    Date : 7/6/2023 Amount : $500.00 Be careful dealing with this shady business....*********** told me my deposit was 100% refundable (minus a $20 processing fee) and that I should place it immediately to hold the boat I was interested in. I was upfront about their schedule and mine making an immediate pickup impossible and it would be a few weeks, 'not a problem'. Fast forward a week and I was told if I didn't pick it up that day it would be given to someone else (I'm 8 HOURS away). The sales manager said the salesman was 'confused' and that I could pay for the boat by that Friday and they would hold it indefinitely once paid for. My credit union was still finishing up the paperwork on Friday (the ** made 2 internal errors on the application which *was* pre-approved) and wouldn't be able to wire the $ over that day so I emailed saying that it would be impossible to complete the transaction today so please refund my deposit as stated. Now they are saying my deposit is 'non refundable' "because of unethical people like myself who tie up a boat with no intention of buying it". I had every intention, even after their incompetent sales staff acted as such. Dispute filed with my credit card company who will of course reverse the charge, next up is the BBB. The sales manager said he anxiously awaits my review to say how I never had any intention of buying the boat which is incorrect - I searched ****mi for this exact boat and am now on a waiting list at a dealership that doesn't try to steal from its customers.

    Response to ********* BBB complaint:

    It was in fact explained to ********************** that his down payment of $500 will not be refunded by us for the following reasons:
    1.) By excepting his partial down payment the two parties entered into a contractual agreement,both parties would preform their due diligence to complete the agreement.
    2.) We took the vessel off the market and therefore made it unsellable to other interested parties.
    3.) We processed the preparation of his unit to make his unit functional and safe on the water and in doing so we incurred financial expenses.
    4.) He told us (via phone conversation) that he would pay for the boat prior to July 13, 2023 and it was mutually agreed that he could leave his boat here until such time that was convenient.
    5.) The final reason that we will not process a refund for ********************** is that he has filed a dispute with his credit card company therefore he would be getting double the refund. We are just protecting ourselves from further internet scams and scammers.

    I am rejecting this response because:

    *********** stated without question my deposit was refundable minus a $20 processing fee.

    The vessel was NOT prepared, they specifically stated as such.

    I was told I had until a certain date to provide payment otherwise they would cancel the sale.

    I never signed any contract.

    I was asked to cancel my credit card dispute and they would provide a check refund, however they refused to put this in writing when requested.

    As the complainant has clearly stated in his response, it was agreed that we would provide him a refund check if he was to cancel his credit card dispute. 

    If ***** provides documented proof that the credit card dispute is canceled we will then process a check refund.

    Maybe it would just be better that we all agree to just let the credit card dispute process and take it's course. This will be his refund?

    I am rejecting this response because:

    The business REFUSED to state in writing that they would provide a FULL refund.  This is not an excessive request and if they actually intended to provide a refund they would have no issue putting it in writing.

    Withholding a deposit is ILLEGAL.  They know it, I know it.  If they wish to resolve the matter all that is required is putting in writing that I will receive my deposit back.  Or they can simply refund the charge to my credit card and the dispute will automatically be resolved.  But they clearly have no intention of refunding my money.
