I contacted ************************* of Aspen Grove on February 16th, On February 15th my grandchildren and I did a welfare check on ****************************, my ex-husband, our children are deceased, and his grandkids are his only living immediate relatives. We subsequently, discovered he had died a month before in a Hospice and ******************** had been assigned to help him. She was in the process of getting guardianship of him, when he died. ****************** was all suger and sweetness, until I asked her to work with a family frined in *******, because it would be easier that dealing with stuff long distance. This instant I told her he would be calling, she cut off all communication. We have no idea as to what has happened to his body, we have no idea about his burial, Nothing! she has not returned phone calls, or emails responded in anyway. We had no intention of not paying her for her services...we just wanted her to work through our friend *****, because he was there. Very, very unprofessional of her, and it makes me feel like perhaps she is not the most honest and trustworthy person to handle anyone's money. She obviously doesn't care about the family.

      Business Response

      Date: 07/12/2023

I would like to respond to this complaint by clarifying that I was never appointed to any position of authority on this gentleman's case. I had been contacted by the hospice agency on January 12th to assess Mr ******* for possible POA and quickly realized that he did not have capacity to sign documents. I spoke with my attorney about filing a petition for guardianship and conservatorship, but unfortunately Mr. ******* passed away within days after meeting and before any steps could be taken. I had contemplated applying for personal representative as far as had bbeen reported, Mr. ******* had no living relatives that could represent his estate. There is a 45 day post-mortem waiting period before you can apply and that requirement had not yet been met.

I received a call from ************ on Valentines day, and I informed her of what I knew at the time. Which wasn't much. I had agreed to assist in any way that I could. Very soon after my contact with ************, I was contacted by a gentleman claiming to be the son of the woman named as Mr. ********* POA, personal rep and trustee as well as the beneficiary in his will. I also spoke with attorney ********************* regarding the named representative, located the recorded documents and determined that this case was already settled and I no longer needed to pursue. ************ was informed and was not willing to accept this outcome. This was beyond my control, I was never "hired" by anyone, never appointed, had no obligation or responsibility and as I stated, no authority.

Also for the record, I never received a call from the family friend *****. My honesty & integrity are completely in tact, and no one would ever argue my concerns for clients and their families. While have great sympathy for this family's loss, there was nothing more that I could legally do and was not required to to provide any further assistance to the family. Again, I offer condolences but nothing more.
