    I hired *** ****** ********** to do the 10 year home inspection for gas appliances. Mr. ******* charged me 994$ for about 3 hours of work and put a red tag on the propane tank. This red tag essentially condemns the propane tank and it needs to be replaced. The propane provider refused to change the rented tank because it is compliant. Mr ****** refused to remove the red tag unless I pay an additional 320$ plus tax. According to Propane ***** the propane tank should not have been red tagged in the first place and they refuse to take any action. I feel that Mr ****** is trying to extort me for an additional 320$ and if I dont pay the red tag stays and I will run out of propane in a matter of days.

    Hello, 

    Mr ****** Called me February 13th,2023 to come perform a 10 year inspection that was needed by his fuel distributor *****.

    Upon arrival I started my inspection and started to notice a couple deficiencies. I wrote down all the deficiencies with the that needed to be corrected and charged him for 1 hour and gave him an invoice.. Mr ****** said can you do this now? I said I need my install van because I need my pipe threading machine to do the work and i don't have it all on me.

    On March 2nd i was called back to go repair the deficiencies, Before i left i asked Mr ****** if all the literature (Rating plate) was corrected on the tank before I came to his home. Mr ****** said yes.

    I then made Mr ****** aware that his invoice from Feb 13,2023 was still unpaid. I made him aware that i couldn't come to his home since he still had an outstanding balance of 180.80. Then he though he would only have to pay at the end. i said no i gave you a written invoice On Feb 13,2023 and handed it to you by hand from me. Mr ****** then paid by email transfer. the 180.80.

    On the same day March 2,2023 shorty after Mr ****** paid, i advised Mr ****** that the repairsare going to be anywhere from a 1000$-1500$ and that it was a time and material  at 160$ per hour. 

    i had to send the same message two times and he wrote -Yes I am ok with this  i went and did the repairs and gave him a bill of 813.60 Tax included for the repairs. 

    Then when i went to fill out the form and get the information from the propane tank, I noticed the tank still had to rating plate and that i could not read the information on the propane tank . 

    So i left and i emailed ***** asking them to comply and to go install a rating plate. 

    I have 8 emails going back and forth between me and ***** . They did want to go install a new rating plate. So i have 14 days to make a decision on issuing a red tag. So because ***** did not want to comply i had to go back to the home and issue a Red Tag for the tank that ***** owns. 

    I then emailed ***** an invoice for 1 hour for my time to go red tag the tank to protect my license. 

    ***** emailed me back saying they did not want to pay my invoice or comply. The Tag was issued for 5 days  to have the issue resovled. 

    On March 23,2023 ***** from ***** finally went and installed a rating plate on the propane tank and emailed me the pictures. 

    ***** asked me to go remove the red tag and I said ill review the email and respond... I then replied to ***** that i appreciate that they complied but now i have 1 invoice still unpaid for 1 hour and that i would have to charge 1 more hour to re-inspect at the home and get the Red Tag fill out the back and email back ***** that everything is in compliance to our code. 

    i did not hear back from *****. 

    On March 24 Mr ****** started sending me threatening messages to my cell phone and then wrote defamation on my google reviews. 

    On March 24 I told Mr ****** that he has 2 options either he emails ***** to pay for my time for inspections or he can pay for ***** . 

    Unfortunately Mr ****** over reacted and ***** Should of just complied as soon as asked to. It is *****'s responsibility to have a propane tank that has a proper rating plate. I made everyone well aware well before the repairs that the tank seemed to be expired and I could not read the brand serial and model and only the date was present. 

    please see the attachment's for proof. i have everything documented .

     

    We will not refund Mr ****** because we wasted a lot of time already with ***** and tried real hard to prevent this from happening. And given the fact that ***** decided to comply a month later shows us that they don't even care to comply within 5 days of a red tag. I have all this documented with TSSA as well. 

    Mr ****** then decided to change propane distributor and is going with *******. 

    We are Happy that Mr ****** is no longer using our services and we wish him the best of luck in the upcoming future.

    I am rejecting this response because:

    I have paid Mr ****** all outstanding bills totalling 994$.


    I have extensive documentation about this whole situation.


    Mr ****** informed me on February 13 that the tank had
    expired and he would need to put a red tag on it, essentially condemning the
    tank.  After Mr ****** left, I went to
    check the tank and immediately noticed the tank was not in fact expired.  I texted him the picture on the same day and
    Mr ****** texted back with “ok perfect”.


    On March 23 I find out that Mr ****** had not taken the red
    tag off.  ***** *******, the company
    which I rent the tank, inspected the tank and deemed the tank compliant, safe
    and up to date.  ***** requested Mr
    ****** remove the tag but Mr ****** refused.  He demanded payment for 2 hours of his time at 160$ totalling
    368.80$.  ***** refused to pay Mr ******
    because the tank should not have been red tagged in the first place. 


    I texted Mr ****** that I’m running out of propane and that
    whatever issue he has with ***** has nothing to do with me.  Mr ****** indicated that “if they don’t pay,
    the red tag stays on.  My times not free.
    They’re playing dumb.”


    Mr ****** then gave me 2 options.  Email ***** and force them to pay or pay the
    bill myself.  Knowing that ***** was
    refusing to pay him (MR ****** told me so), my only option was to pay Mr ******
    myself.  I was running out of propane and
    Mr ****** used this as leverage to get me to pay him.  I already paid Mr ****** in full for his
    services and I did not need to pay anything else.  This is extortion.  I have spoken to other technicians and the
    right to do in this case is remove the tag and then go after ***** for
    payment.  Mr ****** did not do this,
    instead using me as leverage against ***** and force their hand to pay
    him. 


    On Friday March 24 I terminated my contract with Mr ******
    and told him that I will be hiring somebody else.  At this point my tank was low and I needed to
    take action.   I told Mr ****** that I’m reporting him for
    fraud and extortion.  I also wrote a bad
    review on google about Mr ******’s company.

    Mr ****** texted me with “remove your google review or I
    will serve you with legal documents for defamation”.  I assumed that Mr ****** was stating that he
    was going to sue me for defamation.  Mr
    ****** then texted “may want to check your google review”.  Mr ****** gave my business, ****** ******, a
    bad review in retaliation (screenshot included).  I want to make it clear that the services I
    hired Mr ****** to do was for my personal residence and has nothing to do with
    ****** ******. 


    I have spoken to my lawyer.  He indicated that I have done nothing wrong and that I am well within my
    rights to leave *** ****** ********** a bad review.  My statement on google was truthful and I
    have all the documentation to prove it.  Ironically,
    I can sue Mr ****** for defamation for putting a bad review on my business because
    this issue has nothing to do with ****** ******.


    I do not expect Mr ****** to reimburse me for the service
    that he did not complete.  I am doing
    this to protect future victims.  I will
    not be replying to any more messages from the *** or Mr ****** himself.  All future correspondences will be directed
    to my lawyer.

    Hello, 

    Mr ****** does not understand that I need more then just an expiry date and that I need the model serial and brand of the tank.

    Please see the attachment where ***** has installed a new rating plate, the date the rating plate was issues  is Feb 20 (it's on the rating plate) and they still failed to write the brand called Winchester tank who manufactured the tank in 1994.

    i also emailed ***** ******* this information.

    When bringing the red tag  to the tank. I also notices that the regulator also needs to be piped away and higher. So there is more deficiencies to repair at his home. Mr ****** will need to pay another contractor to repair that as well. Because Mr ****** seems to think that we work for free. 

    We wish him the best luck in the future.
