Builder will not build shed according to the contract so I canceled last week during the order prep before any production process took place. I have not received the cancellation paperwork or my deposit of $1,959.71. ********************** ordered a building from ** on 2/24/24. Unfortunately, the requested design was a design that had a high likelihood of leaking. Our design team worked with ********************** for the better part of two weeks trying to find a solution that would not leak. When we were unable to solve this issue in a manner agreeable to **********************, she cancelled her building. Her deposit was returned to her credit card on 3/28/24.Customer Answer

In March of 2023 I was told they would handle everything from permitting to delivery in a 6 month time line. After 3 months my paperwork wasn't even submitted for permits. Every month I would request an update only to be put off or given very vague answers. In the 10 months I was waiting and hoping I had 4 different people over seeing my account: ********, ******, ****** and ******. When I finally had enough of being strung along because I had no permit and construction wasn't even scheduled to start I asked my options for canceling, all communication was abandoned from these 4 people. My emails were never answered my calls weren't returned and on the chance someone actually answered the phone it was in an office in another town. Not sure why no one here can't do their job but save yourself the headache and take your money else where! Once I asked to cancel I received a cancellation form to sign via email from a corporate email that does not accept replies to the email. Despite them refusing to do the job I hired them for they kept my $1000 deposit and ceased all contact. In my contract it states you can cancel for full refund so long as it is before construction starts. I signed the document Jan **** after waiting 10 months to for a job never completed. I believe I should receive my deposit back immediately.Business Response

When it comes to permitting, we must work at the pace and discretion of the permitting office and the reviewer. Unfortunately, in this case, the Kern County reviewer requested the shed be put on a concrete slab or that we provide a Geotech Report, **************** did not want to pour a slab and contacted a Geotech Company,who apparently quoted to **************** an out-dated **************** stating she did not need a Geotech Report. Nevertheless, the reviewer would not issue a permit without a Geotech Report. This put ** in a situation where *************** would not provide the information Kern County required and Kern County would not issue a permit. Thus, we could no longer move forward with this permit. **************** cancelled the order, and we did not charge her for that which we spent in excess of the initial $1,000 we spent trying to obtain this permit.Customer Answer

I am rejecting this response because:
The pace this company works at is unreasonable and the fact they are still refusing to take responsibility for a poor job by blaming it on the permitting office. Each time the permit office communicated with Ulrich it would take Ulrich 4-6 weeks to respond back which drug out the process. I was never informed my ************ were to poor a slab in fact Ulrich assured me I would not need to do that and there would be no problem acquiring a permit without one. If this company regularly acquires permits for sheds in kern county wouldn't they know what their customers should expect? In the process of getting quotes for the soil report Ulrich had a hard time telling me what type of soil report I needed to request. I was never told the quote I received was with outdated kern county code. After this point of communication it was next to impossible to get Ulrich to respond to my emails or phone calls. Before cancelling my order I requested on three different occasions for an itemized invoice for the fees my project had incurred to verify if I would get my deposit back. This information was NEVER provided for me. Since Ulrich had continually mislead me thought the 10 months I waited on my project I have a hard time taking their word. I need to see documented proof.

We are sorry **************** felt misled. Our sales people are trained that they cannot promise anything with regard to permitting. Unfortunately, permitting is not an exact science as the reviewers are often given a great deal of discretion when it comes to their implementation of the permitting standard. It is possible that our sales person gave **************** a good faith opinion based on experience in Kern County of what has historically been permitted, but to offer any "assurances" with regards to a permit is inconsistent with our policy or training of our sales people.
It is also possible **************** sense of being misled stem, in part, from the eronious report she ostensibly recieved from a third party. I have uploaded this dcoument and it clearly states they are refering to the outdated 2019 California Building Code. However, on Jan 1, 2022 Kern County's permitting standard changed to the 2022 California Building Code. With regard to the request for proof, I have uploaded the document from Kern County clear stating their request for a Soils Report (aka a Geotechnical Analysis) in bullet #3 of the Helical Piles Requirements section and their reference to the 2022 California Building Code and the letter *************** provided us from a third party referencing the 2019 code (I have highlighted these in green for convenince).
After review, we are unaware of any instances where we took 4 to 6 weeks to respond back to Kern County. However, there are periods where it would take two to three weeks to respond as it takes time for our engineers to make plan corrections and respond to the reviewers comments.

Very unreliable company! I have been ran around for the last year trying to get my gutters repaired. I have been told several times they’d be coming out to be repaired and no one shows up. Yesterday was one of those days. I can’t seem to get a hold of anyone and when I do there is always an excuse! They don’t even have the documents/plans from my barn that was built 3 years ago or of the repairs to the gutters they claim to be coming out to repair. I have had to repeat myself to the last 4 people I’ve had conversations with. The gutters were not up to snow standards and ended up breaking and flooding my stalls. I have now spent a good amount of money having my stalls leveled just to have them start flooding again because they still have not came out!Business Response

Purchased a shed to be built onsite in Oct 22, still have no shed today. I have been told the city is the reason things are not moving and I only know that because I call them to get updates. ****** has not reached out to me 1time to keep me updated about the process. I'm tried of the lies and have been ignored and lie to again when I explained that I want the loan voided, permit cancelled and refund of my deposit.Business Response

Good DayI spoke to ****** ****** the head of customer service and was informed the project was concelled 4/4/23. A refund to the customer is in process. Clearly there was a failure to set realistice expectations by the ****** sales department if a building sold in Oct 22 located in the city of Lancaster, Ca with permitting was expected to be completed by the end of March 23. Permitting of a structure in LA County or Lancaster city will always be greater than 6 months. ****** has usured me that this has been addressed and our sales team clearly understands expectations to communicate to our customers. I spoke with the customer by phone and I apoligize I didn't keep you informed. The Refund will be processed by the same form as it was paid which in this case I understand was a Credit Card. The contract is cancelled and permit cancellation is in process. When the cancellation is complete the refund will be processed.
