  Muscle Empire, a sole proprietorship led by Jiyanu  A. uses coercion to siphon clients of additional payment, and has failed to deliver the service that I had paid for in full (a Monthly Meal Plan service charged a total sum of $282.50 CAD) and the sole proprietor has taken no actions nor intended to resolve this matter without an unjustifiable monetary payment towards your business.
  I purchased a Health Assessment from Muscle Empire on December 7, 2023 for the total sum of $70.00 CAD. The Health Assessment held on December 11, 2023 and Jiyanu A. acted childishly and carried himself with poor professionalism throughout the entirety of the assessment. In performing the assessment, he overtly belittled and demeaned my physique and stature. After which he advised an exercise program of 20 sessions in which I gave my response that I have personal and professional obligations and could not commit to the proposed exercise regiment. In response, he spent the next 20-30 minutes pestering me to agree to some form of payment and insisting I "take action" repeatedly despite my clear apprehension toward your recommendation. As a means to progress the conversation forward and continue with the already purchased Health Assessment, I agreed to purchase the Monthly Meal Plan package for the sum paid of $282.50 CAD after taxes. Within the invoice itself, there was no mention nor indication that this Monthly Meal Plan service offering was part of the fee for the whole package (valued at approximately $2,800 CAD) that he had assumed I would purchase after a mere speculative conversation. This "Monthly Meal Plan" service offering has not yet been delivered. He has made it clear that he had no intention of providing this service in good faith without paying a sum that exceeds the previous invoice amount paid in full for this service,
  Currently, it is December 17, 2023 and he claims I owe him a cancellation fee of $968.97 after failing to provide his service.

  Dear ***** it was such a pleasure meeting you. Thank you for bringing your concerns to my attention. i take all feedback seriously and appreciate the opportunity to address any misunderstandings.
  I'd like to provide some clarification regarding the points you've raised. Firstly, Muscle Empire operates as a corporation, not as a sole proprietorship.I pride ourselves on transparency and professionalism in all my dealings. It was stated that i used coercion, but i did not force you to sign the contract, you to signed of your own accord. In the assessment acted professional and created an atmosphere that can can be a safe space. You agreed to pay the for the 20 sessions, and i only suggested that we took action to better help ***** reach his fitness goals. he agreed to pay a deposit of the program and then next week we would continue with the plan. in my contract i have a no refund policy. ***** committed to a 20-session fitness program, and he already made a deposit for your personalized meal plan, which was a integral part of your overall fitness journey. I want to emphasize that his dedication to this program is commendable, and I value the effort he put into his fitness goals.
  During the phone call, we discussed that *****'s desire to cancel the program. I explained that due to the nature of our agreement and your commitment to a 20-session plan, canceling outright isn't feasible. However, in an effort to find a middle ground, I presented two options for his consideration:
  Option 1: Reduce your sessions to 12, and we can conclude our contract after completing the revised program.
  Option 2: If you prefer to cancel entirely, there is a cancellation fee of 35% of the total fitness program cost, amounting to $968.97.
  It's important to note that the meal plan, which is already prepared for you, will only be provided upon completion of either the full 20-session program or the mutually agreed-upon 12-session alternative, or upon payment of the cancellation fee because it was part of the program you purchased.
  i am more than happy to still help him out and give him a meal plan however he would have to honour the agreement he signed with me and pay the cancellation fee as i would cheated out of our agreement. since the meal plan was a full package and not a separate item with the fitness program.
