    I bid of a forklift. I put a maximum bid of $400 but at the time of the original closing I was winning at $235. Right before closing on 11/27/23, Apex Auction extended the auction two days because they got a call from a buyer who needed to figure out transportation. That left me with one of two options.Pay more for an item I would have won if Apex Auctions would have not extended or loose the item all together.

    We *** extend the closing date of any auction at our discretion.  It does not happen often but, at times, circumstances beyond our control *** force us to extend an auction closure.  This was one of those cases.  The auction never closed, therefore, there is no original sale to be honored.  Additionally, the lot in question never would have sold for $400.  There were 32 watch tags, 70 unique ***s and was viewed close to 300 times.  Lastly, we know that this person would never have won this item because the winning ***der was watching from the beginning, their max *** ended up much higher than what they paid to win this lot.  We understand losing ***ders *** feel upset but that is certainly no reason to throw Apex under the bus.  We consider this matter closed.

    I am rejecting this response because:
    As you can see in the screen shot, again, that the bids/potential bids did not get placed until after the closing on 11/27/23.
    It does not matter what the value of the item is, if there is no reserve and it goes for under what is desired, the high bid on the closing of the auction is the winning bid. That is the risk of auctions. They could bring high dollar amounts or pennies on the dollar. If a minimum amount is desired/required then there needs to be a reserve placed on the item. 
    There is no place in the terms and conditions that state you have the right to extend the auction and especially since somebody called in and asked for an extension. Plus if the winning bidder was watching it from the start is there conflict of interest in the fact that he can call ask a favor for an extension? Seems like a friend doing some inside work to help out a friend. Again, bad business. 
    so, Yes, a person could potentially win a higher value item for $400 or less. It is not as the discretion of the auctioneer to extend just to bring in more money after the terms of the auction have been met.
