    We entered in to a contract on Feb. 28, 2023, to finish the basement of my residence as per city codes and to make a seprate entrance for the basement for a total price of $64,000 plus taxes. Up to now an amount of $48,544.0 has been paid by three different cheques. Business committed to finish the basement as per city codes and provide a sepraterate entrance. The basement was partially finished before starting the job, but apparently, it was not meeting city codes. Business dig a separate entrance through a sub contracter but installation of door is not yet completed. Further did a little bit of framing, some plumbing work and after that stopped the work. Stopped answering the phone calls. Visited their office many times but could not see any responsible person. On Oct. 2, 2023, when I visited the office accidently I was able to see the owner Anwar H***** as he was entering the office, and he **** ** ****** **** ** was sick and could not get the job done, after that I tried many times but could not see him. I request either to complete the work in shortest possible time or return the money, so that I can pay some one else to get the job done. I have copy of signed contract and receipts of the amounts paid. According to the contract complete project was supposed to be completed in 30 weeks, that is the job should have been competed by September 2023, but we are at the end of November but only 10 to 15 % of work has been completed. After the issuance of work permit I gave them full access of the site and now they have a lock box installed at the door for 24-7 access to the site.     As we have discussed with the client, permits timelines, are not in our control, then the client asked us to pause for 2 months.

     

    clients payments were supposed to be made, in 2 payments, yet he made it into 3 payments, hence why we have faced delays, as it states clearly about that in the agreement.

     

    However after discussing with the client, we are resuming work as needed, where needed *** *** ********** ** *** ********* and work is continuing as paid.

    I am rejecting this response because:

    Regarding the plea that the business was asked to pause for two months, that was in April 2023, when it was informed that I will not be available for some time, but that all time was passed before issuance of work permit. So, this plea cannot be accepted for delay in work. Also the delay in the work permit was due to the delay in depositing the city fees by the business, although I made that payment in advance to the business. Since the issuance of work permits, on July 21, 2023, full access is provided to the business, and they have a lockbox with key to have 24/7 access to the job site.

    Regarding Business Plea that the Payments were made in three payments instead of two, I would like to inform that it was decided during negotiation that first payment will be split in two, and it was amended in the agreement. Please see the last page of agreement ***** ** ******* ********* The first payment was made on Feb. 28,2023 for $7,232.0 to apply for the work permit and second payment of $16,000.0 was made on July 20, 2023, before the issuance of work permit. So, the delay in work has nothing to do with split of payment. Third payment of $25,312.0 was made on Aug. 16, 2023, at the request of the business staff.

    several unsuccessful attempts to meet in person or to contact the business
    owner by phone, Finally I was able to see the Business owner in his office on Dec. 12, 2023,
    when he assured that the work will be resumed very soon, but since then there
    is no activity up to today, i.e. Dec. 29, except that an Electrical contractor visited one day to look at the work and after that no body ever showed up for work.
