Given that our resolution is more than reasonable, no further offers will be made at this time.

      This email is being sent to BBB which I anticipate will be further transmitted to B J ELECTRIC [BJE]

      by BBB, and concerns my response to the Aug. 12 2022 “MESSAGE FROM BUSINESS” . 

      The purpose of this email is to discover what the BJE-alluded “full value of the power tool” is in actual dollar terms. 

       

      The discussion below refers to the background of this determinative process to date, and corrects some

      misstatements of fact by BJE:

       

      This latter document [“MESSAGE FROM BUSINESS”] is the only actual BJE response thus far to my complaint

      and I enter its relevant partial text below as follows:

      “…As the units previous is no longer available for retail purchase a cash payment resolution for the goods in the

      full amount of their value was offered to the customer.  This offer was rejected by the customer.

       

      At this time we feel that our offer to pay for the full value of the power tool is more than fair given it was received

      in an unusable state.

       

      Given that our resolution is more than reasonable, no further offers will be made at this time.

       

      My response is as follows:

      1.  Concerning the first BJE paragraph (above, italicized) , the only time an offer was casually mentioned was in

      Mr. ***** *****’s [representing BJE] phone call to me on August 2 2022 (q.v.), but this was an indefinite amount  ($150.)

      at the time of discussion due to the actual value of the Remington combination Polesaw/chainsaw not being available

      during the telecon. 

      This latter defect was remedied by my sending Mr. ***** ***** a copy of the amazon.ca purchase order ($269.86);

      this is the full amount paid for the Polesaw, noting that there are no included HST or shipping charges attached to this figure.

      Copies of correspondence relating to the above statements are attached to this email.

       

       2.  I received an August 4 2022 email from BBB attaching a BJE “MESSAGE FROM BUSINESS” that stated:

      As a gesture of good faith we would like to replace the saw for you and/or cover the cost of the unit.  We will be in

      contact in the next day or so regarding the steps forward and hope that this can make amends to the events that took place.”

       

        3.  I immediately responded to BBB in an email on this same day - August 4 2022; I understand that this

      AUG 4 2022 EML TO BBB.pdf has been transmitted to BJE.

      Due to the vagueness of the BJE response with respect to their statement […cover the cost of the unit.”]

      which attached no such cost to their proposal, I did not accept their proposal and instead suggested three alternatives,

      one of which I now list below:

       

      (ii) a cheque in the amount of $269.86 Cdn.  [original cost of Remington chainsaw purchase]  made payable to

      myself, plus, return of assembled chainsaw unit that was handed to BJE my myself on May 21 2022.

       

       

      So my query to BJE remains:

      What is the BJE actual dollar value of their proffered, “full value of the power tool” ?

       

      On the BJE reply to this question hangs my acceptance/rejection of their offer, and incidentally, the closure of the BBB complaint.

       

      May I please have a timely reply from BJE to this query [noting the BBB response time rule of seven days – on which the

      clock started today – Aug. 13 2022].
