      Hello,
For about a year, I have been consigning to a company for "second-hand" clothes. I have a contract with the consignee. The contract states that after I agree with the proposed price, to receive 45% of the sale if the item is sold. However, I noticed, that on Dec. 26, 2023, that on one of the garments the agreed price was $90.00, but the item was subsequently tagged with a much higher amount than what was offered to me. The tag was for $168.00. In this particular case, even though the sale will go through for $168.00, I will only be able to get 45% of the $90.00, but not 45% of $168.00. As a percentage, that's an 87% inflated profit for the consignee. I am assuming, that all items were sold in that way. The total amount that I received so far from all items that were consigned was for $ 890.40, or less than 87%. In reality this amount should be $1,665.05, therefore I was embezzled for $ 774.65.
I hope, that you can help me to have the amount according to the agreement I signed with the boutique. Or email: [email protected].

      With thanks,

      Business Response

      Date: 17/01/2024

      Good afternoon,

This was a misunderstanding. On Tuesday January 16th we called the client and explained the situation. She stated that her claims were incorrect and a miscommunication and has agreed to remove the claim. I will preface this statement by saying we are extremely diligent in how we document all clothing taken from a client as well as all items which are sold to our customers. We use ******* ***** to track all items and the ******* POS system to account for every sale. Every claim I will make in this statement can absolutely be backed by receipts and documents from our systems.

***** ********* became a client of Second Nature Boutique in 2022 and was subsequently given an account Number #****. Upon her first appointment with us to consign, ***** was given the contract to read over and sign. We have this contract on file. Since becoming a client with us she has given us 26 items to sell for her. As each item is entered into our system it is given a number. Once we research and price every item, we follow up with an email to the client that lists what we intend to sell each piece for. Per our contact, the client retails a payout of 45% of the sale price once their item has sold. On August 29th 2023 we listed a ****** Skirt as item #25 and priced it at $90 with a $9 administrative fee. On August 29th at 6:53PM we emailed ***** with the pricing of this item ********* ** **** ******. This skirt sold at full price on September 8th 2023. On November 21st 2023 we listed another skirt that ***** brought us as item #26 which was a **** ***** Skirt priced at $155 with an administrative fee of $14. We emailed ***** on November 21st 1:42pm with the pricing of this item ********* ** **** ******. On December 26th 2023, ***** came into our boutique, noticed the price of skirt #26 and asked to take it back to which we obliged. Upon reading *****'s claim through the BBB, we believe **** was confused and mixed up item #25 and #26. This year we are celebrating 50 years and are very proud of the reputable business that we have built through three generations of women on pillars of trust and honesty. I can assure you that when our clients receive a price list, this is an export from our ******* ***** system which is what we use to then print our tickets out and ultimately what we use to sell our merchandise. In 50 years we have not ever received an accusation like this, and I believe our reputation for operating an upstanding business should be noted in this claim. As mentioned, we spoke with ***** over the phone yesterday and explained the circumstances. She confirmed that she was in-fact incorrect and agreed to remove this complaint. We have documentation to stand behind every statement made in this response and are happy to provide all information necessary to prove our innocence in this matter.

Finally, it should be noted, that at the end of our call yesterday evening, ***** did state not only that she agreed this was a misunderstanding but also that she would like to continue to do business with us. She asked if she could bring in more clothing to consign.

Kindly let us know should you require further information or any documentation to support our position in this claim.

      Warm regards,

      Kary Dick
