    We entered into a construction contract with Pottridge Constuction LLC on 3/9/22. Closing occurred on 4/1/22. Construction started on 5/9/22. Pottridge Construction received three draws based on meeting milestones of the contract. When Pottridge Construction tried to obtain the 4th draw on February 23rd, 2023, Chambers Bank denied it based on the construction did not meet the requirement to “be in the dry”.

    March 10th: Received text from ***** ********* stating that we would be receiving a notification of intent to lien on our property from River Valley because the red iron had not been paid for.
    March 16th; Learned from River Valley Feed and Metal that the metal required to put the house in the dry had not been ordered.
    March 21st: Learned from ABC Supply in Fort Smith that the front door had been ordered but not paid for.
    March 21st: Learned from ******** ***** that the framer had not been paid for the work completed on the home.
    April 12th, received text from ***** ********* stating that he would not be doing any more work on our home until he talked to his lawyer. Three further texts from us requesting an update have gone unanswered.
    The following defects have been found.
    1) Fireplace has to be reframed
    2) Mr. Pottridge installed black tar paper on the plywood on the roof which mostly blew off during a wind storm.
    3) The concrete slab was poured incorrectly resulting in about 4 inches of material outside of the structure.
    4) Two windows were broke during installation.
    5) Plumbing for second hot water heater not installed as the design.
    6) Interior concrete was not prepped for staining as per the contract. The construction crew also left chips in the concrete.
    Based on discussions with other contractors, it’s our best estimate that Pottridge Construction did roughly 1/4 dollars worth of work against the money drawn.
    They have left vendors and sub-contractors unpaid. One of which filed a lein against us.
