      We purchase a set of windows and doors from Miranda windows and doors. We were told in the quote the windows and doors were energy star rated. After having the windows installed as per the specifications of the supplier we ask for the report for the energy star rating as per our quote.
      When we asked we were told they are not energy star rated windows and doors. When show the quote and bill of sale the owner told us, tough we got what we got.

      When Mrs. had placed the initial call on May 9, 2022 @ 4:06 pm, for an estimate on windows and French doors, there was no mention of the windows or doors requested to qualify to the Canada Greener Homes Grant. 

      On May 10, 2022 at 10:50 a.m. Monica at MWD left a message with Mrs. ****

      On May 10, 2022 at 11:57 a.m. Mrs. **** called. Monica of MWD confirmed the quote and asked if measurements of the windows and doors could be taken and e-mailed for a written estimate to be given. 

      May 11, 2022 at 11:49 a.m., Monica from MWD sent a reminder e-mail to Mrs. **** for the measurements of the windows for quotations. 

      May 11, 2022 at 12:16 pm, Mrs. **** sent an e-mail with the measurements Once again there were no mentions of any intent to apply for the grant and again no mention that these products needed to meet the specific requirements to qualify for the rebate. 

      On May 27, 2022 at 8:54 a.m. received an e-mail from Mrs. ****, checking in on the status of the window quotation. No mention of grant application. 

      On June 7, 2022 at 4:05 p.m. an estimate was sent to Mrs.**** with the pricing of the windows & doors that was required. 

      On June 9, 2022 at 2:08 p.m., we did receive another e-mail from Mrs. **** and again there was no mentions on the intent to apply for the rebate or that these windows needed to meet the specifications for the rebate. 

      On June 13, 2022 at 12:32 p.m., another e-mail was received from Mrs. ****, and again no mentions of intent to apply for the any rebate or that the windows needed to qualify for the rebate. 

      On June 13, 2022 at 4:20 p.m. I personally spoke to Mrs. **** about the windows and the doors and once again there was no mention about rebate. We spoke about the the e-mail sent earlier in the day, the colour and style of the products. 

      On June 24, 2022 at 3:15 p.m. I personally spoke to Mrs. **** to confirm the operator side of the doors and hardware. Again no mention of any rebate. 

      On June 29, 2022 several e-mails did go back and forth between myself and Mrs. ****, no mentions of any applications for energy rebates. 

      On June 29, 2022 at 3:54 p.m., I sent the contract to Mrs. **** for her review, specifically stating “Please review the contract including styles, sizes and colour. If everything looks good, please sign the bottom and return back to me”

      On June 29, 2022 at 6:54 p.m. I received the approved and signed contract from Mrs. ****. 

      September 13, 2022 at 3:32 p.m. Left a message for Mrs. **** to call office

      October 3, 2022 at 12:12 p.m. Let Mrs. **** know windows are ready, waiting on doors, will let her know when we receive word from the manufacturer.  

      October 5, 2022 at 9:04 a.m. Spoke to Mrs. **** and let her know that expected date would be towards end of October. 

      October 24, 2022 at 9:04 a.m. Monica at MWD called to let Mrs. **** know order was ready will be ready by Monday October 31, 2022. 

      October 27, 2022 at 1:37 p.m. Monica left message that order was completed and ready for pick up

      October 31, 2022 at 11:20 a.m. Received call from Mrs. **** and Monica did confirm order was ready for pick up. 

      November 4, 2022 at 9:24 a.m. Windows and doors were inspected by and picked by Mr. & Mrs. **** and signed for. 

      As you are able to see we keep meticulous recorded accounts of all our dealings with our customers. 

      Everything stated on the contract on June 29, 2022 was fulfilled. 

      We had been in contact several times with Mrs. **** and never was there any mention, either via e-mail or telephone conversation of any request for these windows and doors to qualify for the Greener Homes Energy Grant. Mrs. **** had ample opportunity since May 2022 to request that the windows and doors qualify for the grant. The contract was specifically written to Mrs. ****s requests and approved and signed by Mrs. **** as well. Mrs. **** had ample opportunity to review the contract to ensure all was correct, as there can be changes from the initial estimate to the final signing of the contract. Hence, why we ask the customer to review the contract prior to signing.  

      The fact that Mr. & Mrs. **** are now applying, over one year later, for the energy grant as an after thought because they are now doing other home renovations that may qualify, does not mean we did not give them the windows and doors that Mrs. **** specifically asked and signed for. 

      We provided Mr. & Mrs. **** exactly what the contract stated and exactly what Mrs. **** signed for. If there was any request on their behalf for these windows and doors to be rated for the grant, it would have been specifically written on the contract as per the grant requirements, as well as on the sticker, which is not to be removed from the windows and doors until approved by the inspector. There was ample opportunity between June 2022 to November 2022 to request the products be eligible for the grant. 

      The fact that the inspector has now mentioned he would “help” them out get money for their windows and doors that he never initially inspected prior to the installation is **********. It is also ********** on their part to apply for an energy grant for the windows and doors, if the initial inspection was not done prior to the products being installed. As per Mrs. ****s own account, the initial inspection was done approximately 1 month ago, 15 months since the order was signed and 11 months since your order was picked up. 

      Miranda Windows & Doors Inc. will not take part in any attempts by Mr. & Mrs. **** or the inspector to ******* the Greener Homes Energy Grant by reprinting window information stickers and ********** energy ratings.

      I am rejecting this response because:

      They failed to provide was was included in the quote. Why would I have to ask for something that was stated in a quote. Or what I wanted to do with the information. The issue at hand is a failure to provide was was contractually required. You can quote, accept payment, then provide a product that falls well below that. The final quote and contract we signed stated "Energy star rated and CSA approved windows and doors"
