A contract for $782,503.00 for construction of a residence was executed on 2/22/22 by myself and my wife, ****** *******, and ****************************** Partnership. The construction was allegedly completed 4/28/23. Our real estate agent, volunteered to retain and pay for an inspector of the premises. The inspector contacted PebbleCreek's site manger, **** *****, and requested permission to inspect the premises. **** ***** advised the inspector the premises was ready for inspection and approved inspection. We did not contact or meet the inspector until the day of the inspection after the inspection was completed. On arrival at the premises, we met the inspector and **** *****. We were advised the property flooded. It appeared the entire floor, base boards and part of the walls were damaged. ***** admitted he made a mistake. The construction crews left a rag in the main drain pipe. The pipe had not been scoped the verify the rag had been removed. He stated the property would be fully repaired to our entire satisfaction. Within three days *********** changed its mind and said we would have to pay for repair of the damages. *********** admitted its negligence but wanted us to pay for the damages. *********** unilaterally advised its title insurance company, *************************, "condition of closing" $21,844.00. *********** demanded us to pay for its negligence as a contition of closing. The tile company followed PebbleCreek's unilateral direction. If we did not deposit $21,844.00 into the escrow, PebbleCreek would have forfeited the contract and wrongfully retained hundreds of thousands of dollars already paid for upgrades. That left us with no choice but to pay for damages caused by PebbleCreek's negligence. We actually suffered damages far in excess of $21,844.00 as we could not move in timely and incurred other large expenses. Brief Summary of the Complaint:Unlicensed agent provided inaccurate and deceptive pricing information that was the basis for our executing a purchase agreement. We were not allowed to review detailed design criteria until AFTER we made a non-refundable deposit of $33,900. Via multiple discussions and emails with *** (who is not a licensed agent), we were "assured" that the total cost of the home would be $1,235,890. This even included his estimates for a fence, landscaping and a pool. We asked several times if we could understand what the "base" design options were and we were NOT allowed any design pricing or clarity on what the included "base options" were until we scheduled our "design sessions"; and we were not allowed to schedule "design sessions" or even clearly understand the base options until we had an executed PA and made the non-refundable deposits. After spending 2 of the 5 days in our "design meetings" it became all too clear that we had been COMPLETELY misled as to what the REAL purchase price of the home would be. With NO landscaping, electrical changes, light fixture selections etc. we were over $350,000 HIGHER than the total pricing provided by ***. Just one example of extreme price gouging was the "included" large floor tiles that had bubble flaws pointed out by the designer. Who puts tiles with flaws in a home with a cost over $1M? As a result, we selected standard Vinyl Plank Flooring. This ONE change cost an additional $32K! We asked to understand the "credit" we were receiving for NOT installing the "included flawed tiles" and they would not provide the detail. This is truly when we knew the lack of transparency and disclosure of information was an issue and we feel retaining the large ******* money deposit based on false and misleading information is not acceptable.Initial Complaint

We are writing to you to request your assistance in obtaining reimbursement from Robson Resort Communities for repair of a faulty 1 1/4 PVC pipe at our water meter. On 8/17/24 we found a note on our front door from ****************, dated 8/16/24. The note stated there was a leak at our water main causing a loss of one gallon of water per ten minutes. We immediately contacted a local plumber, who came out after 8PM that night to diagnose the leak. He informed us the type of work needed was not in his expertise as a semi-retired plumber. After turning off all water supply, he stated the leak was due to a faulty pipe elbow put in by Robson and it should be covered by the builder and that we should reach out to them. The invoice for this plumber was $50. We did not request Robson to cover this diagnostic visit. We paid for it ourselves.When we arrived home the next evening, Saturday, August 17th, we immediately called Robson customer service and spoke with an employee named *******. We explained the situation to *******, who informed us to proceed with securing a plumber and to send the invoice to Robson. Additionally, we submitted photos of the leak as well as the note from ***************************** such, we then contacted Rite Way Heating, Cooling and Plumbing, a highly rated plumber in our area. They came out that evening and worked for hours as they had to dig a trench into the ground to reach and expose the leaking pipes. The bill from Rite Way was $987.98. We wanted to send the bill directly to Robson. However, the plumbing contractor required payment on the same day of repair. Therefore, we paid the $987.98 bill in full.On August 18, 2024. ********, a Robson Representative, called us and asked us to send them the invoice. We hand delivered it to them within a few minutes that same day. They have since refused to reimburse the fees.We ask that Robson, fulfill their obligations to us and reimburse the $987.98 plumbing fee.Initial Complaint

My wife and I built a new construction home at the Robson Ranch resort in ****** ***** and relocated from ************ in May 2023. We encountered numerous set backs and obsticles right from the beginning of the transaction and purchase of the property. The initial walk through with builder *********, and *****************, customer service representative. At that time we encountered numerous repair or replacement items such as damage to the front apron of the kitchen island, refrigerator not flush mount as we ordered at our design session and the refrigerator delivered did not have rear wheels and could not be balanced. The refrigerator model number is different from the model number in our design portfolio, also the refrigerator is not flush mount as ordered, and there is a 4" space from the top of the refrigerator and the bottom of the cabinet. After moving in we encountered a street light directly across the street from our front door shining directly in our front door lighting up our home from front to back. After a visit from Coserv our provider, we told that the light was in an unusual position. My wife and I have searched our neighborhood and could not find another home with the street light positioned in front of their home, we feel as though that light should be removed and placed in a proper location. There is total damage to the tops of the kitchen cabinets, there are holes in the dry wall above the kitchen cabinets, the kitchen ceiling was warped and had to be refloated. The granite in the kitchen is not what we ordered at design, there were defective window panes in the living room, second bathroom and other areas of our home. There was a hole in one of the stones in the front wall. numerous grout and caulking issues, generally poor workmanship.(***) we agree with your statement as we have experienced, and are still experiencing similar problems. We have been in our home for 6 months and have a 1 yr. warranty on our home.
