On June 17th I met up with DJ **** ******* to discuss about a contract for my daughter's Quincenera scheduled for 3/08/2025. I informed **** I would contact him when I had the deposit available. On 6/23/2024 I messaged **** ******* to inform him I had sent the deposit via *****. I contacted **** ******* on the third week of August via phone and told him I had found a better package with a different DJ and asked him if he was going to return the deposit, he replied by telling me that he was going to return full deposit guaranteed. **** ******* sent $50 via zelle on August 26th 2024 and another $50 on September 3rd 2024. When I asked about the rest of the money **** ******* kept giving me the run around as to when he would give me the money, he kept saying he had no money at the time and that business was slow and that he was going to give me the rest of the money the following week but that date never came. I messaged **** ******* and told him that I was hoping he would pay me as I felt he was giving me the run around, that is when he replied to me and said that he was not going to refund rest of the money since I was the one who cancelled on him. There was no contract signed I am asking for **** ******* to refund the rest of the deposit, $100.00

Client received contract via email with plenty of time and decided not to sign it but made deposit of $200 to reserve the date. As stated in my contract deposit is non-refundable and not transferable to another location or for times other than those stated here in the contract. The deposit is paid for the sole purpose of reserving the agreed times, date and location only. When client decided to cancel her contract with me, she forfeit her deposit as per my contract rules. Client did not abide by the rules of the contract and my contract states cancellation by purchaser for any reason does not warrant return of any deposit paid.

DJ should have had the contract signed before accepting my deposit. The contract should not be valid without a signature. Also, DJ via text guaranteed he would return refund 100% as stated in the message sent in attachment. There is proof he would refund. I am asking for the ****** he owes me to be refunded.

    Business Response

The deposit was to of $200 was to guarantee the reservation of the date so no other client can book the DJ for that date. The deposit is non refundable therefore when the client cancels they forfeit the deposit.

    Customer Answer

In order for a contract to be validated it has to be signed by both parties. Contract was never signed by neither parties. Secondly in your text you agreed to return the $200 you only gave me $100. I asked you multiple times for the refund and you agreed in our text messages (attached) you kept telling me business was slow and prolonging the rest of the refund. Please respect your word as I did with mine.
