I went in to buy a used motorcycle. Took it for a test ride. I put a large down payment on it. And signed the paperwork with Harley Davidsons Financial Services “Eagle Mark Savings Bank” that was on a Thursday Feb 9th 2023. The dealership was closed Sunday and Monday. The following Tuesday Feb 14, (4 business days later, the same day I’m writing this for documentation) I went to the dealership to cancel the contract for personal reasons.
I never took the bike off dealership property, never touched it since the initial test ride prior to the contract being signed, haven't gotten the keys or anything yet because I no longer plan on purchasing the motorcycle and it remained in Harleys Davidsons possession.
Now I’m dealing with the Fort Smith Harley Davidson dealership and Eagle Mark Savings Bank trying to cancel my contract and get my down payment refunded and contract canceled because I no longer am taking personal possession of the bike.
This is theft. I understand that I signed a payment contract with the dealership and their financial institution but if I haven’t taken the item and choose to cancel the contract in less than 5 business days then it shouldn’t be an issue.
So now I might get screwed out of my down payment, and the interest accumulated until this is resolved plus they won’t purchase the bike back for what they sold it for WHEN IT NEVER LEFT THE DEALERSHIP.
I understand times are tough, but Harley Davidson has more than enough money to do the right thing. They don’t make money, they don’t lose money, and they can sell the same motorcycle to a different person for the same price or higher if they wanted to.
This is outrageous for an American company to treat a customer this way given the situation and timeline. I will never purchase a motorcycle from a Harley Davidson dealership or use any Harley branded or affiliated institution ever again unless this is resolved properly and righteously.

Despite receiving the deposit & signed contract for the purchase of this vehicle, 4 business days prior, Fort Smith Harley-Davidson made every attempt possible to reverse this transaction. We cancelled & refunded payment for the Extended Service Plan & Prepaid Maintenance Plan, that was purchased during the transaction. We also submitted requests to Eagle Mark Savings Bank to attempt to cancel the contract & purchase. Unfortunately, once a contract is signed & funding is finalized, the financing is then handled by the lending/financial institution, Eagle Mark Savings Bank in this case. We also offered to repurchase the vehicle, but at that point, costs had accrued that could not be reversed.
