    On 3/27/24 i had Next Level Powersports service my boat. They changed the oil changed the impeller, and de-winterized the boat stating it test ok and was water ready. The 1st time the boat was in the water after being at the dealership was May 21st. We launched the boat and my wife proceeded to drive the boat approximately a half mile to our dock. She never made it to the dock because the boat over heated and caught fire, The dealership had not turned the Raw Water valve back on after service causing the motor to not get water over heat and catch fire. Once on fire the boat started sinking due to burning the exhaust off, luckily my wife was close enough i was able to get her to the dock and get the fire out before it was a total loss. Dealership initially took responsibility for the fire and said they would file under their insurance. After 2 weeks of them not taking any action i decided to go get the boat and file under my own insurance. At that point i was informed they had never started a claim on my boat and the owner of the company called me and proceeded to curse at me for no apparent reason. After taking the boat several days later my insurance got a claim number with their insurance and shortly after received a denial letter from Next level Powersports insurance. Their negligence ruined a 150k boat and cost me an entire summer on the lake with my family.

    ***** as boat owner it states in your Boat manual to do a full walk around of your boat before it goes into the water. We did service and DE winterize the boat and you were told we never hooked a plunger up only ran a hose over in the boat and bypassed the sea cock and went straight to the strainer in the boat. You were also told that when you picked the boat up the sea cock was closed and would need to be opened before you got into the water. Also, just like **** mentioned the boat has alarms and indicators when it is overheating and its pure negligence that it went as far as it did. That being said it wasn't our decision to Deny your claim it the decision of the insurance company. They investigated the situation and found there was obvious Negligence involved.

    I am rejecting this response because: These statements are false, I was told the boat was water ready by your service manager who also admitted to me and my insurance rep that the dealership was at fault. I was told a plunger was used on the boat and it was ready to be put into the water. Also have paperwork stating it was qater tested. I was never informed the seacock was closed. As for the alarms on the boat by the time it was sounding it was to late I had a wife and child on the boat in the middle of the lake on fire and sinking. Your insurance never gave me a reason for denial and the your dealer ship has been no help at all as you have lied saying you would file a claim yet waited 2 weeks to do nothing about it only to file a claim when your were told the boat was going somewhere else. Your negligence cost my family an entire summer on the lake and all your dealership has done was give me a good cussing from the owner.

    We put a deposit on a boat thinking we would be able to look at it in a few days then some health issues came and we couldn’t make it also after further investigation we found out that this boat was not suitable for the rough water at lake of the Ozarks where boat. After discussing this with the manager he stated he would not give us our refund back .

    To whom it may concern,

           *** ****** ***** called and spoke with our salesman Tyler about buying a pontoon boat. He Decided on a 2022 Manitou 25 OASIS VP II. He decided to put a deposit down to hold his spot as we had several people interested in the boat. He was informed this is a Nonrefundable deposit. The boat was a 2022 model when we got word there was a deposit, we immediately got it picked up with Sky track and lowered on a trailer and taken to the water. The boat went through our final water test and inspection, plugged into, Graph set, Time and Date Etc. Then the boat went into detail for an extensive wash and cleaning on everything as it was a 2022 model and it had been sitting for a while on Tires. We got the boat Cleaned trailered to the water and inspected to find out *** ******* had some unfortunate medical emergencies and was told by another dealership the boat was not "adequate" for Table rock lake. (This is a 25-foot Tri toon with a 200 Mercury outboard). They have been tested in rougher waters however I understand Table Rock Lake is very busy and rough and can make any boat feel it is getting beat up at times. Its company policy to get a deposit for this reason, we have Multiple man hours prepping and finalizing these purchases if we didn't get a non-refundable deposit, we would be out several man hours that could have been directed at another customer.

    I would like to comment more to the next level power management.
    He stated they had to pick the boat up and put it on a trailer and clean the boat for me. Well I have pictures of the boat before we even inquired about it and the boat was already cleaned and setting on a trailer! I don’t understand why he thinks that I should pay for that!

    Our policy at Next level is NO REFUNDS ON DEPSOSITS. It goes above managements head. On a second note, you were informed it was a NON refundable deposit. I have no further explanation. Also noted the boat was fully capable for your lake that's False information you were told by competition in your area. Have a good Day!
