I was a victim of fraud and deception by this business and its owner ***** *********. I was looking for a 3rd mortgage and communicated with Tamer who collected information and crunched the numbers and provided me with an approval letter to sign and kept sending me exclusivity agreement to sign on my phone and emails and I refused. When I was fed up I responded to an email stating that I do not sign such agreements because you simply give me no guarantees of success. When I repeated this again he became very rude and said I dont care about your business or this money (broker fee) it is only $4800 which is not much. Besides what are you worried about. IF YOU DONT SIGN AN OFFER, THEN THE AGREEMENT IS NOT ENFORCEABLE. I thanked him for the explanation. He sent me the offer with the agreement attached to it to sign. I signed the offer and did not sign the agreement, but there was an error message every time I try to submit. After several tries it went through and I was sent a completed documents link. It saw my signature attached to the agreement. I did not make a big deal out of it because I recalled what he said about the agreement only enforceable if I sign on an offer and I liked the offer. The next day he sent me a totally different offer than what we agreed upon. I declined it. The following day he sent me an even worse offer unlike the first. When I refused to sign he became rude again questioning my knowledge in finance. I told him I cant waist my time any longer if he wont deliver the deal I agreed to. He became confrontational & said, I have 6 months to bring you an offer so I am not in a rush at all. go read the agreement with your signature. I told him this is dishonest business practice and I wont be bullied. I sent an email terminating the agreement and advised him that I will not do business with him. We take all customer feedback seriously and are committed to resolving any concerns professionally and fairly. We regret that ****************** feels dissatisfied with their experience, and we would like to address the issues raised in their complaint. Please note that this file is currently active in collections with Metcredit and is pending lawsuit service. The lawsuit draft was completed on December 2nd, 2024, and a formal demand legal notice was issued to the borrower on the same day. We have compiled a detailed outline of communications and emails, which are attached for reference. Should the comment remain (breaching Section 9 of the exclusivity contract agreement),we will issue a secondary claim against the borrower.
Detailed Timeline of Events:
November 26th, 2024:
The borrower, ***** Kirolous, submitted a request online seeking urgent mortgage financing. He had accumulated significant debts and was bound by a purchase sale agreement for a new build, requiring a down payment he could not afford. We explained the terms of our services, including the exclusivity agreement and consent forms, in detail. The borrower had numerous questions, and we provided full disclosure and clarity to ensure he understood his obligations and commitments. He willingly signed the exclusivity agreement and confirmed his understanding via email. (See attached confirmation email.)
November 27th, 2024:
The borrower instructed his appraiser to assign the appraisal to us, as it was necessary for financing purposes. We received confirmation of the appraisal assignment. (See attached email.)
November 28th, 2024:
The borrower sent us the necessary documents to proceed with his financing request. (See Attached) On the same day, we secured conditional financing approval and sent him the package for review. (See attached documents and approval email.)
November 29th, 2024:
We received an email from Oppono requesting a follow-up on the file and signing. We had previously requested Oppono to process this file urgently. On the same day, we contacted the borrower to congratulate him on the approval, inquire if he had any questions, and request any necessary changes. Unfortunately, the call was met with hostility. The borrower was very arrogant and refused to discuss the deal specifics aside from stating he needed a 3rd mortgage and demanded cancellation. He began to make inappropriate and racist remarks and kept asking me about my heritage then stating, I know exactly where you are from, and I just know I was going to have trouble with you as I seem to do with all you people. He then demanded, You have 24 hours to get me another deal; otherwise, do not call me again. We followed up with an email to address his comments and reminded him our contract. (See attached email.)
December 2nd, 2024:
Despite his comments, I instructed my staff to continue with our mandate and see other approvals. Often times clients under financial duress can be extremely emotionally volatile. We continued to prioritize his file and secured an approval on exception for a third mortgage from another lender (Hosper), as he had requested. We packaged the deal and sent it to the borrower. However, we later discovered that the borrower had taken the approval we secured and attempted to circumvent our services by engaging another broker. We reached out to the borrower, but he was uncommunicative. (See attached approval and correspondence.)
On the same day, we sent the borrower an email notifying him of his breach of contract and urging him to seek legal counsel. The borrower responded, confirming that another broker was working on the deal and claiming that our agreement was invalid. He also stated that his lawyer was prepared to receive legal action. (See attached email.)
In response, we issued a formal demand notice, notifying the borrower of the next steps, including collections and legal action. We also reminded him of Clause 9 regarding the non-disparagement clause. (See attached demand notice.)
December 3rd, 2024:
We received confirmation from Oppono that they had canceled the deal due to the borrowers behavior. (See attached cancellation notice.)
January 4th, 2025:
The borrower was processed in collections with Metcredit. (See attached collections notice.)
Conclusion:
There is no fraud. This is a breach of contract case. We have made every effort to assist the borrower in good faith, despite his hostile and uncooperative behavior. The borrower willingly signed the exclusivity agreement and was fully informed of its terms. His actions, including attempting to circumvent our services and breaching the non-disparagement clause, have left us with no choice but to pursue legal and collections remedies.
We remain committed to resolving this matter fairly and professionally. We kinldy ask for the BBB to pause or remove this claim until the matter is resolved in collections and court.

I have never dealt with a more deceptive person in my life. Tamer has 2 faces, a heart unjustifiably full of hate and a soul consumed by evil. His responses have many twists and manipulation to truth. If I was to give details about all interactions, I will be writing a book, instead I will respond to his statements.
Tamer has never made any effort to deal and resolve the issues that I brought to his attention more than once. He was only focused on the fact that he has his hands on an exclusivity agreement and I have to abide by it or risk legal consequences. His only way of dealing with this dispute was by acts of threatening, bullying and intimidation. You could clearly notice that he did not offer any resolution in this reply.
I have never chosen willingly to sign exclusivity agreement. When I submitted the inquiry online, I was immediately receiving texts and emails daily to sign exclusivity agreement. When I was fed up, I sent a reply to the email stating I do not sign exclusivity agreements for few reasons. 1)Family members had bad experience in the past with such agreements, 2) I did not know if he will be able to deliver the deal I am looking for, 3) The was a penalty on the agreement, 4) warning that I can't share my experience and review their service if I was not satisfied, which raised a red flag

Deception 1), When I did not sign the agreement that was sent independently, Tamer attached it to a fake offer to force it on me.
Deception 2) He said he explained the conditions of the agreements and obligations, but he failed to share how he actually explained it. Over the phone he said I am only bound by the agreement if I accept and sign an offer, otherwise the agreement is not in force or effect. I believe him although it did not say that in the body of the agreement, because the offer (fake) he provided me was nice and I wanted to accept it.
He said lender cancelled the deal because of my behavior. He never explained what behavior. I never knew who the lender is, I have never communicated with the lender. Only ******s communicate with lenders. I only submitted documents when asked by ******.
He said I took the deal to another ******, which is not true. I never liked the other offers he made me, why would I take it to another ******. Thae other ****** he is referring to; I was working with before I started communication with Lionsgate ******. The only problem was My first ****** was not responding to my emails an inquiry after 3 attempts which gave me doubts about his ability to deliver an offer, that is why I started searching again and came across Lionsgate Financial.
Tamer said the problem was I seized communication and was not responsive. I only did that after I sent an email terminating the agreement and advised him that I am not interested in their services because I felt I was a victim of fraud and deceived by the fake offer he provided which made me lose trust in him. Also the other offers were very far from what I agreed upon in terms of rates and fees. I seized communication when I was disrespected more than once and was threatened with legal action if I tried to seek financing with anyone else. The numerous attempts to contact me that he mentioned were only 2 disrespectful and threatening messages that is why I did not respond to them.
Tamer is not only an unhelpful person but he is also very harmful and his soul is filled with unexplainable hate. When the 2 agents I worked with before him failed to get me financing for the amount I needed (one ****** could only do financing up to 70% and I needed 75% the other agent didnt work with many 3rd mortgage lenders,) the 2 agents apologized and released the appraisal report without any problems. Although Tamer wasted my time and failed to deliver the loan I agreed to, he refused to release the report which I had transferred to him in the first place, in order to force me to work with him and this way he can impose on me higher ****** fees, which he did, unless I spend $600 more to get a new appraisal.
Tamer, who pretends to be professional in his communications, he threatened me that I will never get the deal funded if I work with any other ****** after terminating the agreement with him. He used language and expressions I never heard or understood in the past like refer to my loan application as a w**** file that will be moving from desk to desk and from lender to lender until no one will consider looking at it.
Tamer welcomed the opportunity if I received an offer from any other agent, I worked with before him that he will match it or beat it if I shared a commitment with him. This is something I would not accept to do to any ****** because I consider this is theft and breach of trust. I consider this stealing the hard work of one person and the fees he earns on the transaction and giving it to another who made no effort. This way cutting the food he puts on the table to his family from the fees he earns from the transaction.
If all of the above is not called fraud and deception, what would it be called.
The unprofessional ****** Tamer threatened me with legal action just because I sent this complaint to BBB in an attempt to end this dispute. It is important to bring this matter to BBB attention which awarded him this classification A+ which he does not deserve and it is also important to warn others about Tamer and his companys dishonest behavior so they don't suffer the same headache.
One of the main reasons I chose to do business with Lionsgate is the BBB logo with A+ rating which I found out that he is not worthy of it, therefore I decided to bring some clarity to BBB about Lionsgate.
I am a God-fearing man. I have high principles and values that direct me and govern all my interactions in life. I will not participate, tolerate nor take part of any dishonest acts.Customer Answer

Hello BBB instigator.
As I previously mentioned ***** ********* the broker at Lionsgate is a lying and deceptive person. He has 2 faces and his heart and soul are consumed with evil. I have attached few of the messages he sent me to give you an idea about how unprofessional he is and about his way of addressing complains by means of intimidation, threats and bullying. I have shared with you some of the messages I received from him perhaps you can detect from the tone in the messages the true nature of the person we are dealing with.
I have also attached in my previous response
1) the fake offer that he sent me and I agreed to and he did not deliver
2) The 2 other offers which were substantially different from the one I signed one that he sent me after I signed on the fake offer.
3) The termination email I sent him when I realized he will not deliver the loan I am looking for or that he promised to deliver.
Thank you for taking the time to review the complaint and I look forward to an end to the harassment and abuse from his end.
I also hope that others will be warned about this dishonest business so they dont fall in the same trap I fell in.

I am rejecting this response because: The business has not taken any steps to resolve the problem which was caused by they not fulfilling their end of the contract and delivering the loan they offered. They (Lionsgate and its broker) has again resorted to threats and intimidation. They are afraid for their reputation being affected because of my sharing my honest experience, and has no concern to complete an honest transaction. I hope BBB will take the right decision and address the issues arose with this business. Lionsgate is using BBB logo and A+ rating, which is one of the reasons that led me to attempt do do business with Lionsgate. Hello BBB,
As it may seem clear to you that the business has no intention to resolve the issue or to even lower their tone and feel a sense of guilt and a desire to resolve the issue, Lionsgate broker has even turned down the opportunity I gave him to take a positive stem forward by fixing the unjustifiable damage and harm they inflicted on me. I am, unfortunately to Lionsgate, bound by my principles and values to continue to take legal steps of course ( such as filing this complaint with BBB, leaving reviews, and filing other complaints with other agencies that should protect consumers such as myself) to warn others about this business so that others do not fall in the same trap I fell in and not to be deceived like I was deceived. I wish to stress on the point that I did not willingly chose or accepted to sign exclusivity agreement. I submitted evidence in that regard previously. Also note, I am still receiving text messages literally every 2 days to sign the exclusivity agreement.
