Advanced Resolution Services, Inc. (ARS) is in receipt of your January 9, 2025, complaint from ****** *******. Thank you for contacting us and for the opportunity to respond.
By way of background, ARS operated the Issuers Clearinghouse Service, a product that was specifically intended to detect and prevent fraud in the course of credit card applications. Please be advised that as of October 31, 2024, ARS discontinued the Issuers ************* ******* and has ceased providing consumer reports to third parties.
****** ********* complaint requests that ARS conduct an investigation to correct information appearing on the ARS consumer report, specifically Oliphant USA.
A copy of ****** ********* ARS consumer report has been sent by US mail January 9, 2025, along with a letter summarizing the disputed items as not on file. Moreover, ARS consumer reports have never contained collection accounts or accounts with payment history.
As ARS discontinued the Issuers ************* ******* and has ceased providing consumer reports to third parties, ****** ******* may wish to obtain a copy of the information maintained by the three nationwide consumer reporting agencies, whose contact information is referenced below.

We have received your May 31, 2023, complaint from ***** *****. Thank you for contacting us and for the opportunity to respond.
In Mr. *****’s complaint, he states that Advanced Resolution Services, Inc. did not honor his request for a copy of his Advanced Resolution Services consumer report. By way of background, Advanced Resolution Services, Inc. operates the Issuers Clearinghouse Service, which is specifically intended to detect and prevent fraud in the course of credit card applications. While ARS does not meet the definition of a nationwide consumer reporting agency under §603p of the Fair Credit Reporting Act (FCRA), which would impose certain obligations, as a common consumer reporting agency pursuant to 15 USC §1681a(f), Advanced Resolution Services, Inc. is, nevertheless, regulated by state and federal credit reporting statutes. Consequently, ARS conducts its operations in compliance with the FCRA (and in this case, New York state law), and has reasonable procedures in place to help ensure maximum accuracy and that information is only disclosed as permitted. One of those obligations is to verify the consumer’s identity before making a disclosure. 15 U.S.C. §1681h(a)(1).
Based on a review of our records, ARS received a request for a security freeze from Mr. ***** on April 25, 2022, via our online portal for a security freeze. The request did not include a request for a consumer report. Importantly, Mr. ***** submitted a New York driver’s license with a Park Avenue, New York City address. The request for a security freeze was promptly honored.
On March 24, 2023, Mr. ***** submitted a request for a copy of his ARS consumer report. However, the request did not include a legible Social Security number, or a legible copy of his state issued ID to enable ARS to properly validate the request. Given our statutory obligation to reasonably verify his identity before making a disclosure, ARS relied on 12 C.F.R. §1022.123, which sets out the requirements for appropriate proof of identity. ARS mailed a letter to Mr. ***** on March 25, 2023, asking him to submit the required information necessary for verification of identity to honor his request. ARS did not receive a response to our letter until receipt of the May 31, 2023 complaint from the BBB.
To provide additional context for our actions, in reviewing the documents Mr. ***** uploaded within his complaint to the BBB, we note that Mr. ***** included a copy of his New York state issued ID issued September 14, 2016, and a Social Security card issued December 28, 2012, with the last four numbers of “****.” ARS was able to match the Driver’s License to yet another consumer request ARS received on November 29, 2022. The Driver’s License was otherwise identical in every respect to the April, 2022, request for a security freeze, except for the address. Different Driver’s Licenses issued on different dates to the same person but with different addresses are common. In this case, we were presented with two Driver’s Licenses ostensibly issued on the same date to the same person, but with different addresses. Moreover, the documents ARS received November 29, 2022, also included a Social Security card issued December 28, 2012, but which contained a Social Security number with the last four number of “****,”. The SSN card provided to ARS in November 2022 has the same issue date, same first five digits, nearly identical signatures, but is otherwise different than Mr. ***** provided within his BBB complaint. Please see the attached redacted information. Faced with the conflicting information, ARS reasonably took the position that, at best, the November request related to a different person, and at worst, raised the possibility that someone was attempting to defraud ARS and its users by preventing negative information from being disclosed to credit card issuers in connection with a credit card application.
Notwithstanding our legitimate concerns, we will deliver a consumer report to Mr. ***** to the address provided in his BBB complaint. in the event ARS receives a request from a credit card issuer to provide information associated with the last 4 SSN **** associated with Mr. *****, (the information submitted by Mr. ***** to the BBB), a security freeze is in place.
We believe we have acted appropriately in accordance with federal law and the BBB’s expectations. I trust this letter satisfactorily responds to Mr. *****’s concerns. Of course, please feel free to contact me at ###-###-#### if you have any further question or concerns.

Advance Resolution Services (ARS) ** *** **** ******* ******* ***** violated the Fair Credit Reporting Act & California Consumer Privacy Act. 15 U.S.C 1681 section 602 A. States I've the right to privacy. ARS collected my data & shared it w/ Experian, Equifax & Transunion without my written permission. 15 U.S.C 1681 Section 604 A Section 2: states a consumer reporting agency cannot furnish an account without my written permission. I've never given ARS my written permission to collect my data or to share. 15 U.S.C 1681c. (a)(5) States: No consumer reporting agency may make any consumer report containing any adverse item of information. ARS has adverse data they've collected on me & also that they've shared w/Experian, Equifax & Transunion. 15 U.S.C. 1681s-2 (A)(1) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ARS shared inaccurate information w/ Experian, Equifax & Transunion. I’ve told them via phone conversations & in writing that it's inaccurate. In writing I've told ARS to put a Security Freeze on my account. They've not. They've my name, address, phone number & social security number. I sent them a copy of my drivers license & a copy of my electric bill proving my identity & that my address & phone are legitimate. I've asked them over the phone & in writing to stop collecting data on me & also asked them in writing & verbally not to report any data that they've collected on me to Experian, Equifax and Transunion. I asked them to delete all the inaccurate data in my file. There should only be one name, one current address & one phone number. ARS has verified my social security number. ARS doesn't respect the American's w/ Disabilities Act. I told them I don't have W2, paystub or tax return due to my disability. They say they won't help until I provide that.Business Response

By way of background, Advanced Resolution Services, Inc, operates the Issuers Clearinghouse Service, which is specifically intended to detect and prevent fraud in the course of credit card applications. As a consumer reporting agency, Advanced Resolution Services, Inc., is regulated by the federal Fair Credit Reporting Act. Consequently, ARS conduct its operations in compliance with the statute (and in this case, California state law) and has reasonable procedures in place to ensure maximum accuracy.
In Mr. ******’s complaint he states that Advanced Resolution Services, Inc. has violated his privacy by sharing it with Experian, Equifax and TransUnion without his permission. Be advised that ARS does not share any information with Experian, Equifax or TransUnion. Mr. ****** cites statute 15 U.S.C. 1681 c(a)(5) no consumer reporting agency may make any consumer report containing any adverse item information. Mr. ****** is incorrect in citing the statute. The statute states (5) any adverse item of information, other than records of convictions of crime which antedates the report by more than seven years should be excluded. ARS does not report information older than seven years. he has a right to privacy under 15 USC 1681 section 604 A section 2. Mr. ****** further states that a consumer reporting agency cannot furnish a consumer report without his written instruction.
Mr. ****** further states that he has requested to place a Security Freeze on the information in our files that is associated with his Social Security number and ARS has not complied. Based on a review of our records Mr. ****** submitted a request via our online portal on February 16, 2023. ARS was unable to verify his identity and in turn sent Mr. ****** a letter on February 20, 2023, requesting additional information. Mr ****** called in to the office on March 1, 2023, in response to the letter he received. Mr. ****** was advised during the phone call to send in a copy of his Social Security Card for verification. To date, ARS has not received this information.
ARS’s request for verification was reasonable. A request for a complete Social Security number and for documents verifying that the number belongs to Mr. ****** are requirements that commensurate with the heightened risk of harm arising from misidentification. ARS has an obligation to safeguard the consumer’s information by requiring that the consumer provide “proper identification”. Because Mr. ****** did not provide the requested information, ARS had no obligation to process the request. It would seem that the complaint lies with the FCRA statute itself, and not with ARS.
We would like to assist Mr. ****** in placing a Security Freeze with Advanced Resolution Service, Inc. In order to place the Security Freeze, he will need to provide:
· A photocopy of Mr. ******’s Social Security card, tax return (with financial information redacted) or W2 showing Mr. ******’s full Social Security number.
