Have contract for 22 windows remove replace. Company supplied 21 windows and stripped flashing from 22 windows. After crew left rep. asked for payment in full/ claimed contract was fulfilled. We were then informed that 1 window had not been replaced. Rep claimed that we would have to pay more to complete job. Claimed that they would have to issue new contract which would be provided the next day. (dec 27 2022). We expressed our reluctance to pay for contract until job was completed. We received a long spiel of his and the companys' integrity. We trusted ( naively) that there was resolution forth coming. That evening we did not see that the remaining window was prepared for removal. The morning light showed us how silly we were in trusting that we would be able to come to a solution. We only want what we in good faith thought we were purchasing. We have had the contract reviewed and find that it is feasible that one can total anywhere from 20 to 24 windows. (picture attached) We have been advised that we should obtain the final window with no penalty. We see on the contract 22 windows if 5th line is a delete. The first line reads like a 9 has been scribbled over and a 10 written over the scribble. It also looks like a 0/0. Irregardless the company prepared 22 windows for removal and left one unfinished. Why would they prep 22 windows if they were replacing 21? We do not understand how they justify leaving one window in disarray. We do not understand how the company can actually claim that we are some how responsible for a bad count. We are and have been patient, we understand that errors are part and parcel of any contract. The company has published their position saying in effect that we are responsible for this fiasco. We will consider the matter closed when we receive the final window. We feel that by the end of June 2023 we will have what we paid for and the matter will be closed. If not we will escalate the matter.
