    I purchased a swim spa on September 29, 2023 from Swim Spas Plus in *****************. It was shipped to my house in ****** ** ****** in August of 2024. I incurred additional expenses to have the swim spa delivered to my house from the highway as the transport company ************* contracted refused to drive down my road. My contract with Swim Spas Plus was for delivery to my door. From the time of delivery this unit is under a 2 year warranty. I had to get a pump replaced upon arrival as it was not working after being connected. The cost for a new pump and the additional transport amounted to $2171.62 Canadian. This company has been notified and they have confirmed via email that they will reimburse me being that we are still under warranty but payment has no been issued. I have emails starting from September 2024 up until April 2025 requesting payment, I have not received any responses on the last few emails sent. The corporate side of this company is Tulipani Enterprises dba Swim Spas Plus.     I spoke with ***** at Swim Spas Plus *************) early in 2025 during January and February before deciding to order a swim spa. After a few conversations about the product, he provided an invoice, explaining that half of the final cost would be due at the time of order via mailed check, and the balance would be due at delivery. He provided an address to mail the check, which we did in the amount of $6,049.00 After the check cleared, I talked with ***** in March 2025 about an *** of when we could expect delivery, (to plan for being at home and arranging the necessary crane and crew), which he stated as being within 8-10 weeks of delivery. To get a better estimate of deliver, he advised me to call the owner of Swim Spas Plus. When I called the owner, ****** ********************** of Tulipani Enterprises, to whom the check was made payable, Mr. ********************** was very obviously somewhat incoherent and had no clear update about shipping and advised me to request a refund. I did request a refund via email on April 5th ccing both ***** and ******, with a request to update about the refund within 48 hours. No response was provided. I then emailed ***** about the refund, to which he responded in an email, "i believe it will be about 30 days I will keep you posted. *****.When I did not hear back from the owner ****** from my original request, I became more concerned. After an off the books conversation with *****, he implied that the company would likely go into Bankruptcy and that he did not have clear evidence that I would receive a refund.

    Invoice dated 09-05-2024 for a sonoma spa, priced at $12999.00 plus $500 for curb delivery total of $13,499.00. Deposit of 50% down was paid to Tulipani Enterprises with check number #**** for $6,749.50. Spa was to be delivered in approximately 6 weeks. We have called many times are given many excuses, the spa is not on the dock, the spa coming, the owner is in the hospital, you will get your spa, but as far as todays date March 06, 2025 we have given up hope and want a refund of our money as we have never received our spa.

    I was searching for a swim spa and came across Swim Spa Plus, I contacted them ( ***** Sonoma ) asked questions, so I ordered a swim spa back in April 30, 2024 and I sent them a check of $6526.75 , and it was cashed on 5-6-24 , I kept in contact with *****, I made calls in July, August and in September he told me that I was on the ship and it would take about 2 weeks and I said ok thats fine , well two weeks had passed by, I I contacted ***** again in November and I asked him if I was going to get the swim spa before the year ended (2024), and he said you will definitely get it before the year ends !! I called back December 30 , and then he told me it would arrive in two weeks and today is 1-23-25. , so I called corporate and talked to ****** Tulipani ************ and he gave me excuses , and told me to call ***** back and give him the invoice number , so I called ***** and no one answered the phone so I left a message and ****** told me that it would take more than a month for my refund, and I told him I did my part when ***** said I need a deposit within 7 days when I ordered the spa, ( 9 months ago) and I just said I did my part and I hope that you due your part ,

    I am rejecting this response because: I had talked to the owner of Swim Spa Plus ( ****** Tulipani ) on January 24 , and was told my refund would take a month or two , had another phone call from his daughter cell ( **** Tulipani ) on February 27th and she said my father ( ****** Tulipani ) would like to talk to you, so ****** asked me if I wanted my spa or a refund which I told him that in January 24, I want my refund and he said send me the invoice, which I did, and so far no refund ! Ill wait until the 31st of March and if nothing I will continue to go to the ************************* or whatever I need to get my refund !!

    I was scammed since December 2023. It is now May 2024. I paid deposit in check of $10,200 and told there would be a 6 week delay by ***. No one from Swim Spa Plus kept in touch. They bring on ******* Tulipani and ****** Tulipani. I give them another $5,200 due to the swim spa delay in shipment. These were on separate credit cards. Every month, they promise me it will be shipped. Every month, I have to contact them, and they give me an excuse as to why it is not shipped. They always have an excuse. I trusted them. I tried to be patient with them. All three of them: ***, **** and ******, seemed like decent human beings. They are all older, very old, so I thought maybe they move at a slower pace because of their age. I gave them empathy and understanding.I am admittedly too gullible for my own good. I am working on it. I feel bad for people like me. There are people like those working in Swim Spa Plus that play games with naive and gullible people.I paid in full once I was told the swim spa was out for shipment. They are quick to send me invoices, collect and deposit my money no matter how sick or unavailable they are, but when it comes to updating me or providing me with the requested tracking number for the shipment they claim is on the way, they do not provide that or update me. I always have to contact them first.I am very disappointed by their lack of integrity. If delays were over 1 year out, at least be honest! I have lost a lot of money on my airbnb property and the opportunity cost of spending $15,000+ for a swim spa I haven't received is taking its toll. I had to take out a loan. The cost of crane, cost of pavement, I could have used the 15k I gave their company on other fixes and updates to the house. I had to take out a loan with no revenue coming in thanks to their lies and deception about when the swim spa would arrive. I don't think they actually sell swim spas. I have no proof, no tracking number, no information from *****; nothing.

    I am rejecting this response because:

    I repeatedly requested credible PROOF that my refund has been sent or initiated by giving me a bank statement or tracking number. He, ****** Tulipani, only gives me yet another one of his many promises that he has done something. 

    Swim Spa Plus is always stating something will occur within 30 days!!! Every month I get told to wait another month.

    Where is his evidentiary proof there is a delay in *****?

    Where is his proof that there was a shipment of a swim spa for me?

    Where is the tracking number proof he has sent a check to me?

    NO PROOF! 

    NO EVIDENCE!

    All I have ever got from Swim Spa Plus, this scam of a company, is one 30 day promise after another 30 day promise and now it is about to be 6 months.

    6 months with no $15,400, 6 months with no swim spa, 6 months of loss of revenue, 6 months of stress. 

    This company, Swim Spa Plus, has provided me with absolutely no proof. 

    ****** Tulipani, ******* Tulipani, and ***************** have been making promises with me for the past 6 months without an ounce of proof or evidence that my Swim Spa exists. 

    I spent over $5,000 in cash on the concrete pavement and over $2,500 for the crane services with permit to get it delivered to my backyard professionally. 

    I am in a financial bind for trusting this company. All I ask for now is PROOF: Tracking number or Bank Statement proof that $15,400 has been sent to me.

    Placed an order with Swim Spa Plus on May 31, 2022 for delivery of a Swim Spa in November 2022. After many emails, it appears the order was never placed and ****** Tulipani was simply using our money as an interest free loan.On January 12, ******************************************************************* full within 14 days. ****** responded with a phone call on January 17, 2023 and agreed. It has been 14 days since the demand letter and my money has not been refunded and I have not received any product from this company. I want my $10,900 refunded immediately.

    We ordered a ****' Sonoma swim spa in February, 2022. We were uncomfortable paying in full by check, so the owner (******** Tulipani) agreed to a 10% down payment ($1,550). He said spa would be delivered July or August. On March 1, ****** sent confirmation of our February check, order #***. He never said that only 10% down could delay our delivery date.In July we asked ****** about our spa's delivery date. He said the spa needed to ship from *****, supply chain issues were delaying things - check back in a month. We again contacted ****** in August, and were told the spa should arrive soon - check back in 30 days. In September, we got the same story: Supply chain problems, but our spa should be in next month. Again in October, the same message: The spa should be here next month. Finally in November, the company's sales manager ***** said he'd look into our order, and called back later to say that our spa was in their next shipping container, but being held up by ******* authorities for some reason; he expected it to be released for shipping in "a week or two." About the first of December, ***** called back to say everything was a go, and our spa would ship out from ***** on December 8, and take about 2 weeks to reach them.By January we hadn't heard anything, so I called ***** and left a message asking about the spa's delivery status. He later called back and sheepishly said ***** was on a "vacation" and he wouldn't know anything else for 30 days. I asked "what about our 12/8 shipping date?" He apologized and said he couldn't explain; "it's not your fault" he said, "it's all our fault." We said enough with the delays and asked for our money back. Later, we heard from ******, who basically said that others paid more than we did, so they got delivery priority! He agreed to return our money. We think that's probably what had happened all those previous months as well: our order kept getting pushed to the back of the line.

    We did not consider the request for $8,000 to be punitive damages, as it was merely an alternative way for the company to meet their obligation, should they be unable to deliver what they originally agreed to.  But we understand why you would classify that request as punitive damages.

    ANYWAY - we have decided against pursuing any remedy at all from Swim Spas Plus.  Instead, we'd just like our complaint to be simply that: A complaint against the company and its practices, for prospective customers to consider before doing business with them.

    I am rejecting this response because:

    The business states known facts about the delays caused by war in ******* and other issues, but does not deny or even address my main complaint:

    The owner agreed to accept a lesser down payment than initially requested, without at any time advising me that doing so might disadvantage our purchase in any way.

    The owner continually, month after month, pushed back the date of my spa's delivery, apparently letting others take priority over my position because they paid a higher deposit.  The owner and his sales manager at no time told me that my lower down payment was putting me at a disadvantage in this or any other way, and never once requested a higher deposit.

    Worst of all, the owner gave the spa promised to me by his sales manager "on the container ship leaving ***** on December 8" to another customer who paid a higher deposit.  Neither the owner nor the sales manager told me they were doing this; nor did they give me the chance to pay a higher deposit in order to keep that spa and its promised delivery date.  Instead, the sales manager admitted that the company was at fault for me not getting that promised spa, and the owner merely explained that others who had paid a larger deposit were entitled to get their spa first, essentially taunting me for not paying a higher deposit.

    These are not fair, proper business practices and could constitute fraud on the business's part.  I have no desire to pursue this further, other than to let others know, by my complaint, what kind of cheesy practices they may face by doing business with this company.
