    To Whom It May **************** Complaint Against OptimizeYou for Violating TCPA Regulations I am writing to lodge a formal complaint against OptimizeYou for their SMS marketing practices, which I believe violate FCC regulations and the TCPA.On December 1st, I received an unsolicited marketing text message from OptimizeYou. I promptly opted out of their marketing communications as per the instructions in their message. However, within a day or two, I received another marketing text from them. This is a clear violation of the ***** which mandates that a request to stop receiving marketing messages must be honored within a reasonable timeframe.I request that this matter be investigated and appropriate action be taken against OptimizeYou for their non-compliance with the TCPA.Thank you for your attention to this matter.

    Firstly, I want to assure you that the message sent to **************** was not a marketing communication. It was, in fact, a non-marketing message specifically intended to request his feedback through a review. I want to emphasize that **************** has been successfully unsubscribed from any future marketing messages, and we respect his preference not to receive such communications.


    However, a second message was inadvertently sent after his unsubscription, and I would like to clarify that this was a result of an automated system designed to send a reminder within two days. Importantly, this reminder is not characteristic of marketing messages and is not intended to be intrusive.


    Steps have been promptly taken to prevent any recurrence of such incidents. I would like to assure you that, moving forward, **************** and others will not receive any unsolicited marketing messages from our end.

    Thank you for your prompt response. However, there seems to be a significant misunderstanding. I would like to clarify that I have never been an employee of Optimize You Performance medicine ( OptimizeYou, LLC). Any claims or records stating otherwise are erroneous and need to be forwarded immediately.

    Considering this, I request you to provide me with any documentation that files me as an employee (W-2, offer letter, etc.). Additionally, I must insist on a formal acknowledgment and visual proof that my personal data has been completely removed from your systems as a patient, along with any other capacity that I have been mistakenly associated with.

    I am concerned that this misrepresentation of employment could potentially be a breach of my rights. In the interest of resolving this matter amicably, I ask you to address these issues promptly. If I do not receive satisfactory evidence of the corrections and my data removal, as the misrepresentation of employment status can constitute a legal offense under applicable state laws, potentially falling under identity theft or employment defamation categories.

    After looking further into this, we have determined that the message in question was generated by a test patient account in which you created. It has been brought to our attention that your information was intentionally entered into these test accounts, resulting in the message being sent. Had your details not been deliberately added to these test patients, the message would not have been generated.

    I would like to acknowledge your observation that you were not an employee, which is accurate. However, it is noted that you had access to all of our systems and intentionally input your information into multiple accounts within the systems. I want to assure you that immediate action has been taken to remove all instances of your information from our records.
