I engaged the services of the company to do some work in my home. I was given an estimate of job cost. I signed it and put the required deposit 30percent by January 2025. The deposit was sent to the owner **** ******* via e-transfer. I waited for him to reach out for a start date and got nothing.I followed up but got the excuses that he was ill , he will call be back and This went on for about three weeks. On February 11 I finally was able to speak to him on the phone after several calls , I told him I was no longer willing to continue with the project given the current situation. I told him to give me back the deposit and cancel the job as I wont be continuing. He told me to send an official request to his email stating my intent to cancel and that my deposit will be given back to me Feb13th. I sent the email same day we spoke.I didnt receive my ********** this point he started claiming they dont issue refunds.he then claimed he had to make returns in other to give my refund and needs time .After a week he insisted refund will be only issued by check that will be dropped off on march 5th at my house. I had no option but to accept.I requested he give me a time when he will be coming to my home.He refused to give me time but just gave a vague after work as time.On march 5th at 3:30 pm I get a call from staff claiming to be at my home. I told the staff I was not home unfortunately as they refused to give me a time. The staff claimed he had no knowledge of my request and was going to come back the next day when I had someone home. This didnt happen and I followed up with calls and text and also offered to pick up my check from the listed office address. He refused and insisted no one is at the office and that the check Ill be brought to my house on Wednesday the 11th at 4pm. I didnt get the check on 11th , the staff canceled at 3:35 claiming he cant make it and will drop it off the next day. I have called and texted and no one is responding to me all day.

I have not received my refund from the business.

i tried using a different  number with a friend to call. He picked the number and told the friend he wont give my refund unless i signed document not to write review of my experience. He proceeded to to also claim we should call today for the refund. He has not picked up our calls today.

we went to the address on his invoice. The company only has a post office address and no location .

What do you advise I do as I really feel he is doing this to people and getting  away with it

    To whom it may concern,

I am the owner of FRC Construction **** and unfortunately the deposit is non-refundable after 30 days due to materials purchased and dedicated time in our schedule for our employees to commence the job.

These are incurred costs that need to be recovered.

Construction is a business where resources are often allocated and expenses are incurred well ahead of time before starting.

Mr. **** ******* does not have the authority to issue refunds.  However, he has been speaking on the clients behalf but unfortunately due to the nature of the cancellation from the client and expenses incurred and time allotted in our schedule, on two occasions because the client was not able to provide the full deposit in full, and then cancelled the job on March 12th, 2025, when the estimate was signed in Nov. 2024, FRC Construction **** need to ensure our costs are covered due to materials being purchased ahead of time and materials that were ordered and not refundable.   Thank you for your understanding.

Thank you for sharing your draft. Here's a proofread and polished version that improves clarity, grammar, and tone while keeping your message strong and direct:

In response to the above from the business, please find attached the following evidence to refute his claims:
Claim 1: That he is not the owner of FRC Construction.
On the ********* website, he is clearly listed as the owner of the business. On another business website I researched, he is also named as the owner of FRC Construction. When he came to my home to inspect the basement for a quote, he personally acknowledged to me that he was indeed the owner of the business. Additionally, he later confirmed this by stating that he would send his staff member, *****, to deliver my refund cheque because he was too busy and unwell to do it himself.
    Claim 2: 30-day refund policy.
I made two deposits to FRC Construction, as shown in the attached image proof:
    First deposit: November 8, 2023 $10,000
    Second deposit: January 28, 2024 $2,000
After the second deposit, I repeatedly called **** for a full week to confirm receipt and to get a schedule for the job. As shown in the attached text message screenshots, he continually gave excuses, including being sick or in the hospital, and failed to provide a schedule or timeline. I even emphasized the urgency and my desired start date, yet he did not respond or answer my calls.
Eventually, I informed him that I no longer wished to proceed. I spoke to him on Wednesday, February 12, and formally requested a refund. As shown in the communication thread attached, this was exactly 14 days after my second depositwell within any reasonable refund period.
His claim of a 30-day refund policy is not stated anywhere in the job estimate. There was no contractual agreement signed by me indicating that a refund would be forfeited if I canceled. I have also attached a copy of the estimate as evidence.
**** has misrepresented the job cancellation date, which further demonstrates a pattern of dishonesty. I have been in communication with him throughout February, as my text and call logs clearly show.
He also claimed to have purchased materials and needed to return them before issuing my refund. Furthermore, he threatened to withhold my refund if I left a negative review. While I am not concerned about the review itself, I believe consumers have a right to know who they are dealing with, and contractors should be held to a standard of professional conduct.
As stated in my original complaint, I am requesting that FRC Construction, owned by **** *******, return the full amount I paid. He has done no work, has not been to my home since the initial inspection, and has failed to fulfill every promise made.
    Thank you.
