    I have been trying to contact to have a new well drilled as the old one is failing. There is a great demand for drillers in southern Idaho because many wells are failing. In the first week of June, 2022, I contracted with Ace Well drilling, a firm registered in Arizona with the ***** ********** ** ***** *********, I contracted with Ace Drilling and gave them a deposit of $6,140 to drill my well. The deposit was required to get on their list to schedule the work. The deposit was half of the estimate for the work to pay for materials, which is common among bids that I solicited. Ace Drilling had done work for others in the area and a neighbor had also contracted with them. The contract stated that the work would begin within 90 days and I would be contacted 2 weeks before work would begin.

    I tried to contact Ace Drilling many times during the late summer/early fall to determine their arrival. I was never able to contact them despite always leaving a message. I finally contacted them in October and was told by the owner **** *******o, that he was not good at returning calls and that they were running behind. Every time I called, the excuses were similar. Finally near Thanksgiving in November, I knew they were running out of time and demanded a hard arrival arrival date. **** asked if I wanted my deposit back. I told him yes if he was not going to do the work as promised. They gave me December 15th. On the 15th I contacted them and asked why they were not there. I was told that it was too cold to work. They continually avoided contacting me. In the fourth week of January, I contacted **** and told him that this situation would not work and asked for the return of my deposit. He told me "good luck in getting it back" and hung up. No contact since that point. The deposit was declared non-refundable, but they would not schedule the work without it. None of the contract items were completed and therefore, the contract is void.
