I signed a contract with this company in March 2023 and gave them a $2761.27 deposit to coat my new garage floor in April 2023. My project got delayed and I have been corresponding with the owner for the past several weeks to get the job rebooked and completed before the winter. The owner called me a accused me of bothering them and he would do the job when he was ready. I asked for a refund and will take my business elsewhere as I no longer trust him or his company to complete the job. He declined and in fact sent me an email indicating he was going to invoice me for the complete job, even though he has done nothing. I would like ***'s assistance in getting my deposit back. I am no longer interested in doing business with this person.

    Business Response

    Date: 23/11/2023

The contract with this client was signed March 29th, 2023. The project was to be started in April, but we were told that the client was going back and forth with his General Contractor to fix certain issues with the poor quality work that was performed on his garage floor by someone else. At the time of the sale we were to fix these issues, but instead the client opted to have another company come in to remove the newly poured concrete and place and finish a new slab. This continued for 7 months of waiting for this client now to be ready for us to perform our work.

On July 5th, **** had called the client and left a message. That same day the client called **** back to discuss if we were still in business, which was a very odd conversation start.  Otherwise he would want a refund. The client explained that they have a proven record of finding bad contractors. In good faith I referred him to some of my contacts for other work he needed fixed. We also went over the best course of action and timing for his project.

On August 17th, the client had called **** to tell him that the new floor was going to be poured in a few days.

On August 23rd, The client had texted **** to tell him that the floor was poured and was looking for a date to book the floor in October. **** said to pick a date which would be done the week of the date you picked (text message). The client chose the week of October 2 for the install date, as his car lift would be installed the following week. On September 29th, the client had texted and called **** several times in a row. As we are normally really busy this time of year trying to finish things up prior to winter, **** was on site with the crew finishing up a coating. The phone rang over and over again like there was some type of emergency.

Then when we were waiting for our next coat, I looked through my phone to see what was happening. I had also received an email from *****. Stating that we need to be there Monday to do the floor and if we couldn’t do it, we would have to return his money. So I called him back.
The discussion went real bad real fast. I explained to the client that I would have to call him back at the end of the day, when I'm not on site to organize the following week's work. There was something wrong with this client, as he was extremely angry. He needed to know right away if we would be there on October 2nd and if not threaten to cancel the project and demanded a refund if we weren’t. After trying to discuss that I would call him back when we were done, he kept yelling at me. So I hung up the phone.
    ***** then emails:
    Hey ****.

Thanks for hanging up on me.
If you are not here to do the floor on Monday, I will be opening up a complaint with the better business bureau and will be taking you to small claims court for breach of contract.
Please confirm if you are coming or not.

    I respond:
*****- We agreed to do your garage next week (the week of) - as you can see in your text messages. The timeline for this was completely in your control.
I don't respond well to people yelling at me nor talking over me when I am trying to find a solution for you. I also don't respond to threats.
When you're in a better mood and are ready to talk civilly you can call me back to organize the day we are showing up.

    ***** Responds:
    Hi ****.
I'm no longer interested in doing business with you.
Please refund my deposit to ******************

    I respond:
*****- that is your choice. We will be sending you an invoice for the full amount since you are in breach of contract.
Otherwise, if you would like to discuss this in a calm manner, please call me.

    ***** responds:
    That's funny.  Good luck.

Several negative reviews were left for us as well made by this person.

At the end of the day, This is a seriously angry person.
A contract was signed. Dates were given for installation and were prolonged by the client. We tried to accommodate by reshuffling our schedule to fit this client's needs. Material was ordered and the install crew had a firm date set to start the work.  We then had to find other work for the install crew to do, leaving us scrambling to do so.
Even after being yelled at, I gave two more opportunities as you can see above for this person to call, make amends and re-schedule the work properly.

This person cannot communicate in a normal, calm business fashion, It's pretty clear that no one will or does want to work with them on any of their renovations.
Also because of the breach of contract by this client and attitude displayed, we sent the full invoice. The work was to be performed, and it is the clients responsibility to act humanly when doing business. Due to their lack of non-payment and negative reviews, we will be dealing with our lawyer moving on, and will be filing a claim with the small claims court for breach of contract, defamation of character and spreading false allegations.
