    *************************** was assigned to me by carpet outlet plus to install my flooring. The majority of floor was installed by 2 teenage boys whom ****** identified as his ************* commenting how they attended high school across street from my home. During install ****** was either on phone or off looking at other jobs. Fast forward a few months my floor began to lift, buckle,& warp. After months of argument between ******, carpet outlet plus, & myself an inspector was sent to look at the floor. Carpet outlet plus was not fully satisfied with that report. So a second neutral inspector was sent. This inspection stated the cause of my floor issue was "improper installation". I have emailed both ****** and carpet outlet plus stating. "I wanted a refund on the cost of the *********************************** for ONLY the kitchen, dining, & bar area that they installed. I wished to have it redone by a different company." ****, the owner of carpet outlet plus has reached back out a couple times stating ****** will do nothing to rectify the issue. ( ****** is trying to push my issue off on a small water leak in an opposite end of my home though the inspector report clearly states improper installation as the cause) ****** himself has not reached out to me & has totally ignored my email & this issue. I have given this a little over one month since I emailed with this request. With no response from ******, this tells me he has no intention of making this right. I don't think this is acceptable, nor do I believe it is acceptable for him to use 2 minor children children to do the install.And especially not even supervising it to ensure it was done, right. Obviously per the inspector report it was done incorrectly and the entire floor has failed.

    I have provided two different pictures of the sales agreement, one showing the total amounts, and the other also shows that he received payment by his signature. Thank you, ************************;

    Business Response

    To whom it may concern, I'd like to start with I was never contacted from ********************** about her complaint. I have no affiliation with carpet outlet plus. I have all text messages from ********************** stating that she had a flood in her home and that I was not responsible. As you can see in photos she provided that those are damages from flooding her home. I will attach the message from her above. I had no acknowledgement of this issue up until a few weeks ago when I received a letter from the contractor state license board. As you can see when carpet outlet would not satisfy her request I was then the target for her damaged floor. If needed I will contact ******* for all phone and text message records to assure you that that last conversation was that everything was fine she even put a happy face. I also would like to state that this install was done almost two years ago. She had a flood in her home after install. Also she is stating that I had teenage boys working for me. That is incorrect the two men were my son's who are 23 and 25. If needed I will send documentation. I'm really shocked about this complaint like I said she never contacted me about this concern. It's been almost two years since install and I have a legal obligation for all my installation that the warranty is one year. Also if you flood your home the warranty is voided. Why was I not contacted by inspector to meet at location if I was the one being blamed for her damaged floor. Someone should have contacted me about any concerns. I've been in business for 25 years and never had a issue that wasn't resolved. I would be doing my business wrong if I just don't respond. Thank you I again will provide all documents stating that she had flooded her home and that I did not need to come out for a repair. That was the last conversation with **********************. So as you can see I'm not sure what is going on and why my business name is being slandered by **********************. I have done nothing wrong on my end. Please feel free to contact me. I also have a legal right to defend my business and name from person who falsely accusing me of wrong doing. Best regards ************************* owner of DANIELS FLOOR COVERING

     I am rejecting this response because:

    To whom it may concern,
     1) ****************** assigned ****** to do my floor install on April 8th & 9th 2021. So, YES, he did work for them.  (see note on reciept)
    2) I had to call ****** back out a couple of times because things were lifting & separating. He Literally left his truck running at the curb & came in to put more glue, more tape.
    3) Later I noticed front bathroom floor making a "popping noise" & lifting. (Since he put no caulk or silicone along tub, water probably leaked under). I texted him to look at, & possibly fix it. He did not provide a date to come out.  Soon after, I developed a pinhole leak in the front bathroom. It wet linen closet, part of the hallway, & front corner of laundry floor (where it adjoins to linen closet). So yes, I sent ****** text telling him to never mind coming out, I had had a leak. My homeowner insurance paid to replace the hall, linen, laundry flooring. I just went ahead & replaced bathroom also. That solved the problem I had texted him about. (I am sending floor area diagram pictures from insurance also)
    4) I am going to draw a diagram of my house showing the areas of poor installation in question here, VS the area where I had the water leak. These are separate incidents in OPPOSITE ends of the house. The (leak) front bathroom is in front of house, & the kitchen/ dining area (which is the floor in this complaint), is at the rear of the house!
    5) YES, ****** was aware of issue. I went to C.O.P. about the lifting & separating in the kitchen, dining, bar. They called ****** while I was in the store. He told them he had "washed his hands of me" So him saying he did not know is another lie. For a couple months, we/they went back-and-forth over whose responsibility it was - ******'s or the flooring itself. Then 1 day COP Said ****** no longer worked for them.
     6) So, their 1st step was **** to contact the flooring manufacturer. The flooring manufacturer, Eternity, sent out an inspector to inspect the floor. They said the flooring itself was not defective.  ****, (C.O.P.) said he wanted a 2nd opinion from another unbiased inspector. The 2nd inspection was done revealing poor installation as the cause.
    7) After months of this, I went to the owner of carpet outlet plus for an answer. He told me I was not the only one with complaints against ******, he no longer worked for him, & the best thing for me to do was turn him in to the contractor's board & the Better Business Bureau. But I wanted to give one more chance to settle before filing complaints, I sat down & emailed both ****** and carpet outlet plus with this issue. I told them I had decided I simply wanted a refund for the floor material in question, also the installation cost. I was taking my business elsewhere.
    8) ****** knows full well, he used those kids. The boys told me they were students at the high school across the street from my home. The fact that he is lying about the boy's ages tells me he knew it was against the rules.  Or else why would he bother to hide it? I'm sure he CAN get his older boys to say it was them. However, it's not true! I also have witnesses - my daughter had come to see the job, & my adult granddaughter lives in my home & was here.  (I'm willing to put my hand on a bible & swear to it. I will even take a lie detector test if need be.)
    9)The minors are really not even the issue here.  The issue is the floor ****** installed improperly coming apart. The inspector's report of poor installation causing my floor to separate & lift. I am not asking for a refund of his ENTIRE job. I am ONLY asking for the area the inspector proved was caused by his neglect.
    10) ****** called & offered to settle with me on the last day. He offered $200 total. I can't cover anything with that amount of money, so I declined. Once I declined he started to make threats to me, to use my water leak as an excuse, etc. His response is no surprise. This is no way slander. It is the ****** so help me God word-for-word. I have damaged floors & the inspectors report to show my proof.
    Thank you for time on this.                   Thank you, ************************;    #********
