Contracted Black Tar to repave my driveway. Specifically pointed out some unique features including a tree well, 3 city manholes and adjacent stamped concrete that I didnt want damaged to the sales rep that gave the quote in person. Was assured that their crews were the best in the business and had seen it all. Paving was completed on May 21st while I was working from home. Came upstairs from a meeting to take a quick look at the work and provide final payment. At first glance it looked great, nice and smooth so made the final payment to the worker waiting at the door and went back to my meeting. ~ 30 minutes later I went back outside and realized that all three of the city manholes had been completely paved over! Luckily one of the crew was still at a neighbors house talking about possible future work. I flagged him down and told him. He was initially incredulous that this would have happened. I showed him a picture of where the manholes used to be and he apologized and said they would take care of it. Their solution was to reheat the pavement and dig out the manholes leaving 3 large craters in my driveway which I was obviously not satisfied with as the previous driveway was ~ flush with the manholes (not unlike any city street, this is not rocket science). Clearly someone completely dropped the ball when setting the grade. I immediately informed the customer service rep I had contact with and sent photos that day resulting in following timeline:May 29th - Ops manager shows up at my house. Says his tool to take measurements is broken or not calibrated and leaves.June 5th - After a lot of bugging the company, finally returns and takes measurements ments. Tells me that he needs to take measurements back to office and they will get back to me in a day or two.June 18th - More bugging told work crew is scheduled for next day.June 19th - No one shows up.June 25th - Send message asking what is going on. No response since.

    Hello *****,

Thank you for bringing your concerns to our attention. We understand that your driveway project included unique challenges, particularly the three manholes, which are located close to each other and at different heights compared to the rest of the driveway.

While the project complies with city bylaws and specifications, we strive to exceed our customers' expectations and ensure complete satisfaction. To demonstrate our commitment to your satisfaction, we are willing to go above and beyond by repaving your driveway in 2025 at no additional cost. Our customer success team will reach out to you promptly to discuss the details and ensure we meet your expectations.

At Black Tar Construction, we pride ourselves on delivering exceptional service and quality, and we appreciate your patience and understanding as we work to resolve this matter.

Blacktar paved my driveway in Sep, 2022, and sealed it in Aug 2023. Some sinking and cracking have shown already. I called Blacktar and was asked to send them a few pictures 3 days ago (5/21/2024), but hadn't heard anything back from Blacktar. So I called again today (5/24/2024) and was told they wouldn't repair it until next sealing that is in Aug, 2025, unless I pay them for the sealing now. I paid almost $600 for the sealing last Aug, and can't pay so much for the sealing in less than one year. This obviously is a quality problem (Poor base), why they ask me to pay for another sealing in order to get this problem fixed?

    Business Response

    Date: 24/05/2024

    Good afternoon, Jun,

Thank you for discussing your concerns regarding your driveway with me earlier today. As per our conversation at 12:50 PM on May 24, 2024, I escalated your request for repairs to the management team immediately after our call. The documentation, including photos, has been submitted, although the team was unable to review them until work at the site concluded safely.

You mentioned the possibility of leaving negative reviews if the issue remains unresolved by next week. While I understand your frustration, please allow us a bit more time to thoroughly address your concerns. We take such feedback seriously and are committed to finding a satisfactory resolution.

In response to your escalated concerns, management is prepared to proceed with the necessary driveway repairs under the existing warranty terms, without the need for additional sealing this season. We will provide you with a $0 quote for the repairs, however, this offer is contingent on the removal of the negative review and the resolution of the BBB complaint within the next three business days. Note this quote will be binding under the same terms of your original contract.

Black Tar values customer feedback and strives to work collaboratively toward effective solutions. We believe in fairness for all parties involved and hope that the proposed resolution meets your expectations. We look forward to your acceptance and to scheduling the repairs promptly.

    Best regards,

Numerous emails to get repairs to the new driveway installation. Two holes/defects need to be repaired before the driveway can be sealed. No response from the project team after sending pictures.

    Good morning, ****,

    Thanks for reaching out.

There is a hole repair workorder that was completed in 2022. If there are additional issues with your driveway in 2023, note that it will be repaired under warranty with the sealing visit currently under your neighbor's file as both properties are combined in the same visit during paving and now sealing.

If it makes it easier for communication and separation of individual concerns, we can separate the files for the future.

Let us know how you'd like to proceed.

In 2022 I hired Black Tar to replace my driveway ( and my neighbour) , and everything went smooth. As per contract to maintain Lifetime Warranty a sealing job must be performed second year after installation and I paid the advance for this job back in March 2023. After multiple emails back and forth with multiple project coordinators, as today August 29th 2023 I still dont have a date for this sealing job . This is unacceptable the way customers are treated. I would very much like to get a straight answer and a scheduled date for this job to be done.

    Good morning, ***,

Thanks for reaching out to us.

Since your sealing job includes both you and your neighbor's driveway, we cannot complete the job until your neighbor's concerns are addressed. If this is no longer a concern, we can complete the sealing job this Friday, September 1st.

Let us know if this is the preferred solution!

During the summer of 2022 we entered into a contract with Black Tar to lift and relay interlock and repave our driveway. Quotes ****** * ******. The lift and relay was completed first early Summer, then the repaving mid August. During the repaving the equipment that was used moved approximately 12 paving stones that had been relayed. The paving crew took note of this and captured photos of the stones that needed to be adjusted back into the positions from which they were moved. I was told Black Tar office would be advised and to expect a follow up. I contacted their office several times and never had any follow up until October 20th when I received an email from ***** **** who stated the repair wasn't covered by warranty but could be done anyway. I replied to him correcting his understanding of the situation that it wasn't warranty work but regardless it needed to be completed. Since my reply I have heard nothing from the company except an email follow up from *** ********* on Jan 12, 2023 regarding resealing our driveway to ensure the warranty. At that time I replied to her asking for the stone fix to be done first before I committ to paying for a reseal. Her reply was that she would see that the repair would be done. No correspondance was receieved from her until I emailed her on May 20, 2023 which at the time I was notified she was not at the company and that my request would be for****ed to ********************. Since then there has been no correspondance from Black Tar and the lift and relay stone job is incomplete. All services have been paid in full.

    Good afternoon, *****,

    Thank you for the information.

Firstly, I do want to apologize for the wait before getting this issue resolved. I understand from our files and notes that you notified us via phone on September 9, 2022 that the stones needed to be relayed.

Secondly, I'd like to send our quality control specialist to your property on Tuesday for updated photos. You do not need to be home for this visit as I know this is short notice - especially before a long weekend. Once we have the photos, I can provide you a more specific date so our interlock installer can come by to fix the interlock. This visit is to make sure that our team can arrive with everything they need to do the job and there are no surprises.

Again, I want to extend my sincerest apologies for the delays in resolving this issue. I'll reach out via phone on Tuesday to touch base. Please look out for a email from me - it may end up in the junk mail confirming the details.

    All the best,

I am rejecting this response because:

After the complaint was filed I heard from Black Tar. They kept me up to date about when they believed they could complete the outstanding work but ultimately the job is not done. They haven't been able to give me a date and the last correspondence I have had with them was July 21st. I have reached out to them via email with the same employee who I was in contact with but they have been silent. I have given them what I believe is plenty of time to fix the problem but I think they have forgotten about me or are just ignoring the issue.

    Reference: Quote **** ($4197.52) - Driveway, Accepted August, 2021, Final Completion Date - June 30th, 2022 AND quote **** ($3122.30) - Interlock Pavers, Accepted August,2021, Final Completion Date - June 30th, 2022

I paid for a complete driveway replacement and interlock paver installation in August of 2021, and the driveway prep team showed up the following May to get everything ready. When they left, they said that they would return as soon as the pavers were installed. Pavers were not installed until last month (May, 2023). The "Paving Project Deadline" was June 30th, 2022.

After many discussions with Black Tar, the following response was posted on your *** website:

Dear *******,We sincerely apologize for the significant delays and frustrations you've experienced with your driveway replacement project. We take full responsibility for the extended timeline and improper paver installation. My interlock ******* stated he spoke to you regarding ************* installation and that you are satisfied with ************* implemented. Thank you for bringing your concerns to our attention, and we appreciate your patience as we work towards resolving this matter, we will make sure to book you in for the asphalt paving installation immediately. As a token of appreciation for your patience and understanding, I have just sent you a free sealing visit worth $217+hst. I know this does not do justice for the delays, but I hope it will allow you to give our company another chance to make this right! *********************** (***)

    My response is quoted below:

Firstly, let me say how grateful I am that you have taken the time to respond to my complaint. As a ***, I am certain that you have far more pressing items on your agenda.

Also, let me say that I am grateful, both as a senior citizen and as a military veteran (Army, 1970's, Navy, 1990's, and Air Force, 2005-2008, 3b medical release), that your company offers a 5% discount for either of these instances. I will be happy to pass this letter on to all of my military brothers and sisters and to all of the DND people with which I currently work; we all need to save money wherever we can.

Sadly, due to my continuing physical situation, and the certainty that that deterioration will progress, I will not be able to do much more than get my 2019 Honda Gold Wing Touring DCT motorcycle out of storage, where it has resided since the fall of 2021, shortly after agreeing to your quote.

I was, in May of 2022, when your prep crew came and did its work on my driveway, overjoyed by the prospect of riding the summer away, but my joy was short-lived.

I am currently left with the prospect of asking a friend or paying someone to drive my motorcycle to my home, just so that I can park it in my garage and run a 'For Sale' notice on AutoTrader.

Due to a medical accommodation, I have been designated as a 'work from home' individual, and that provides me ample time to meet with people during the daytime, as opposed to waiting until evening.

That being said, I look forward to meeting with you and your job-site foreman at my home in the days before your paving crew arrives, so that we can discuss the attached drawing, examine the model I have created, and go over your intended plan of execution.

Also, I would welcome the inclusion of *****, the paver installer, as I value his input in this matter.

Since that response was posted, I have not been contacted by Black Tar

    Business Response

    Date: 27/06/2023

    Good morning, *******,

Thank you for reaching out to us with your concerns.

Please note that we have sent you a mutual release agreement on this matter. With the current property line dispute you are having with your neighbour, it has come to our attention that we are unable to proceed with our previous agreement stated in Quote #**** due to safety concerns for our employees, and legal action from both you and your neighbour.

We hope you can understand that this has put Black Tar in a tough situation. We cannot complete the services you requested originally in lieu of lawsuits one way or another. Your neighbour has threatened to sue Black Tar if we are to pave your driveway as originally quoted. You have also informed us that you would invoke legal action if Black Tar does not pave to the originally quoted specifications. As well, last time our team was present at your connected properties, they were met with clear hostility between you and your neighbour.

It has been a pleasure working with you on your interlock project. However, in light of the current dispute, we are unable to proceed. In order to dissolve our business relationship, the mutual release agreement was drafted and sent. To summarize, Black Tar would fully refund you the deposit you've made on Quote #****. We would cover the cost incurred with the preparation of your driveway as a gesture of good faith.

Again, we will resend the agreement. Please reach out to us if you don't receive this. As well - please check your junk!

I am rejecting this response because it is incomplete.

I WILL accept the following resolution:

Total refund of ALL monies paid to Black Tar (inclusive of ALL deposits and payments for both Quote #**** and #****), which entails complete removal of all interlock pavers, (which were not installed to my satisfaction, and do not take into account the final height of the driveway) and a return to the conditions that existed prior to Black Tar's arrival. Specifically, a gravel driveway and gravel sidewalk base.

Quote #****: Total amount invoiced $3122.30 Paid deposit of $468.35 on Aug 9, 2021, and the balance of $2653.95 was paid on Apr 25, 2023

Quote #****: Total amount invoiced $4197.52 Paid deposit of $629.63 on Aug 9, 2021, balance remains unpaid.

**Black tar is good for paving, DO NOT contract for interlock**

We contracted Blacktar for paving and interlock in the winter of 2022 for installation in summer 2022. Paving was completed in August 2022 and is satisfactory. Interlock was delayed several times, although we were promised it would be completed by the fall. We learnt end of November that we weren't getting our interlock in 2022. As with others, we were offered to take our deposit back or wait and be first in line for Spring 2023. This is not a replacement job, this is a new construction with bare gravel that we've had for more than a year and through the winter! Absolutely unacceptable. As of writing, we are mid-June 2023, we learn that we are in fact not first in line, pretty much last in line, that our selection of interlock which was done a year earlier is backordered and if the material can be found, installation end of August! A timeline that is surely going to be delayed further. Our patience is growing thin and we are seriously considering taking our deposit and looking elsewhere. This is very dissapointing.

As a resolution, I would like for Blacktar to contact me, and to finish the job in June, a job which is 1.5 years late.

    Business Response

    Date: 15/06/2023

    Dear ******,

We want to sincerely apologize for the significant delays and inconvenience you have experienced with the interlock installation. We fully acknowledge and take responsibility for falling behind schedule, and we understand the frustration this has caused.

Please know that we are committed to resolving this issue promptly and to your satisfaction. Our team is actively working to rectify the situation and expedite the completion of your interlock installation.

We deeply regret the impact this has had on your project and understand the importance of finishing the job as soon as possible. We assure you that we are taking immediate steps to address the delays and prevent similar situations from occurring in the future.

Someone from our company will be in contact with you before the end of this week to provide a detailed plan and proposed solution to ensure the timely completion of your interlock installation.

We appreciate your understanding and patience as we work to make this right. We value your satisfaction and are committed to providing the quality service you deserve.

Once again, we apologize for any inconvenience caused, and we are determined to rectify the situation as quickly as possible.

I had my driveway paved by Black Tar Corporation 3 months ago. I did not park or walk on the asphalt for 4 weeks. Yesterday, my wife drove out with Toyota Yaris and left a gouge in the asphalt. I informed Black Tar Corporation of this issue and sent a photo of the gouge. I was told that this was just a tire mark and that they can do nothing about it. It is not just a tire mark, it is a gouge with a raised lip on one edge. This will be further damaged by a snowplow following a snowfall. I have never seen such a gouge on a new driveway or on freshly paved roads. This should not have happened, especially at the current outdoor temperature. I can only assume that the asphalt is substandard. I have no other explanation as to why a light vehicle should create a gouge in 3 month old asphalt. I had a >2000 kg Road trek parked in a different spot all summer and there is no sign of a blemish where the wheels stood. Black Tar Corp. refuses to do anything about this. They did not even inspect the gouge personally but based their conclusion on a rough photograph. They claim it is just a tire mark. I can accept a simple tire mark but I cannot accept a gouge.

    Business Response

    Date: 09/11/2022

    Hi *****,

I hope you are enjoying the sunny weather today.

My sincere apologies for the gauge that was left from your Toyota Yaris. Contrary to widespread belief, asphalt is at its weakest point during the first year of installation due to its malleability. It's common for tire marks and gauges to appear during warm weather.

Nevertheless, I understand how frustrating it must be to see a gauge in your freshly paved driveway. I would hate for you to have to see that every day! Therefore, I will inform our customer success team to contact you for an immediate resolution. We will fix the gauge free of charge in 2023.

    Kind regards,

I am rejecting this response because: The gouge in the asphalt is not a common occurrence.  If that was the case then our roads would look like accordions. This should not happen after 3 months of curing.  I have not seen such damage in any new driveway.  The Black Tar Corp. response is not satisfactory.  I would like this gouge to be repaired before the first snowfall.

    Hi *****,

You are correct by stating that the roads do not look the same, but you are not making a reasonable comparison, here are some points on why:

    1) Road are paved with three layers of asphalt, often 6-12 inches in asphalt. Residential driveways are typically 1.5 to 2.5 inches depending on contractor selection.

    2) Roads are compacted with 5-15 ton rollers that would cause serious damage to a foundation if used on a residential property.

    3) Roads use a commercial grade combi roller that speed up the curing time.

    4) Most Importantly: Most tire marks and gauges are caused by dry steering (turning your car tires without moving the car), which happens a lot more frequently on residential properties then they do on commercial properties.

We have a clause about this specific situation in our terms and conditions because it is a common occurance in residential properties. We were nice to offer you a free repair in the spring even though you signed a contract stating that it is not covered.

Let's find a resolution that is fair to both parties. I have two options. We can repair it for free in the winter, or you can pay an expedited fee of $97 to have it repaired in the next few weeks. Our season ends in two weeks, therefore I would need to know by Nov 14th at the latest.

    Kind regards,

In March 0f 2022 we contracted with BlackTar to install an interlocked stone walkway and provided a deposit of $1500. The date given at that time was August of this year.
In July, I notified BlackTar that I would be away for August and was told that they could schedule it into September.
Starting mid-August, I called BlackTar to get a specific date for the work. This was important as I am often out of town. On every call, I was told that someone would get back to me. That never happened. I continued calling and started emailing through September - 10 calls and two emails - exactly the same result.
What I would like is a date for this season provided and the job completed before snow arrives.

    Hi *******,

I would like to start by stating that I completely understand your concern, and I am here to help fix it! My sincere apologies for the lack of communication and delays you have experienced, I am sure it must be frustrating. We have been working tirelessly to catch up on our interlock work, but we keep getting delayed due to workforce and material shortages.

We are doing everything we can to complete your project before end of season. The frost line typically develops by end of November to December, we are hoping to have your project completed by then.

If we cannot complete it this season, we can issue you a full refund, or we can freeze your price for spring of 2023.

Thank you for being so patient and understanding!
