    Omnisource is a nearby business on *********. In ********, AL. that is becoming a nuisance to the community. Their daily operations begin anywhere between 5:30 - 6 AM until 5:30pm Monday - Saturday. It involves, consistent ground shaking explosions, thunderous booms, piercing screeches, very loud slamming, crashing and crushing that is not only disturbing the peace of the community, but also breaking the noise ordinance. Please help us! I made a personal visit to Omnisource and was told they are zoned to work and make any noise they wanted at any hour of the day. Im confident that the city of ******** is unaware of these operations and would not have allowed this type of business near any residential district being that it effects the overall health of the community. Omnisource has been under fire for years due to unfair work practices including discrimination and even purchasing stolen scrap metal. Omnisource has consistently lied about the source of this noise, blamed it on employees and nearby businesses. They know that theyre wrong but feel like theyre bigger than the rules/law. The surrounding residents of this city need your help.

    OmniSource has been in business for over 50 years in ***************** and operating a scrap yard in ********, AL for over around four years.  Omni has a long-standing history of being a good local citizen in every community that we operate in.  Omnis Bessemer, AL yard is zoned I-2 (heavy industrial) and is located in an industrial area along with several other businesses including a brick making business.  As I-2 zoned, Omni has the legal ability to operate 24 hours/day and is not subject to any workplace noise ordinances,contrary to the complaint.  The Complaint references a set of ordinances that are not applicable in the jurisdiction.  While **** has the legal right to operate 24 hours/day, Omni currently chooses not to operate round the clock, but rather,attempts only to operate during normal business hours.   However, at times, depending upon orders and time tables, Omni may occasionally have to operate outside of normal operating hours. 

    The noise complained of may be emanating from ****, as scrap yards have a tendency to produce noise.  However, there are also many other potential causes of the noise; there is rail line between the Omni yard and the residence of the complainant, there is a brick manufacturer that operates 24 hours per day, and other industrial sites.   Omni is not attempting to blame anyone else for the noise, but rather, point out the issues with the noise complaints.

    As to the other allegations, Omnis Bessemer yard has no past or active matters for unfair work practices.  In addition, the Omni yard in Bessemer is not a retail yard, so it does not buy from the general public.  As a result, all of the scrap purchased by **** at that particular yard is lawfully obtained from other commercial or industrial customers.
