Complaint to the Better Business Bureau To Whom It May ********* am writing to lodge a complaint against *********************************** and Day and Night Electrical Eel and Plumbing. My experience with ************** and this company has caused me significant financial and emotional distress. In early April, I hired ************** for renovations of my basement and to replace the moldy ceiling in my bathroom. He provided a quote of $6800 and requested a $2800 deposit. I paid $1500 upfront, with the agreement to pay the remainder when he started work on May 3rd.************** failed to show up on the agreed date, repeatedly rescheduling and providing various excuses. THE BIGGEST LIE BY *****, HE CAME TO MY HOME WITH THE COMPANY TRUCK MISREPRESENTING HIMSELF AS THE ***** OF THE COMPANY, DESPITE BEING AN EMPLOYEE. WHEN I CALLED THE COMPANY NUMBER, SOMEONE ELSE PICKED UP AND HE MENTIONED HE NEVER HAD ANY DETAILS OF MY CONTRACT AND I WAS DEVASTATED TO KNOW THIS. And his father who is the owner of this company came to my home next day and said he would issue a refund as ***** if off for months now.Despite my repeated requests for a refund due to the urgent mold issue, ************** responded abusively, affecting my mental health. The company's owner, ****************** father, assured me of a refund by May 27th, citing ****************** medical issues. Despite this promise, I received no refund and my calls were ignored.Attaching some screenshots of how he disrespected me continuously, refusing refund and he is incapable to work as he has got amputations.I am requesting the following resolutions:1. **Full Refund**: The immediate return of my $1500 deposit.2. **Formal Apology**: A written apology from ************** and the company.3. **Company *************************** that ************** will be held accountable and measures will be taken to prevent such incidents.Thank you for your attention. Business Response

    Date: 10/06/2024

This is ************* owner of Day&Night Electric eel and Plumbing. I'm sorry for whats happening. I was totally unaware what was going on. Unfortunately in this type of business we have *** employees that come and go. With this being said. Sometimes some employees go to customes house and they leave their own personal numbers and do the job at a cheaper rate. Which this was the case of what happened to you. I was not aware that the employee gave you their number and you ended up dealing directly with him Instead of me. When you notified me like you said I came to your house and I promised a refund for the mistake you and my employee did, by deducting from his commission. I already paid you $1000 back and I have proof of the transaction. So how can you say you didn't get anything back? Instead you called me from morning to the middle of the night and bothering me even though I am not responsible for the refund. And we set up a payment plan which you agreed upon. I don't know why you are saying we didn't issue you a refund when we only have $500 left from the $1500. He is currently not working so you have to wait until he is back to get the remaining money. This is what happens when you work with the employees under the table to save money. You should deal directly with the company owner instead.

I am rejecting this response because:

    Hello

    Thank you for your response

This complaint was opened before this agreement of refunding $500 every Friday was done. Secondly, I did not mean to defame your company but I was given his number by a property management company not any random person making me feel that I am dealing with a licensed contractor and a reliable person.

So please discard the part where I said I did not get anything back, I acknowledge receiving $1000 from you and expecting the rest next week. As soon as I receive it, I will close the case.

I would never prefer dealing with a unlicensed employee of a company. He came with your business truck and as I said misrepresentation was done. But what would a consumer do in this case. It was a contract worth $7000 almost so it wasn't a cheap contract and it is the dishonesty of your employee not the foolishness of innocent customers who put in their faith in you.

Anyhow I am thankful that you have returned me a part of my deposit and also at the same time feel sorry that I had to bother you after what your employee had done. No offense, but had to call you the day you promised to return the money because I need to pay my bills and tuition being a full time student.

I would be waiting for the rest of $500 and then close this case as per our discussion once I receive the rest of my deposit.

    Sincerely and respectfully,

    ***********************

So I wish to close this case now as he will be sending me the money as per our most recent conversation.
