    April 26, 2023 - hired MDConstruction to replace/recap front/side concrete sidewalks; asked about warranty/guarantee and was told "yes any problems we will take care of". April 30 - $1,665 etransferred to ****/MDConstruction. Sidewalks done on May 1-3. May 3 - $1,665 etransferred to ****. May 5 - texted **** there are cracks in concrete; we will watch over next few days and then touch base again. May 6 - texted **** many more cracks so please come and take a look. After numerous texts they finally came to look at sidewalks on May 23; said they would come up with a game plan to repair and get back to me "next week". Since May 23 I have texted many many times asking them to honour their work and either get run-around "I'll come this afternoon or tomorrow" and they don't show up or they never respond to my text messages. On June 18 sent official letter via email and text formally requesting that we meet and mutually agree to a plan to repair the sidewalks and indicated this meeting/agreement is to take place no later than Friday, June 23, 2023 otherwise we will be pursuing other formal/legal action. Received email reply June 18 "I apologize we planned on going there last week, unfortunately we had 2 deaths in the family, which changed our plans. We will take care of the issue. I hope you understand our situation." Since then no other contact from **** to "take care of the issue". Have done independent research on ******** product that they used to repair/top damaged concrete surfaces and I personally don't believe they did procedure correctly causing a lot of our problems. I have no confidence in this company repairing the sidewalks to our satisfaction and request full refund of $3,330 so we can hire a reputable company to repair/replace their mess.

    I have had contact  with *****, and told her on numerous times I will repair what I can but there was no guarantee from cracking. Specifically on the recapped area of the sidewalk. I also told her before hand that it will Crack in certain areas due to movement and freeze thaw cycles. I do not guarantee any concrete solution from cracking. I did not give a date to when I would do the repairs but cause I wanted to wait to see how much movement they would have. No point doing a repair if it will only need another repair later on . I intended to do it towards the end of the season.

    I am rejecting this response -

    I strongly disagree with ****’s comments, as below:

    He says he told me on numerous times he will repair what he can.  Not once did he say he will repair “what he can”.  On April 26, 2023, I asked him about his warranty/guarantee and his response was “any problems we will take care of” – no mention of repair “what he can”.
    He says he told me beforehand that the recapped area will crack.  On April 25, 2023, **** told me recap “lasts a few good years”.  The one and only time he said anything about the recapped area cracking was on May 23, 2023 – three weeks after he completed the job.  He said he knew it would crack and I told him if we had been told this upfront we would not have gone with this option.
    He says he did not give a date to do repairs as he wanted to wait to see how much movement they would have and he intended to do repairs towards the end of the season.  This is the first I am hearing this.  On May 6, 2023, he said they “will come next week sometime” – he never showed up.  On May 23, 2023, they came over to take a look and said they will “make a game plan to repair” and get back to us next week – never heard back from them next week. On June 6, 2023, **** says “we will come by late this week or early next week to do the repairs” – he never showed up.  On June 14, 2023, **** said they are “going to pop by later today. If not it will be tomorrow for sure.” – he never showed up.  If he intended to do repairs towards the end of the season why did he tell me in May/June he would be coming to do repairs then?

    Next steps:

    On June 18, 2023, I formally requested that we meet and mutually agree to a plan to repair the sidewalks, with a deadline of Friday, June 23 to meet/agree.  Response from **** received that day saying they “will take care of the issue” – never heard back from him after that.
    On August 8, 2023, I sent demand letter by registered mail requesting full refund of $3,330.00 within fourteen days of the date of the letter, and advising that failure to receive full refund by that date will result in me pursuing action in Small Claims Court.  Reply received on August 12 saying they will come out and repair the damage but then go on to say they “will come and repair what we can”.  I responded saying repair is now not an option and my demand letter requests full refund.  To date I have not received a response to request for full refund.  Deadline for **** to respond is August 23, 2023.

    My Conclusions:

    It is obvious to me that ****/MD Construction and Son do not want to take responsibility for their work and do not want to spend any more time/money/energy properly fixing the mess they created. 
    I suspect they are in over their heads and do not have the knowledge/experience/capability to properly repair the situation.  Looking at the work they did, it is very unprofessional.
    Their offer to repair what they can is not an acceptable solution as I have had a few other concrete specialists look at the work and all advise that the sidewalks need to be completely taken out and start from scratch and done properly.  There is no way to “repair” the problems.
    I will not allow ****/MD Construction and Son to do any further work for me as I have no confidence in their abilities.
