    Contract was signed June 2021 for siding, windows and gutters. He asked for half up front to cover materials - over $8000. He kept saying he would come in a couple of weeks, but never showed up. Every month I would contact him, every month he said he would come, and then didn't. Throughout this entire time I have been in and out of the hospital, having chemotherapy and radiation treatments, Finally January of *************************************** back my money. He said he didn't have all of it because he'd bought the windows already. So I requested that he bring me the windows and remaining money. He agreed to come January 20th but didn't show. So I texted him and he said his kids were sick and he would come on the 25th. Again, no show and will not respond to any of my texts. My daughter sent him messages and finally a certified letter in February asking him to return my money, or measures would be taken against him. He will not respond to her either. I realize this began over 12 months ago, but I was hoping he would do what was right and was giving him time to do so.

    4-11-2023 ************ with BBB called Mr. ******************** for his position. Mr. ******************** said he has purchased the windows for the home which cost approximately $3800. He offers two resolutions:

    1. Deliver the windows and install them, no money will be refunded.  2. Deliver the windows and refund approximately $3800 left of the $8000 deposit. Mr. ******************** said when the contract was originally wrote up and he was ready to begin work you contacted him saying you didn't have all the money. He then moved on to other jobs. He was waiting to hear from you.

    Please let BBB know what you would like to do.

    I am rejecting this response because: ****************** called, she doesn't want the windows or any of the other work on the estimate done. She would like the full $8000 refunded. If you are not prepared to refund the full $8000, she will take delivery of the windows and a refund of the balance. When considering the balance please note the actual cost that you paid per unit and not the ****** (that *** include labor cost) since no labor has been given.
