I received a settlement offer, *** decided to pay it now that *** saved up the money, but the website is so unclear. Doesnt show the account balance just wants a payment. I didnt know if they would take the payment or not, so I duplicated it on mistake. Ive called and talked to two separate agents and its been nothing each time. All they tell me is they have to speak to operations, I asked for another number so I can get it sorted through them and not have a middle man, but they will not allow me to do that. No one can apparently tell me if they are going to take my payment twice and put me in the negatives or not. Such an unorganized system, I feel others should be able to talk to someone in billing other then being told im sending an email to operations, call back later for an update.Business Response

This law firm is not the attorneys for this complainant but represents the opposing party in a civil judgment matter in the Small Claims Court of **************, ******** However, the firm apologizes to the consumer for any difficulties she may have experienced submitting her settlement payment to our office via our web payment portal. However, the online payment portal is provided as a courtesy only and such is maintained by a third party vendor. That being said, when the consumer called and advised our telephone representatives that she had mistakenly scheduled a double payment, they advised her correctly. Our telephone representatives do not have access to firm accounting or the online portal, and they correctly advised the consumer that they could convey the message or request to remove or stop any duplicate to the operations and account department. That message was promptly and properly conveyed and the operations department had the duplicate payment removed or stopped as requested. As of this date, only one payment has been processed, which has posted and is acknowledged and upon confirmation of clearance, the file will close out and the civil judgment will be satisfied with the trial court. This "lawfirm" has purchased a debt and have sued in a small claims court without ever having me personally served with a statement of claim, upon receiving the default judgement against me I called to discuss the account. The gentleman on the phone was so rude and nasty, and refused to give me any information about what they were suing for, amount owed, or what I needed to do to resolve the situation. They have mostly 1 star reviews on ****** with people having similar issues. I've also reported them to the ********************* due to their blatantly lack of communication as well as their legal malpractice. No way the "lawyers" responsible for this firm should be allowed to practice law.Business Response

This firm does not represent any client by the name of ******* ***** and has no attorney-client relationship with any such client, and this law firm does not purchase or own any debts. Also, unfortunately, we are unable to locate a file in our open adversary litigation inventory in the given name of this complainant, ******* *****. Also, a name search of the Alabama online judicial database has failed to turn up a case with that named defendant. As a result, we are unable to locate a litigation file for this named individual so as to be able to respond substantively. Should she possible have a former or different name, or a case number and venue for us to try to locate by cross-reference, or even happen to have our internal file number, we will again try to locate the file and response substantively. I am filing a complaint against ************************************************ P.C., a collection agency, due to their refusal to provide reasonable settlement offers to myself and their lack of transparency in handling my debt-related inquiries. It is also clear others have had the same issues as you can verify with their generic and lack luster BBB responses. This complaint will also be filed with the ******************************** and the ****. Key ***************** Legal Ethics Violations:Lack of Good Faith *********** (Alabama Rule 4.1 - Truthfulness in Statements to Others)If they refuse reasonable offers without any justification, they may be acting in bad faith, misleading consumers about their options or falsely implying they have no flexibility.Failure to Offer Reasonable Settlement Terms I have made multiple good-faith attempts to negotiate a fair settlement, but ************************************************ P.C. has either refused to provide any reasonable offer or insisted on unworkable terms.Lack of Documentation I requested written proof of how they calculated their settlement amounts, but they have failed to provide clear, itemized documentation.Given their unwillingness to negotiate in good faith, I believe they are acting in a manner that is unfair and inconsistent with standard debt collection practices. I made a written agreement at the courthouse for this business with. I have proof of payments paid in accordance to that agreement. Now, when I went to make a payment, the website show I do not have a balance to make a payment towards. Instead, I have to agree to an installment plan. I was able to make a payment but I do not trust these people to renege on the agreement I made with their lawyer. My payments have followed the agreement perfectly. I have other debts I am repaying, I will not be able to make larger payments until others are paid. Nathan and Nathan is not the center of the universe they think they are.Business Response

As stated by the consumer, this matter involves a civil legal action in which this firm are the attorneys of record for the Plaintiff creditor. We acknowledge that a settlement and repayment agreement was entered into in court with the consumer and that such is noted on our file, and that she is paying as previously agreed. We apologize for any inconvenience that the consumer has had using our online payment portal, although such is not structured to be able to provide a balance, and any reflection of $0.00 is in the proposed payment field before a payment amount is populated.
