    Mr. ******* Fitzsimmons is the property Manager he is not respecting his contractual Obligations towards the owner which is me. I am a owner and he is not providing services per the contract. The front steps are damaged and he has *** nothing to repair the steps, the stairs in the back have not been inspected for damages, and they have a snow removal company that they hired and they have not come by to remove the snow in front of my home and I was stuck in my house last year. I have sent emails to him and they have gone ignored. I want him to do his job and to look into the repairs that I have submitted.

    I am writing in response to the above-noted complaint made by ********* ******* against my company, A.H. Fitzsimmons *******************, on November 4, 2024.

    My company is retained as the property management company for ******-***************************************** No. 783 (***** 783 or the Corporation), a *********************** in ******,*******. Ms. ******* is a unit owner within ***** 783 and is a member of the ****************** of Directors. The above-noted complaint that Ms. ******* filed against A.H. Fitzsimmons was filed without the authorization or direction of the ***** 783 Board of Directors (which is required as condominium corporation Directors cannot act unilaterally on behalf of the corporation). As such, the complaint is not valid, in particular given that A.H. Fitzsimmonsproperty management contract is with the Corporation and not Ms. *********************** this, Ms. ******* complaint against A.H. Fitzsimmons is also without merit. To the extent the issues raised in Ms. ******* complaint can be substantiated, they are properly directed at the condominium corporation, not A.H. Fitzsimmons who acts only as agent for OCSCC 783.

    Please see the attached letter from OCSCC 783s legal counsel to the Better Business Bureau, dated October 21, 2024,confirming the above.

    The steps she refers to are being re-inspected by ************************, the report will be made available once received.

    We were not managing the property last winter so I have no idea what the circumstances are with regards to her snow removal complaint.

    The snow contract was signed by another condominium management company who manages the other 10 corporations in this Baycrest shared joint committee, the other 9 accepted the snow contract and therefore had the majority to proceed with the contract. Ms. ******* refuses to accept that and there is NOTHING that can be done.

    AH Fitzsimmons company and its

    Property Manager

    Having neglected in his contractual obligations (he has even attached his contract) to show that he must respond to owners when he is informed of property damage or repairs or neglect which is what my complaint is concerning 

     

    and both myself and my neighbour share those back stairs and he has done nothing to date

    This Was brought to his attention in July of 2024

    also the front stairs are seriously damaged and theses are shared between 4 units?

    i Am physically challenged person and my para transport has even written to his supervisor about these seriously damaged stairs 

    in The winter they accumulated ice and become very slippery 

    **** **** the contractor in charge of removing the snow do not put either ice barrier on the steps and leave a bin full of  a product that is not at all safe to use by an owner
