      Mystical began renovations on my home but did not renovate to code nor complete the work once I raised concern with owner Robinson about quality of work and workers' behavior.Major is the staircase built has both a "small" rise step at the top and a "small" rise step at the bottom, a support that swings freely across the floor and a landing that is sinking;the staircase railing and loft railing are not compliant with safety standards as the spindle placements are too far apart. I, a 67 year-old woman, have fallen for the third time attempting to negotiate those stairs. 1/2 base boards and door/window trim were poly coated. 0 stained doors poly coated. 2/3 painting finished. Door keys from handle replacement were not given to me--Robinson said they were left on the counter; I told him they were not, he just repeated they were left on the counter. The crew broke a ceiling fan, a Sony smart TV, left stain on the floor, on the cement porch, on carpet. Workers ate while working leaving food on my walls/floors/spattered in my microwave. Often the crew leader left the crew working with no direction; then threw tantrums when he observed their shoddy work. Crew leader ****** cursed me, threw tools, bullied me. Workers brought their girlfriends to work with them. During work on the ceiling, the roof they had been paid to repair began leaking. I complained to Robinson, about the leak, the crew leader, the horrible crew behavior and the staircase, he came out, looked over the work, said it would cost more to complete quality work than the amount of the contract then left.I paid Mystical Construction 16,400 dollars and have stairs that cannot be negotiated safely, a loft railing rendering the loft not usable, 1/2 stain/poly job, and 3/4 paint job, 3/4 dry wall begun, doors with no keys, doors with no handles and closets wired but no lights. I just paid a roofing company to repair my roof I paid Mystical to repair. I ask for a refund of 5,000 to replace stairs and railing.

      Overview.
           We were called out to look at ******** house after she told us another contractor started the work but walked off the job. She was unable to give me an exact description of the work she wanted done and I was unable to know exactly what we would need to do to fix what the other contractor did. I was not able to give her an estimate because of those reasons so we agreed to a daily price for labor and basic materials. As in the contract. When we started to get close to her budget I let her know. At that time she asked how much more it would cost. We came to a verbal agreement of about $24,000.00 for the work she still wanted done and could afford. At that time she was told us, the work we completed to that point looked good but when I was not on the job she started to have my crew redo work that they already finished and that she said looked good. Upon completion of the work agreed to she refused to pay us the balance do for labor and materials of $8,800.00.


      Stairs
          The stairs were built to how SHE wanted. The contractor before us built the landing to her loft. If we were to build the stairs to standard, the stairs would go pass the wall that runs next to the stairs and she did not want that and she did not want us to redo the landing. We told her it would be a trip hazard but she told ****** (foremen) and myself that it would be fine because it is just her. She was the one that told us to put the small step at the top and bottom to fit in the space available. We had to build the stairs twice to make her happy at the time. Upon completion the second time she told us she was satisfied. 
         At first she did not want any support beams under the stairs. When ****** refused to do that because we needed something to support the weight. She then allowed us to put in the support beams but she would not let us anchor it to the floor. When I asked about it she made it perfectly clear we were not to do anything to her floor. So we were unable to set the beams.

      Railing
           The railing was also custom built to exactly what she wanted. When I talked to her about it she told us that is what she wanted. I tried to tell her that it was going to be an issue but she told us that is what she wanted and what she is paying for. Both ****** and myself told her we needed better support but she refused. We had to also rebuild the stair rails twice to get it the way she wanted it.


      Food/eating on job
           On the first day one of the crew was eating lunch when he noticed something wrong with the painting. So he would not forget he fixed it right then. When she told me about how the guys were eating while working and they got food on the walls I asked her to show me. She was unable to.


      Keys
          On the last day of the job when we were leaving 3 people saw the keys on the counter and I told her where they were. I have no idea what happened to the keys after we left the job.


      T.V.
           When the crew was clearing out her bedroom they asked her where she wanted us to put the TV. She told them to leave it on the bed and to just put a blanket over it. ****** refused and told her that is how it would get broken because no one would be able to see it. He then put some plastic sheeting over it so people could see it. She then put a blanket over it. ****** had a bad feeling about it when they were leaving because she told us about how one of the contractors before us broke her TV so he checked it before leaving and it was fine. When they came back it was broken.


      Girlfriend
         One of the guys girlfriend did come to pick him up early. About 1/2 hour to 1 hour early. She did not get out of the car and she did not go into the job


      Ceiling fan
         The crew DID break the glass globe on the ceiling fan. We did offer to replace the globe but she said it was ok and that she was replacing the fan anyways


      Closet light
          That was never talked about. If she supplied the light or told me about it we would have done it


      Door handles
          All door handles were to be supplied by her per our basic labor and materials contract. She ordered them and all handles supplied were installed.

       This will be my final response to this matter. The agreement was a price per day for a certain amount of workers per day. We never had a total price for a particular trade.  She keeps saying the paint didn't get finished,  we never said x amount to paint the walls or what ever.  I'm sorry she feels this way but you can only do so much.

      I am rejecting this response because: ****** ******** is incorrect: the FIRST agreement was a per day; however, *** **** negated that agreement with a signed contract to finish the job.  Mystical Construction did not finish the job. Some of those unfinished details are listed in previous correspondence here.  When I complained about workers' behavior, the roof repairs that did not solve the roof leaks,  and the stairs not meeting code, Mystical Construction walked off the job with Robinson stating for the amount left on the contract it was not cost effective for Mystical Construction to complete the job. I am offering a compromise that benefits Mystical Construction, ****** ********, more than it benefits me.  Please compromise with 5,000.00 dollars so I may at least have a safe set of stairs.
