    I was told on 2/19 by Titan that the work had been completed, and Titan wanted payment and me to sign-off on the COS agreeing that the services had been completed and that I would pay the estimated cost (provided 12/15 after the demolition was completed). Between 2/22 and 3/14 I reviewed completion photos and identified work that was not done (line items 8, 9, 21, 22 in the estimate). On 3/14 I notified Titan of the items not completed and asked for an adjustment to the bill/estimate to remove those items.

    On 3/15 I received an adjusted bill/estimate with those items removed but with numerous additions and increases to existing line items to mostly make up for the requested adjustment along with other numerous changes.

    None of the changes were previously present to me or approved by me.

    On, 2-19-24 we informed the complainant that the work for the claim # ********** was completed. On 2-20- 24 Titan Restoration sent completion photos and we were informed that a light was not working in the laundry room and that it was contributed to the water damage from the claim. We informed Mr. ****** that during an insurance claim supplemental estimates are common and that this would be needed to return the home to its pre-loss condition. On, 2-23-24 we reopened existing estimate and determined that other claim related items were needed to repair the home to its pre-loss condition, we submitted the supplement for the light fixture and the additional items at this time. On, 3-14- 24 we received a communication from Mr. ****** that some billing items were in question. We immediately reconciled the billing for any items not completed and provided proof of completion for the work that was completed. The work completed was approved by Country Finacial and Titan has revised the billing after a reconciliation of accounts to include only that work. We billed for work related to claim and from which the insured was paid for and feel if the work is completed then the bill should be paid.

Owner has been informed, and agrees, that: (a) Owner is personally responsible for any and all deductible(s), depreciation, work or Services and/or charges not paid by insurance; (b) Contractor’s Invoices not paid by insurance are due from Owner upon receipt; (c) Owner hereby authorizes and directs the responsible insurance company to make payment directly to Contractor for the Services ; and (d) if Owner’s insurance company pays proceeds for the Services directly to Owner as the insured, Owner will immediately forward those insurance proceeds in their entirety to Contractor. Interest at the highest rate allowed under law will be charged onany unpaid balance after thirty (30) days of the date of invoice. Owner agrees to pay all collection costs, collection agency commissions, attorneys’ fees, expert fees, courtcosts and arbitration costs incurred by Contractor to collect past due balances. This attorneys’ fees provision is expressly limited to actions on this Agreement and shallnot be interpreted or construed to apply to any other claims.

    On 3/14 I notified Titan Restoration of the items not completed and asked for an adjustment to the estimate to remove charges for those items.  On 3/15 I received an adjusted estimate which removed the charges for items that had not been completed, but with numerous additions and increases to existing line items to mostly make up for the requested adjustment.  None of the additions and increases were previously authorized or communicated to me or the insurance company and are largely unverifiable since that nearly all of the work except for replacement of the upstairs bathroom floor and a light fixture in the laundry room had been completed by early January.  I have paid Titan Restoration $18,975.28 which far exceeds what the insurance company has provided me for repairs.  So I do not that part of their response.  I am being overcharged for their services and I am simply asking for an adjustment of $692.80 to the final bill.
