On 5/4/2022 I purchased and paid CASH ($28,007.35) for a used 2005 GMC C6500 Topkick Box Truck. The truck broke down on the freeway in Las Vegas two weeks after I purchased it. $2,250 to tow the truck to be fixed. The cost of repairs and parts (fuel transfer filter and drag link) was $3,100.04. The truck went back on the road 7/11/2022 and broke down again on 7/13/2022 Loves truck stop road side assistance came out diagnostic fee $633.01 (radiator hose busted) towing fee $1800.00 to Loves Tr stop to fix. The cost to repair the truck by Loves was $790.00. On 7/22/2022 I took the truck to get an oil change and when I parked the truck at the truck stop I heard a squealing noise from a belt. I contacted Rush Truck Center they came out diagnostic fee $342.00 (clutch fan, serpentine belt, pulley and bearing). The cost to repair the truck is $3,511.24. On 7/26/2022 I called the manager/owner of Tucson Trux and I told him about the new repair issue I was having with the box truck and I asked him to help me pay half of what the truck cost to be repair this time and he told me that he could ONLY help me find the parts. At this point, I am asking BBB to help me recover ALL the cost that I spent to repair and ALL the towing cost for the truck . Tucson Trux & Equipment Sales LLC sold me a botched up / lemon box truck and refuse to help or assist with the repair costs.

      In response to complaint 17628728

We do agree that she purchased a USED 2005 GMC. The KEY
      word is used.
AS stated on the Sales Agreement- Buyer understands SAID
      GOODS ARE SOLD “AS IS”
With no warranties of any kind expressed or implied.
Within (2) Days of purchasing Owner’s Employee called and
said truck would not start. After walking the driver through a series of things
as to why it would not start, it was determined that the driver had the truck
in REVERSE.   Once the truck was put in NUETRAL, the truck immediately
      started.
      (2) weeks later we received a call that the truck had broken down.
It was determined at that time by the mechanic was that the driver had put GAS
in the truck and not DEISEL. The mechanic drained the tank and replaced the
fuel with Diesel and the truck started and ran fine. As to the need for the FUEL
Transfer pump, this was caused by the gas being placed in the fuel system.
We then received a call that the truck was not running well.
The owner was advised at that time she would need to bring the truck in to our
location for us to look at. The owner did bring the truck in (Driving it to us
from California).  The issue found was
that they had pressed the Overdrive button on the truck which was what was
making the truck run “Bad”. The truck was running on its Rev Limitor since it
was stuck in 4th Gear. Once the Overdrive was disengaged the truck
ran fine. The owner acknowledges that this was driver error. It was also
discovered that the passenger fuel tank had been shut off.
As to the issue with the Radiator Hose and the Fan Clutch,
these are just things that happen on a used truck and are considered just
      normal wear and replacement.
We feel that we have gone above and beyond trying to help this
customer, but without the knowledge of trucks which Is evident in this
complaint we feel most of these issues were user caused or normal upkeep and
      repairs on any vehicle.

As far as the incident of using the wrong gas that is incorrect and I have PROOF that the correct gas was used. That is all the owner can say because of what the Love's shop told him. I can and will present ALL my Fleet card receipts that has every gas station, the time, the date and the type of gas used in the box truck. The owner always harps on the inexperience of me buying a box truck, my cash was not inexperience when I purchased it. Was it inexperience when I brought the truck back to the shop and Arayon noticed the gas values were closed off all the time I have been driving it. Was it inexperience when I purchased the truck and the emission was not completed and I had to bring the truck back to Arizona to get the emission completed. I completely disagree that Tucson Trux & Equipment Sales LLC went above and beyond for me. I do agree on one thing and YES it was a used box truck better yet it was a good looking lemon. I was sold a truck that had a lot of problems under the hood and Tucson Trux & Equipment Sales LLC knew it.

We would like to request that you (BBB) look at our long-standing record with you. As
we have been with BBB for a very long time.  You will find that we have a clean record.

As explained before the following is the disclosure on all of our invoices-
      **Sales Agreement/Bill of Sale
Buyer hereby acknowledges receipt of the above-described
goods and accepts same. Buyer acknowledges that Buyer has inspected said goods
OR has had a reasonable opportunity to inspect said goods and has chosen not to
do so. Buyer understands SAID GOODS ARE SOLD "AS IS" with no
warranties of any kind expressed or implied, more specifically, but not by way
of limitation, THERE ARE NO IMPLIED WARRANTIES OF MERCHANT ABILITY OR FITNESS
FOR A PARTICULAR PURPOSE. Buyer understands and agrees that payment of all sums
reflected by this invoice is due to Seller as of the date hereof. I have read
the foregoing and understand and agree to same. AS IS SALE - NO WARRANTIES OR
EXCHANGES UNLESS SPECIFIED IN WRITING ABOVE.

We have never had an issue before this. We feel we have done
what we can by troubleshooting the issues. These were normal things that happen
with purchasing a used truck, not major components.
We also just tried to contact by phone to let her know that
we did locate the part she needs in Phoenix AZ. Here phone number is no longer
working. An email was also sent to the one on file.
If the results is a strike against our perfect record so, be
      it.
      Thank You!

      Customer Answer

I received an email from the business advising me that they have located the parts that I need at a salvage truck place in Phoenix, AZ. I declined the suggestion and/or offer to use those parts because I am tired of breaking down every week. The owner labelled me as an inexperienced box truck owner and with his choice words, I decided to put NEW parts on my truck so I can get back on the road with no problems and those parts have warranties. Lastly, going back and forth with this business is a waste of my time and energy. Before I purchased my box truck, I looked up their BBB rating and it was A+ which encouraged me to purchase the used box truck from them. I was told by the salesperson if I had any problems with the box truck, to call them! I was also told if I have any engine/motor issues let them know. He even went on to tell me about a past customer that had trouble with his used truck years after he purchased it and they helped him out. It's clear my situation is different and it's obvious this business does not stand behind a truck that is purchased off their lot. I hope the next customer(s) does a little more homework on their business endeavors and on this company before purchasing a used box truck from Tucson Trux & Equipment Sales LLC.
