I was going to a get together for a coworker’ birthday and I parked at a parking lot on fourth ave in Tucson Arizona. It was late and I must’ve been gone for maybe 30 minutes. When I went to get my car it was gone. I thought it was stolen found out it was towed. I called and they told me I would have to pay 300 dollars to get it out. I spoke to the lady at rushing and sons automotive and she said I was the luck of the draw that I happened to be the only and last car they picked up that night. They must’ve been waiting around the corner because I was only gone for a short period of time. I feel scammed out of 300 dollars and the very least I should get a parking ticket for the parking not have my car towed and potentially damaged because I didn’t see a sign saying they would tow your vehicle. Would like to some how get my money back.

Thank you! Here's a professional and firm response you can send to the Better Business Bureau in response to the customer's complaint:

    Response to BBB Complaint
Dear [BBB Representative / Customer's Name],
Thank you for the opportunity to respond to the recent complaint submitted regarding a vehicle tow from our privately managed paid parking lot.
Our company provides clearly marked and monitored private parking for paying customers only. In this case, the vehicle in question was parked without a valid parking ticket displayed, which is a direct violation of the posted terms and conditions. Signage throughout the lot clearly states that parking is for paid users only and that unauthorized vehicles are subject to immediate towing at the owner's expense.
We understand that being towed can be frustrating. However, our enforcement practices are not predatory—they are in place to ensure fairness for our paying customers and to maintain the integrity of the parking system. The complainant did not purchase or display a valid ticket, and as such, the tow was carried out in accordance with posted policies and local regulations.
We regret any inconvenience caused, but we believe the tow was lawful, justified, and consistent with our stated procedures.
If the customer would like to discuss this further or review the signage and records from the date of the incident, we are happy to provide supporting documentation.
    Sincerely,
    Rushing & Sons Automotive

    520-690-9100

Let me know if you'd like to soften or strengthen the tone, or if you want to attach any supporting materials or photos of signage.

I didn’t see any sign at the parking lot saying they would tow for parking there. I’ve parked there before. The price is around 5 dollars why would you tow someone’s car for 5 dollars. It was 1pm and I was gone for 30 min my coworkers can be my witnesses as they were with me. Seems like a scam to make money and I’ve seen multiple reviews that agree with the same thing. 300 dollars down the drain because you guys were camping outside the parking lot at 1pm and you guys also confirmed it was bad luck and I was the last car.

    To Whom It May Concern,

    Good morning,

The parking lot in question is a privately owned, paid parking facility. Clear signage is posted throughout the property indicating the parking requirements and payment instructions. There are three visible kiosks on-site, each marked with the location code and clear instructions for purchasing a permit.

The individual in question parked on the property without securing a valid parking permit. Our security team documented the violation, including photographic evidence of the vehicle and license plate at the time of the infraction.

We operate within all local regulations and make every effort to ensure transparency and fairness. The responsibility to read posted signage and comply with parking terms falls on the driver.

    Sincerely,
    Sheldon Rushing

4/12/2025 I parked in the late evening at this business parking lot at ******************************. I paid at the machine, $8 for 6 hours of parking, and provided my stall/parking spot number as 39. At approximately 10:30 PM, the car was towed regardless of having paid for the time. After seeing that the car was towed, we searched the parking lot for why that might have happened. There is in fact one sign, not lit, several feet above eye level in the parking lot, which indicates receipt must be left on dashboard. Several signs indicate that rushing and sons towing service will tow vehicles at a rate of $300 Towing and Fees. The towing service was no longer available as it was after hours. They did respond to a message promptly in the morning, informing me that the fee would be $565, which includes their time, the towing fee, and the use of towing equipment, plus a $30 charge for one day, since the car was towed before midnight. My paid time should have continued until approximately 2:30 AM. When I pointed out that not only did I pay, but I have a receipt with my stall number, proving that I have paid, the representative of rushing and sons bargained down to a $150 charge plus a six dollar credit card fee. I disagreed with having to pay $150 but I was told that that was the only way I could get my car back, so I paid. After an almost $50 rideshare ride home that night with my daughter, and at their location the next morning to pick up the car, I brought up that there are no easily visible signs in the parking lot indicating that a receipt has to be left on the dash, and indeed many cars in the parking lot had no receipt. The representative said that they tow a lot of cars from there, because people keep stealing the signs.I also mentioned that since its necessary to input the stall number, they should check the machine to see who paid. The representative replied, yeah we dont do that. Id like my $156 back.

Subject: Response to Complaint Regarding Parking Violation at ******************************

    Complaint# 23208600

    To Whom It May Concern,

We are writing in response to the complaint received regarding a parking violation at our lot located at ******************************. We understand the customer's frustration with the parking charge incurred.
However, we want to emphasize that clear signage is prominently displayed within the parking lot, explicitly stating that the parking receipt must be visibly placed on the dashboard of the vehicle. Furthermore, the instructions provided on the parking kiosk at the time of ticket purchase also clearly instruct users to display their receipt on the dashboard.
While the standard towing fee in this situation is $565.00, we made an effort to work with the customer and reduced the charge to $156.00. This adjusted fee accounts for a portion of our operational costs, including the driver's time and other expenses associated with the towing process.
We recognize that parking violations can be upsetting, and we made an effort to mitigate the financial impact by negotiating the fees. We also hope the customer can appreciate that we have a responsibility to enforce the parking regulations within the lot.
Moving forward, we will continue to ensure that the parking lot signage remains clearly visible and that the parking kiosk is in good working order, accurately displaying the rules for parking at this location.

    Sincerely,
    Rushing and Sons Management

Towed 500 ft from private owner caller yard. Called the cops. As of friday 3/1, said she would charge $500 for the impound tow, holding/storage from end of Jan to 3/3, and tow out. They wouldn't do it before bc they didn't like that I was towing it to. BLM. They told me they'd help me fix it but I had to schedule to bring in keys and I am homeless and fleeing DV. They were kind and patient but, Peggy, became hateful and cruel and refused to speak with me or uphold her generous offer. They yelled at me yesterday when I followed up reporting that I would have all of the money today and said if I didn't set an appointment to pay and tow yesterday, I would not be able to to have it even if I paid them as planned. Now they won't release my belongings without ab appointment. They have lied and bullied me into losing everything I had including my home

    To Whom It May Concern:

We have made numerous attempts to try to work with Theresa in getting her RV and belongings back to her. TPD officer Ruano came out and gave Theresa 24 hours to have her RV towed to a location free of charge (case # P2402060087) however Theresa did not stand by these arrangements and was told by Officer Ruano that if she did not come get her RV within that 24 hours we would start charging her storage. After not showing up when told to by TPD we still tried to work with her a couple of times and came to an agreement of 500 to tow the RV and cover the storage but again she did not follow through with the arrangements made by her with us. When Theresa did not comply with the numerous attempts by us and officer Rauno she then called TPD again and at that time officer Howard called and asked that we allow her to come and at least get her belongings from her RV. We agreed to allow her to come retrieve her belongings on the following day 3-12-24 for a 1 hour period. On 3-12-24 Theresa finally showed up with a Uhaul and obtained her belongings from the RV. We were never holding her home hostage it is going to cost us over 1000.00 to dispose of it, we would have liked that Theresa held up to what officer Rauno gave her the option to do but she did not follow through as stated above. Unfortunately after numerous attempts, months passing since we obtained the RV and no follow through we had no other choice but to follow through with the abandoned vehicle laws at this point because she did not render the title as she stated she would at the time of retrieving her personal belongings.

We have been in contact with ***** ******* since June 22,2023 when his vehicle was towed due to being left abandoned for weeks in a shopping center. We made numerous attempts to meet with Mr. ******* and unfortunately they were failed attempts as Mr. ******* would not show. When he called to make his apt he was in fact told that he has to bring a title or registration as proof of ownership, his picture ID and his keys to be able to drive the vehicle away. This was not told to him for him to turn those items over to us but what we require from every vehicle that is impounded in our lot. Due to the failed attempts at showing up for his apt to regain his vehicle we have since gained title of this vehicle by the Abandoned Vehicle Department at Motor Vehicles. We did everything we could to get Mr. ******* his vehicle back but he could not make it to his appts with the required documentation.

***** as the owner of the Rushing & Sons never contacted me as the owner of the vehicle. I found out from ******* (property manager of the lot where my car was towed) on Aug 16,2023 that my car was towed by Rushing & Sons. I called Rushing & Sons right away and spoke to *****. At first she was very helpful but then she said I cannot get the van back because she already gained title of it which is a lie. She said if I want to pick up my belongings I have to surrender the title and the key. I refused to surrender the title and the key. She asked for more than $2,000 for the van and I told her I don’t have any money and the van is not worth $500. She told me if I can get $500 I can get the van back. I borrowed $500 from my friend so I can get the van back. My friend and I called & left messages numerous times but nobody ever called back (I have phone records). ***** wanted to keep my van from the get go and has no intention giving it back to me. Please read feedback from other people. This business is a scam. They are stealing cars from other people. Please help getting my van and my stuff back.

    To Whom if May Concern,

While going over another complaint from Mr. ******* I realized I misspoke in my last response regarding his vehicle. I stated we had been in contact with him since the day we picked up the vehicle however that was not correct. That is the day we actually picked up the vehicle. On July 22nd I received and email from the property management team for the property the vehicle was parked on. They asked that we remove the vehicle as it had been left abandoned. They put a note on the vehicle stating vehicle would be towed on the 19th of July 2023 if the owner did not remove the vehicle. In the mean time the Management team contacted us to remove the vehicle. We went to the property the following day and the vehicle was still there parked near Mod Pizza so we had to remove the vehicle. The Property Management Team signed the ADOT Removal from from Arizona Department of Motor Vehicles. We then had the vehicle and did not hear anything from the owner or any other individuals regarding this vehicle until roughly the end of August. Mr. ******* contacted us stating he was the owner, we scheduled an appt with him and advised him to bring his Title or Proof of Ownership, Driver License and his keys to the vehicle. We advised him that we first need to establish ownership and then we could arrange for him to get his belongings or his vehicle. Mr. ******* missed his scheduled appt to establish proof of ownership. The first week of September we were issued the e-title from the Abandoned Vehicle Department of Arizona, whom also does their part of trying to locate and notify the last registered owner or financial institute that may have interest in said vehicle. Due to them not being able to find the last registered owner or financial institute of the1993 Toyota Previa they then issued the e-title to us.

We did a search on the vin of the vehicle through Motor Vehicles to see if Mr. ******* was in fact the owner of the vehicle however his name does not appear to be connected to the vin. This search was done as of 10/7/23 and there was nothing that returned with his name being connected to the 1993 Toyota Previa. Therefore even if he had come down to try to retrieve the Previa he would not have been able to as he could not prove ownership to the vehicle and this is law. We can not release a vehicle to anyone without establishing ownership to the vehicle. We are always willing and ready to work with everyone however Mr. ******* could not connect with us as he stated he would.

As I stated before that I found out from the property manager on Aug 16 that my van has been towed by Rushing & Sons and I called them on the same day and spoke to *****. At first she was helpful but then she did not respond to any of my phone calls. I called many times and left messages with staff member and voice mail as well. I told her that I have notarized copy and the key for the van. She asked me to surrender the title and the key for the van if I want to get my belongings but I refused to surrender the title and the key. I told her many times that I want the van and my belongings back. I have phone records as well. She was asking for more than $2,000 but then she agreed if I can give her $500 to get the van and my belongings back. I told her that I can get her $500. My friend and I have been calling everyday trying to get the van back and she told my friend on Sep 16 that I cannot get the van and she had thrown away all my belongings. I have witnesses as well. It took them over 3 weeks to reply to my complaint. My lawyer also had sent them a demand letter on Sep 22 asking them to return the van and my belongings and got no response. Rushing and Sons is a scam. They are stealing other people cars as well (please read the review from other people as well). Their practices are predatory and against City of Tucson anti predatory towing ordinance. I want the van and my belongings back.

Wife and Daughter parked in the paid parking downtown on 5th/7th. They paid for 6 hour parking at the kiosk spot 19.

They paid attention to the kiosk, the signs and the receipt indicated that the receipt had to be visible, so they put up the sunshade in the car and placed the receipt on the dash in front of the steering wheel.

They came back 2 hours later and the car was gone. Wife and daughter were now stranded while I drove 30 minutes to get them, in the 100+ az heat.

We called the number on the TOW sign - for almost an hour no one answered then finally a gentleman answered and indicated that because the receipt was not VISABLE they towed the car.

When we arrived we could clearly see the receipt on the dash from the driver side.

We then had to wait for the tow guy to "deal with" me - once he arrived he indicated that I would owe $100. I asked for what, they indicated because they towed my car. I advised they towed it illegally as the receipt was on the dash - to which the gentleman advised that it was "visible to the naked eye" , I responded that it says "VISABLE" as it clearly was if the driver would have taken 2 minutes to look - but instead it was a money grab and if you read reviews about this business I don't seem to be the first person to have this same issue and from the same spot.

I offered to pay $50 and to call it good, they refused and wanted $100 or they would hold my car at $30 a day plus the $300 originally tow fee.

I paid the $100 with a Credit Card - to which the company wrote down my CC# on a form, had me sign the form, then ran my card on the terminal. I advised them that PCI compliance is not being utilized because they have written down my CC#/EXP/CVC. I asked them to black out all but the last four digits, they complied but also took pictures of the form with her phone

They then drove my car off their lot, and I took possession. I inspected the car for damage , there are some minor issues - that will be Insurnace claim

We understand that Travis Hahn is requesting a 100.00 refund for the removal of his vehicle parked on private property. We understand Me. Hahn's debate in this matter and will gladly give him a refund and will make sure to speak to our employee regarding the situation. We do want Mr. Hahn to be careful in the future as to when being asked to leave a ticket on the dash of the vehicle as proof pf purchase to keep from getting your vehicle towed. We do understand that you did place the receipt on the dash but as you stated you had a sun shade up which makes it difficult when looking into the windshield of the vehicle to see said receipt. We will make sure our drivers are looking further but we just want to advise you that other tow companies may not look further either, so in the future to keep this from possibly happening again just make sure the receipt in in the view of the windshield and sunshade.

I parked my car in the lot on 5th and 7th ave downtown on June 20th, 2023, I paid for 6 hours of parking and there were no signs anywhere once paid or during payment at the kiosk to leave my receipt in the front windshield of my car. The kiosk clear states to take the receipt, which is what I did. When I returned to my car it was gone, I called the number on the sign for the towing service and was told my car had be impounded and it will be $480.00 CASH ONLY to get my car out, which is ILLEGAL for a towing company to demand cash only. When I went to rushing and sons towing to retrieve my car they were trying to charge me and ADDITIONAL $150.00 ADMINSTRATIVE FEE. The law clearly states all fees associated with the impound of a vehicle needs to be clearly stated on all signs in the lot or parking service area. Two weeks later I see on the news KVOA this illegal action from this tow company and owner of the lot on 5th and 7th avenue has been happening to others for quite some time. This company is operating illegal procedures in their business practice. Do not trust them. I highly recommend calling the police to assist you in retrieving your car when dealing with these snakes. To Whom It May Concern,

Anissa Quintana Parked her vehicle at *** * **** ****** ** ***** ** ******** This parking lot is a privately owned parking lot where you are required to pay for parking and then leave your parking ticket on the dash of your vehicle. These rules are stated on the kiosk electronically when you are purchasing your ticket. I understand that Anissa is stating she didn't see these rules because the kiosk is poorly lit up at night however if you see the picture attached Anissa's vehicle was towed during the day at 1253pm. We do agree that more signage needs to be throughout the parking lot stating the rules and all of the fee's endured if your vehicle is towed so we have taken the initiative to buy these signs ourselves and post them in this particular parking lot stating what the exact rules are as well as the fees that will be charged if you do not pay for your parking and then place your receipt on the dash of the vehicle.

We understand that there are some new laws that are in place that we were not aware of and we take full responsibility for that. These being accepting all forms of payment and only charging storage for every 24 hours the vehicle was there. With that being said we have made sure to educate all of our employees on the changes that we are making. From here on out we will make sure to check the laws periodically so we do not let this happen again.

Please know that we do our very best to always support and help not only our fellow Tucsonans but the Businesses of Tucson. Parking downtown is very limited therefor it is crucial to follow all rules and pay attention to all signage whether that be electronically or physically.

We do understand your frustration in this matter but please know that we too were only doing our job. We have suggested to the property management of this particular parking lot that the receipt should also state "please place this ticket on your dash". So in the near future we will post physical signs and we are hoping the property management will also make the changes to the receipts.

    Thank you,

    Peggy Rushing

On june 23rd I parked my car to attend a local market that was directly across the street. The parking lot is privately owned and I paid for my parking spot. There is literally nothing posted on any signage saying the ticket needs to be displayed on your dash board to avoid towing . I was shown that it appears briefly on the screen after purchasing time, but the screens are not well lit at night and at the time I was purchasing my ticket the machine was malfunctioning. Not even on the physical ticket is doesn’t state anything . and there is no physical signage indicating the ticket needs to be left. Cost me $435 to get my car back the day after . Tow company said I needed to dispute it with the parking lot company, but did not provide any contact information or name. I am looking into if there is any legal route I can pursue. I showed proof that I paid for my ticket but I still had to pay the towing fee even though I didn’t park illegally.

Anissa Romero parked in a privately owned parking lot at *** * *** *** ****** ** ***** on 6/23/23. This parking lot is paid parking only and you do have to display your ticket on your dash to park there without being towed. This is displayed on the kiosk as you are purchasing your ticket. We understand that there needs to be more signage posted and made more visible to the public. We have taken initiative and purchased new signs that state where to place your ticket and have also ordered new signs that will have the correct fees on them. We have also reached out to the management team of the parking lot and have relayed the messages given by the public of making sure it also states to leave ticket on dash on the dash itself.

We appreciate the feedback and apologize for any inconvenience, we are working hard on making the changes we need to.

I would like a full refund. The kiosk didn’t display the ticket message to display on dashboard otherwise I would’ve done so. Also I did pay for my parking spot and kept my ticket as proof. I followed only what was visible to me. Not my fault you wrongfully towed my car. I think close to $500 dollars is ridiculous and such a scam. I didn’t break any of the rules. You can talk with the property owner and work this out. Also, the signage and proper pricing for the parking should’ve been there way before this became a huge issue and you knew it would be bad business on both ends !
No remorse or care to do the right thing by your consumer. The cash payment and the amount really rendered my financial situation and to hold my own property for ransom basically. I deserve my money back and also for the parking I paid for since it was falsely advertised.

Last night, 6/24/23, my vehicle was towed from the car lot on 7th Ave and 5th St. I had purchased 6 hours of parking time at 8:22pm. When I returned around 12:15am, my vehicle was taken.

The posted phone number was for a Rushing & Sons Automotive on N. 1st Ave. I was advised that the ticket should have been placed in my windshield. This instruction was not posted on any of the signage around the lot, nor is it on the signage of the pay kiosks on site. The only document I received after purchase was a receipt, which also did not indicate that the receipt should be left behind. It was explained to me that the instructions show on the screen, but the screen is poorly lit at night.

When I spoke to the operator, I was informed it would be $300 to get my vehicle out, but when I arrived this morning, the total was over $500. This included a $150 processing fee and two days of storage on the lot. The processing fee was not made clear on the posted signage and the vehicle was on their lot for less than 24 hours. In the end, I was charged $435. They advised they were “doing me a favor” by waiving half the administrative fee and “being open on a Sunday” to pick up my car. I asked who I could speak to in order to challenge the charge. They advised I would need to speak to the owner of the lot, but would not provide a name or contact info. The only posted contact at the lot itself is for Rushing & Sons Automotive.

I have taken pictures of my receipt and of the signs that are posted around the lot. It is my intention to return to the lot soon to document the signage on the kiosk. I intend to pursue this in small claims court.

I am unsure if I have a legal case to bring against the company, but I am currently looking into getting a Civil lawyer to explore options. Regardless, I do not believe the operation was conducted ethically and they should be held accountable.

    To Whom It May Concern,

On June 24th 2023 we towed Mr. Thomas' vehicle from the Privately owned parking lot at *** **** *** *** ****** ** ****** Mr. Thomas parked in the parking lot and did not display his parking ticket on the dash of his vehicle as stated digitally while purchasing the parking ticket. (Picture of Kiosk from the time his vehicle was towed is attached) When Mr. Thomas called inquiring about his vehicle he was advised that he was towed due to not displaying his parking ticket. Mr. Thomas became very loud and combative with the employee who answered the phone. He was still given an apt to come and pick up his vehicle the following day. When Mr. Thomas arrived you could instantly see his frustration and anger in his face which is understandable as he was in circumstance that would irritate anyone. When he approached our employee she advised him of his fee at which time he instantly became aggressive saying he was told it would only be 300.00. As we were trying to work with Mr. Thomas he became more and more combative and verbally abusive and started slamming his hands on the counter. At that time we could no longer talk about what we may be able to do for him as he was out of hand. The employee had to have him escorted out of the building. After helping a few other customers he came back in and paid for his vehicle and quietly left without saying anything else.

We would have been happy to listen to Mr. Thomas and possibly reduce his fees more than he was originally told but due to his aggressive behavior for the safety of our employees we had to have him leave as quickly as possible. We understand that this is a very frustrating situation we do not disagree with that at all so we understand that people are going to come in unhappy but to become physical by pounding on our desks that puts our employees at risk so we had no other choice but to stop the communication with him and have him pay what was asked and leave.

    Thank you,

There are no physical signs in the lot indicating the ticket should be displayed in the window of the vehicle. I operated based on the instructions provided on the outside of the kiosk, which ends at "take ticket". I admit to being quite angry, but this situation was extremely frustrating. Their answered still involved me making a payment when there should have been none. I feel the situation is extortion. In fact, I brought this to the attention of a local news station, who agreed and ran a report on the subject. Our local city council is working on making these practices illegal.

Bottom line: my car was towed unnecessarily. I provided proof of this and was still charged.

This company engages in predatory practices and flagrantly violates Arizona law.

Rushing and Son's insistence on cash payments for towing is a clear violation of Arizona law (HB 2306). They impose exorbitant, arbitrary fees with forced cash payments. Their unethical conduct raises serious concerns about their integrity.

On the evening of Saturday, June 23, I parked and paid for parking at a lot located at 290 E 7th St, Tucson. Upon returning to my car before my parking expired, I found that my car had been towed by Rushing and Sons Automotive. The instructions on the pay machine ended with step number 4 "take receipt" - with no indication or signage in the lot that the parking receipt needed to be placed on my dashboard.

When I called the tow company the next morning as soon as it opened, I was informed it would be a total of $435 to retrieve my vehicle, which could only be paid in cash. The charges were: $300 towing fee, $75 administration fee, and $30 fee per "day". Even though my car was in the tow lot for less than 12 hours, I was charged $60 for two days. They forced a cash payment, which is a clear violation of Arizona State Law.

This business is predatory from every angle.

    To Whom It May Concern,

On June 23, 2023 Savannah Reising has stated that we towed her vehicle from the lot at *** **** *** *** ****** ** *****. While we do tow from a parking lot at *** **** *** ** we do not tow from the address of *** **** *** **. additionally we were unable to find any towed vehicles under the name Savannah Reising. Therefore we do not know if we actually towed this customers vehicle or not. Although we would like to mention to you that we do realize now that we are to be taking cash and credit or debit cards. We have made the necessary changes to be able to take all forms of payment. This is not the only change we have made recently as we are making all changes necessary to abide by the laws set in place for Towing Companies. We will continue to check the ADOT website to make sure that no changes have been made and if changes have been we will make the changes again as well.

We strive everyday to do our best for the community and the local business owners. We want to do our very best to help the people of Tucson and this includes the business owners in Tucson. The particular parking lot that we tow from a* *** **** *** ** is privately owned and requires a permit to park in that parking lot. Not only does it require a permit but you are to display the ticket on the dash of your vehicle. These instructions are found digitally when you are purchasing the ticket. I see that a picture of the kiosk was shown to provide some proof that the kiosk does not tell you to leave the ticket however it does state to do so digitally as just explained.

We will continue to do our very best everyday and will make sure we are always following the towing laws.

We appreciate your feedback and have already made the necessary changes as stated above.

    Thank you,

    Peggy Rushing
