    Business Response

    Date: 09/13/2022

This email is in response to ID ********.                                                                                   My business is located at my home, although 95% or more of my work is performed at customer locations. I do not mind when people come to my house for work. People that I work for know that I am seldom at my home/business during normal workday- work hours. I have policemen and sheriff deputies come to my house for work often and many times it’s after-hours and I don’t mind it because that’s part of being self employed with a home based business.
I would like to provide some background on the previous transactions I have had with this customer. I sold him a portable radio(the radio involved in this case) sometime back in 2012-14. No issues with sale, customer returned about 5 years ago to purchase a battery for the radio. I sold him a battery, which customer was going to pay for with a debit/cash card. The card was declined, rechecked numbers, declined twice more. Customer says that can’t be right card is good and tries to take the radio and the new battery and says  he will go get the cash and pay, to which I stated that when he had the cash he could return for the battery, returned his radio and old battery. He later returned with cash and I gave him the new battery. This customer contacted me approximately 2 year ago (pre-covid about the time covid started) and said his radio would not power on, which more than likely it is the rechargeable battery again(generally speaking about 3 years is the life of a radio battery), I told him that due to covid that it was very difficult to obtain *** accessories and suggested that he look on Amazon for an aftermarket battery. The customer refused to accept that suggestion, he has called many times( If I don’t answer when he calls, he will immediately and repeatedly call back as many as 5 times in a row. Sometimes I am in a area of bad cell coverage and sometimes I am on the phone with other customers and vendors)and I have politely and repeatedly told him to get the battery from Amazon that I can’t get them. I ran into him a couple of months ago in town at a local business and he asked about the battery again, to which I politely responded by saying that he should go on to Amazon and purchase the battery. Customers response was NO I want you to order it, even if it’s off Amazon and he would pay me extra. I told him I didn’t want to do that and again suggested he just get it himself and that would save him money. Customer called me 5 times on 8-27-22, which is a Saturday, I did not answer because I only respond to emergency calls from police and fire department customers for which I work for on the weekends.
On Monday, 8-29-22 I stayed home due to a 24 hour stomach virus, I did not go to work I was sick. At approximately 10 AM I hear my 1 of my 2 dogs(a ******** ********* and a ********** ******** *******) bark and a car horn blow, I looked out the window and saw the customer getting out of his car. I was not feeling well and was not going to answer the door, the customer then turned and shouted at the one barking dog and clapped his hands, to which the dog barked again, wagging his tail not aggressive barking. The customer then pulled an aluminum walking stick out of his car and started poking and jabbing at the one barking dog and then struck the dog across the left front shoulder. When I saw the customer strike my dog I went outside and told him to get in his car and leave, to which he refused to leave and said he had a question, I told him I was sick and was not answering questions and that he should get in his car and leave to which he refused again and I told him again leave or I would call the police and have him arrested for striking my dog and trespassing. He refused to leave and wanted to ask me a question and didn’t know what he had done to make me mad. I told him that he was not going to come to my house, provoke my dog, hit him and expect me to do business with him and that he should leave immediately. He still refused to leave and then began to use profanity against me, my dog and my business. I told him to leave and not to call me or return to my house again. He finally got in his car after being told multiple times to leave. He rolled down his car window as he was leaving and told me that he was going to go to my ***** church and tell my ***** preacher that I ran him off. About 15 minutes later I receive a call from the ****** Police Department(one of my customers) that a man was there to file a complaint on me about my vicious dog. He was told that since my business was not located in the ****** City limits they couldn’t help him and that since he was on my property provoking the dog to anger that there was nothing they could do and the fact that they have been to my house/business and that I didn’t  have vicious dogs. Which made the man mad, so he proceed to go to the church that I attend and asks if he can talk to the preacher to file a complaint against one of the members. The secretary told him the preacher was not there on Mondays and he could come back on Wednesday or Sunday. The customer then returned to the church on the morning of 9-4-22 to talk to the preacher, the associate pastor and 2 deacons told him they would talk to me that there really wasn’t a lot they could do. He told them that I had to work for him because I sold him the radio and a battery and in New York where he used to live, if you sold something to someone you HAD to work on it for them. He was not happy about their answer and on 9-6-22 he went to the ****** ****** Sheriff’s Department(also one of my customers) to get them to talk to me that he wanted to make peace and that I HAD to fix his radio.
I know that this is a long response but I feel that it is very important for you to understand that this customer has issues and I want you to know the steps that he has taken and has tried to take against me for running him off my property after hitting my dog. There are other instances that have occurred in the past, with this customer that I can inform you of if necessary. The radio that I sold this customer carried a 3 year warranty when purchased new and the replacement battery carried a 1 year warranty, neither the radio or battery are under warranty and I am under no obligations to have any further business dealing with this individual. I encourage you to contact any of my customers, to which I can provided you as many contacts as you would like to talk with, some of which have had contact/dealings with this individual in other unrelated cases and they can verify any info that you would like to discuss. I also feel as though I have been overly patient with this individual  and could take further action(both criminal and civil) against him if necessary. I don’t have any other complaints from other people about my services. I feel as though he is just mad and trying to cause me problems, I have offered him a suggestion/solution for the issue he is having and he refuses to follow the advice. I can not help this individual anymore.
