    On May 23, 2023 and May 31, 2023, ************************* attended my property and gave me a price for concrete paving services. We had agreed that: ****** would commence the work on August 21, 2023; and, the total cost of your services would be $4,800.Dzenan confirmed the agreement to those material terms on June 16, 2023 via email.Under pressure from Dzenan to make payment months before the scheduled work, I electronically transferred a fifty percent deposit of $2,400 to Dzenan on May 31, 2023. That day, ****** acknowledged receipt and confirmed that hewould perform the work on August 21, 2023. ****** once again confirmed that date on August 15, 2023 via Instagram messenger.However, on August 18, 2023, ****** advised me that he could no longer perform the work on the scheduled date. Thereafter, ****** and I agreed that he would perform the work on August 22, 2023, but he cancelled again.Given his unwillingness or inability to perform, the we agreed to withdraw from the agreement on August 22, 2023. ****** specifically agreed to return the deposit of $2,400 to me.Because ****** did not return the deposit promptly, I followed up with him regularly throughout August and September requesting the funds. On more than one occasion, he assured me that he would return the funds to me, and that I could expect to see the funds in my account, on specific dates. ****** never sent the funds to me. I advised ****** that ******, albeit reluctantly, retain legal counsel if he did not return the funds. ****** apologized and once again and stated that he would return the funds to him.To date, I have still not received the deposit funds and he is no longer answering my calls or messages.
