    We have a lifetime warranty with Phillips Affordable House Leveling for the piers they placed under our house before we bought it. We have the certificate authenticating this. We have called the business 6 times, leaving voicemails numerous times for a call back, with no response. I have told them my name and address and left my phone number. We are having issues with our foundation now and just want them to come out and look at the piers they placed. We cannot get a response or an answer.

    My name is ******* ********, and I used ‘American Abstract Title Company’ in North Little Rock, Ar when closing on my house on September 6th, 2022. The house that I purchased had a transferable lifetime warranty for the foundation repair that was done in 2014 by ‘******** affordable house leveling’. When closing on my house my relator, the title company, and myself were all in mutual understanding and agreement that it was the title company who will be completing the task of sending the required $100 check to the foundation company to complete the transfer of ownership. I was explained to that this task was apart of the closing cost I paid when closing on my house.
    The lifetime warranty had a 90-day period, starting from the date of closing on the house, that the transfer of ownership had to be made. I was not contacted until July of 2023 by the title company, explaining that they tried sending the money for the transfer of ownership on the warranty three separate times but received the check back as “undeliverable” all three times. The Title company also explained that they had called and spoken with one of the foundation company employees on all three attempts asking for a current mailing address to send the money to. On each of the three attempts, the foundation company provided a different mailing address for the title company to send the money for transfer of ownership to. All three addresses provided by the foundation company failed to accept the check sent by the title company, and therefore were returned to the title company as “undeliverable.”
    With the 90-day period that the transfer of ownership had to be completed by, the last day of the period would have been 12/6/22. But I was not contacted by the title company until 7 months later, in July of 2023, being way past the time frame allotted for the transfer of ownership. I was told 9/6/22 when sitting down with the title company manager ******, whom I closed on my house with, that they would handle it. And with not being contacted during the 90-day period I was in understanding that it was handled properly by the title company. Instead, over the last several months my house has acquired damages from the foundation issues it possesses. When contacting the foundation company to come evaluate the extent of the damages that my house has obtained, they explained to me that they never received the check for transfer of ownership and the warranty is now voided. The foundation company employee who came out to inspect my house said he would have to talk to his supervisor about the warranty situation, and said he would be in contact later that day. I never received a call from him, and when I attempted to call the foundation company they did not answer their phone with the number provided on the company website. When I was not able to get in contact with the foundation company, I tried calling the title company to ask what to do in this situation, that I thought had been handled and they were not able to provide much help. ******, the title company manager and whom I closed on my house with, told me “There was not much more that the title company could do on their part.” In which case, I purchased my house under false pretenses that there was a lifetime foundation warranty that came with the house upon purchasing that the title company failed to complete.
    The title company failed to contact me in a timely manner in regards to the foundation company evading the acceptance of the check for transfer of ownership for the lifetime warranty on my houses’ foundation.

    Upon researching the mailing addresses provided by the foundation company, the information and pictures of these addresses appeared to be run down/ abandoned houses. I also did research on the foundation company, and they no longer possess a contractor’s license and are no longer accredited by the BBB after failing to meet their guidelines.
    I am reaching out in hopes of somebody in a higher position to shed some guidance or assistance on the current situation I am facing with a foundation company evading their responsibilities and a title company who failed to complete a task they were paid to do. And now my house is continuing to acquire damages from this ongoing foundation issue that should have a lifetime warranty on. I am going to provide the contact information for the title company and foundation company below, along with my contact information.
