    We purchased some playground equipment from Miracle Play Systems and paid a 50% deposit. There are two issues:1. Shortly after we received the item, and before we received our final invoice, the company filed a pre-lien with the *******************. Our landlord was, understandably, not happy. When questioned about it, MPS indicated that this is "standard practice" to file a pre lien against all private customers spending over $10,000. Their actions created unnecessary angst for our landlord and for us.2. The item was delivered and and installed at an angle (due to issue with forklift setting item down onto ***** bank instead of directly into hole that had been leveled out, which caused sand to fill into our hole and then when the ***** pound item was set down it was not level. Given it's a water table, the water does not go down half of the table due to the mis-leveled install. We notified rep during install and they had no solution or resolution.

    ********** requires a preliminary notice to be sent in order to preserve our right to file a mechanics lien. Owner, General Contractor, and Lenders are all provided the notice and as payments are recorded, Lien Waivers are created releasing liability. We do this on all orders over $10,000 that are placed by private companies. The notice was sent to the owner of the property where ********************** is located. This was a notice, no lien was actually filed against the property and no lien will be filed against the property in regards to this order.  

    The order placed by *************** was for equipment only. There were no installation or construction services contracted within the scope of the order and this is the only order on file for **********************. We are not at fault for the improper installation or any damage that occurred during the installation process as this was not completed by us or any sub-contractors hired by Miracle Playsystems. **************** should seek remedy with the company he hired to install these items. .

    I have attached a copy of the signed quote for the order that **************** signed in August along with the final invoice. Below are screen shots of showing the time stamps that **************** paid the final invoice within 2 minutes of receiving it. I am not sure why he would have paid the final invoice for this order if there were any outstanding issues that were within our control. 

    I ask that you dismiss this complaint as the bulk of the issue was not with Miracle Playsystems, but with another company unknown to Miracle Playsystems. As far as the landlord receiving a notice in the mail, it is unfortunate that this caused angst but it was easily explained and remedied.
