    I hired Peninsula Paving to pave my driveway in 2021. The job was completed on November 12, 2021. $10,600 was paid in full - $6,000 in cash on 17 August 2021 and $4,600 in cash on 12 November 2021. At the end of April 2022 I noticed that there were tire marks, weeds growing up through the driveway beside the house and tire divots wherever I parked. I called Peninsula Paving and spoke to the receptionist requesting a site visit to address the issues (May 30th, June 20th, and June 29th)with no response. On July 4th I call and left another message stating that I would have no choice but to seek legal advise if I did not hear back from the company. On July 5th a representative called and stated Sean would get back to me within a week. He made a site visit on 11 July 2022. During our discussion he stated the following:
    - He stated that would dig up the driveway approximately 1 ft out from the house to replace the driveway where the weeds have grown through the asphalt.
    - He would seal the driveway providing the labour &charging me for the cost of the sealant at $400.00.
    - He stated the tire marks were from cars turning the wheels on the driveway.
    - He stated that out of the 150 driveways he did in 2021 only 10 of them had problem.
    - He stated that there was nothing wrong with the asphal
    I researched asphalt driveways, including talking to professionals in the field and visiting other driveways paved in the fall of 2021 and concluded that his proposal was not acceptable. On July 25, I sent him an email informing him that the driveway was continuing to deteriorate with additional tire marks (as of today = 10), weed protrusions (as of today = 15) and divots where water pools (as of today = 25). I requested that he provide me with a written plan and schedule detailing the steps Peninsula Paving will take to provide me with the quality of driveway that I paid for or reimburse me. To date no response.

    I am rejecting this response because: while Peninsula Paving has promised to “fix” the driveway, they have failed once again to document how they are going to fix it.  Nor have they provided a timeframe.  Without this information I am reluctant to accept their proposal at face value.

    promise - letter stating that your driveway located at ** ********* **** *** *********** **, will be  redone  in the spring of 2023.

    This will include:

    Excavate old asphalt and remove materials
    Supply & Apply Granular “A Stone as needed
    Fine Grade Stone
    Compact Stone with Vibratory Roller
    Supply & Apply 2” Hot HL3 Hot Asphalt
    (compressed)

    I apologize for any inconvenience this has
    caused.

    I am rejecting this response because:

    While I have accepted their proposal - they have indicated in writing that they will fix my driveway in 2023,  I am not sure if I should keep this complaint open until the promised work is completed or close it now on the promise that they will complete the work in a timely fashion in 2023.  

    Please advise.
