    Transaction Date & Amount: We paid the deposit of $3,550.42 + $461.55 HST on Dec 23, 2023. The balance of $9,361.28 (HST inclusive) was not paid.

    What the business committed to provide: JAD Soundproofing, owned by **** *******, committed in a contract to soundproof a wall between two rental units and a ceiling between a rental bedroom and our upstairs living room in our triplex.

    Nature of the dispute: The soundproofing work was ineffective and poorly executed. We hired an independent acoustical engineer who confirmed that **** failed to treat the entire ceiling, leaving the entire bulkhead portion untouched, which rendered the soundproofing "completely ineffective." Also, on the wall between rental units, **** failed to seal the side of the wall and the area where the bulkhead connects with the wall, allowing sound to easily bypass the treated areas, resulting in no improvement.
    **** conducted manipulated sound tests to deceive us into believing his work was effective. The pre-construction test played pink noise at a deafening 90-decibel, while the post-construction test volume was lower by approximately 30 decibels. At the post test, we were suspicious and followed **** into our rental unit to inspect his speaker setup, where we verified the volume was dramatically lower than the pre-test.

    Whether the business has tried to resolve the problem: We have requested the test results, in writing, on three occasions, and **** refuses to provide them. We know this is because the results were manipulated and would not withstand scrutiny. In a review response, **** falsely claimed that “we saw the test results.” We have also requested a refund of our deposit and reimbursement for the expert report, but **** hasn’t replied or refunded anything.

    We are seeking:
    1: Deposit refund: $3,550.42 + $461.55 HST = $4,011.97
    2: Expert report reimbursement: $1,150.00 + $149.50 HST = $1,299.50
    3: Compensation for rental vacancy losses: $2,816.00 (no HST)
    Total amount: $8,127.50
