    Date of transactions: Met 2 partners in late Apr 2023 to discuss, then met 3-4 more workers followed during the entire concrete projects between May-Oct 2023.Issued 1st check May 16, 2023 for $4,000 as down payment, 2nd check May 23, 2023 for $18,150 for various projects such as;Concrete Sealer $350 Concrete pour for building pad $10,100 Driveways (E and W side) + pool pad $5,900 Fence $5,800 (**** claims this is his brother's business)Issued 3rd check Aug 26, 2023 for $5,700 pathway and driveway extension S side Handed $200 cash for 8 scoop of dirt @25/scoop Total amount of money paid to the business:$28,050 Only completed Concrete projects from May 23, 2023 - Oct 24, 2023 Aug 26, 2023 Discussed the erosion of dirt underneath the edges of the slab of the building on the * side. *ot resolved Showed him some cracks on the pool pad but no reaction, not resolved 1st Qtr of 2024: Dispute was for the refund of $5,800 for the fence project Have not discussed issues as per only occurred during Heavy rains in the Spring of 2024 Cracked and falling, uneven pathway on East side of house Uneven extended driveway on S side of building Refunded us $2,000, received check on Sep 6, 2024.Sep 12, 2024 we contacted them acknowledged receipt of partial refund payment. Again disputed for remaining balance they believe should be $1,800 not $3,800 and said as soon as he has it he will pay us.Sep 23, 2024 Texted the partner again for the remaining balance, and at this point his message was for us not to bother him anymore. After my wife responded to him that she would be reporting him and the business to BBB to resolve this issue. He replied with ranting accusations that we were invading his privacy and he threatened that he will sue for defamation and will not pay unpaid balance. They took advantage of us by taking the $5,800, and not providing us the fence, he dispute buying materials and resell it for less. I am a Senior Citizen and a Disabled Veteran. We treated them well.

             Thank you for taking the time to contact me to explain the issue encountered recently. I apologize for any inconvenience this may have caused.I have the desire to provide the best solution. After reviewing the complaint I came to the conclusion that I disagree with the 
    accusations made against my company.In the month of May, our former clients trusted us with two different projects. Project one included placing concrete and  project two  was installing a fence. The prices for each project have been correctly mentioned in the complaint;however I consider that adding a 5% interest over the refund money is unacceptable considering that my former clients canceled the project  due to  personal problems( copy provided of email).The concrete project was set to last from May 2023 - Aug 2023. 
    Soon after, the installation of the fence was scheduled but was not successful due to constant rain.Awaiting to proceed with the project, clients contacted us to cancel and requested a full refund for installation of the fence. We informed clients we had bought material specifically for their project and that we needed time to pay a refund due to the fact that we had invested in the supplies. Clients have received $2,000 leaving a balance of $3,800. My company has a loss on this project,however I agree to refund the amount due with the exception of the 5% considering clients canceled .I am requesting am extensión to pay remaining balance please.     Dear *****,

    We would like to dispute the response this company have made and we are not satisfied with their request of extension. The company has given us many reasons just to delay payment of refund and those excuses were not acceptable that is why we were in this situation now. Now they use my email against me to make the it look like we initiated the cancellation. **** forgot to mention that we bumped into him at Aldi's ************* and there he said if we wanted to cancel he will pay us partial $3500 and he will sell the materials first and pay balance after that, we agreed to that. That is why I emailed him to remind about my money that he said he will send 2 weeks after we saw him at Aldi's. But again did not comply. If indeed they had the materials already on their had then why did they not put it up then. Our neighbors have had their fences done and it only took 1 day to finish for them to with 10 yrs and jumped to 15 yrs experience one day fence installation is a great challenge?  They also used constant rain as an excuse which is not acceptable. And saying that concrete project was set from May 2023- Aug 2023, that is not true. Besides them delaying the small projects,  They also used our yard to put their banner to advertise themselves. They are always mentioning  a loss happened in 2023 when one of their client did not pay them out of unsatisfaction as per ****** statement, and it seemed like they also want us to share with their loss which is also not acceptable.  They got our money and hold on to it since May 2023, we have more loss plus the quality of work they did I really believe we have overpaid them too. I guess asking for 5% is just a fair deal for our ordeal for the last 16 months they hold on the $5,800 till Sep 2024 and still left us a balance of $3,800 and other damages. This Company have threatened us to not contact them anymore even blocked ******** messaging.
