In August 2023 my brother, ***************************, was contacted by Foreclosure Excess Proceeds. They were aware that our deceased mother's property had been foreclosed upon and was being auctioned. They told him it was a very drawnout process that he couldn't navigate to.retrieve the funds from the court, and that they would do the work to claim the excess proceeds for ******* dollars total fee. He informed them that he has two sisters whom had a right to the money as well. They said no problem, you can be the representative and the proceeds will be split 3 ways after the ******* dollar fee was taken out for FEP. I had previously spoken with the county treasurer and was told that over 35 thousand dollars was the excess from the auction that had been deposited with the court. FEP didn't keep us informed as to when the case was being heard. They recovered the funds and did not promptly disburse them to us. My brother was in need of money before the court date and they offered a loan against the funds anticipated. He received a $1500.00 loan for which they kept $2500, effectively charging him far more than the legal interest rate. My brother was paid the balance of his share a week before my sister and I were because he knew when the case was heard and demanded his money. My sister and I received ours a week later after they tried to come up with resons why they didn't owe us as much as was expected. Once I told them I had spoken with the treasurer and knew how much money was due, ******* was sick and unreachable for 5 days. She finally forwarded my sister's and my portion minus $500 extra. I asked for paperwork to see the amounts and for tax purposes, I was told we did not have to pay taxes and they didn't need to give us paperwork. We would like the extra money withheld to be returned to us. Thank you for any help you can provide.
