    I have seen employees wearing KSI vests, driving vehicles labeled KSI in my neighborhood, on my street, and specifically in my front yard at various times of the day for the past 3-4 weeks. Today, KSI employees hoisted what appeared to be a camera on a pole above my backyard fence from multiple angles for several minutes at a time. I did not observe these workers do this to any of my surrounding neighbors. I have never been contacted by or given permission to KSI to perform any type of work or survey my private property. I want to hear from the owner of this business what they are doing in my neighborhood and why they have been on my property without consent.

    I am writing in response to BBB complaint 185***61. The KSI employees that were in the area are land surveyors performing work that will be utilized for the design of updated water infrastructure within the Cal Water service area. As part of the requirement of this professional service, we need to know where the street right-of-way and existing utility infrastructure is located. This process ensures that no future design encroaches onto private property where easements to do so don’t exist.

     

    The item on top of a pole referenced to in the complaint was a GNSS receiver that collects and stores geospatial data. Some shots require a higher degree of accuracy, so a longer observation is needed.

     

    Regarding entering the private property, a common misconception is that property begins at the back of the sidewalk. For this neighborhood, the property line begins 30 feet from the center of the street (see attached map and red line below). This gives utility companies like power, cable, and water, the ability to stay within the public right-of-way to service the community. I have reviewed the field data, and no shots were collected past the back of sidewalk (see below).

     

     

    The surveyors were staying within the street right-of-way during this survey; however, land crews working under the direction of a professional land surveyor have a right of entry to real property under Section 8774 (a) of the California Business and Profession’s code which reads:

     

    1. The right of entry upon or to real property to investigate and utilize boundary evidence, and to perform surveys, is a right of persons legally authorized to practice land surveying, and it is the responsibility of the owner or tenant who owns or controls property to provide reasonable access without undue delay. The right of entry is not contingent upon the provision of prior notice to the owner or tenant. However, the owner or tenant shall be notified of the proposed time of entry where practicable.

     

    We operate with a strict, good neighbor policy, and my field crews are instructed to always notify a property owner should they need to access their property.

     

    I’m happy to answer any questions that the property owner has regarding our work, and I hope this letter serves as an adequate explanation and response to the complaint.
