      I file an initial claim with the business for damages doing winter storm, however it took them up to 45 days to reach a decision, ** ***** stated we should have file the claim in adequate time. I then stated if you are denying the claim due to the time frame why did you waste time by sending an adjuster out to evaluate the building

      Regarding *** ********* statement, we looked back in our notes that are stored in our Agency Management System. Please see below the chronological activities that were made regarding this claim. Our responsibility is to report the claim to the insurance company in a timely manner which was done. You can see that our agency did that. It’s the company’s decision about the claim. Their determination was the amount of damage done was less than the deductible so therefore nothing was paid to the insured. I’m sorry *** ******* feels this way, but it has been documented that we did everything correctly. 

      April 4th – insured notified me that they had storm damage and were trying to decide if they were going to file a claim

      April 9th – insured notified me that they wanted to file a claim, and I sent them an email with a list of information that would be needed to file the claim

      April 22nd – received email from insured with details of the claim – claim immediately filed with company – claim acknowledgement received from company

      April 23rd – letter sent to the insured from the company setting up an inspection date of May 1st

      May 7th – letter to insured that claim inspection had been performed and report would be sent to the company for consideration

      May 31st – received notice from the company that they were denying the claim due to the damage being below deductible

      June 5th – letter to insured that claim was being denied due to damages being below deductible

       

       

      The claim was not denied for any time frame.  The company stated the amount of damage is below the insureds deductible.

      I am rejecting this response because: 

      It continues to rain in the building and has been on going . Everytime I go to the building due to the roof leaking it began to smell like mildew. Why have insurance or pay for insurance but when you file a claim it gets denied before long it's gonna continue to rain and the building gonna be in worst shape.

      I will take this complaint to court if I have to
